Abstract

Dengan menerapkan Pendaftaran Tanah Sistematis Lengkap, pemerintah mempercepat program dengan mendorong partisipasi masyarakat. Desa Landungsari di Kabupaten Malang dipilih sebagai lokasi PTSL tahun 2023. Keterlibatan masyarakat dalam kegiatan PTSL di Desa Landungsari ditunjukan dengan partisipasi warga desa yang aktif mendaftarkan tanah mereka. Meskipun sudah ada partisipasi masyarakat dalam PTSL, pada kenyataannya tahapan tertentu masih belum melibatkan partisipasi masyarakat. Meskipun masyarakat telah berpartisipasi dalam kegiatan PTSL tetapi ternyata bentuk partisipasinya masih belum jelas. Tujuan penelitian ini untuk melakukan analisis dalam implementasi PTSL di Desa Landungsari. Jenis penelitian yang digunakan adalah penelitian sosio legal. Pendekatan penelitiannya pendekatan yuridis sosiologis. Data primer bersumber dari wawancara dengan responden. Populasi dalam penelitian ini adalah seluruh pegawai Kantor Pertanahan Kabupaten Malang dan seluruh warga desa Landungsari. Sampel menggunakan Teknik purposive sampling. Data yang diperoleh akan dianalisis menggunakan metode deskriptif analitis. Dalam penelitian ini diperoleh jawaban atas masalah di atas. Apabila dilihat secara substansi masih terdapat ketidaklengkapan. Kemudian secara struktur sudah terpenuhi. Kemudian secara kultur yang ada di masyarakat masih ada permasalahan berupa kurangnya pemahaman masyarakat terhadap peraturan yang berlaku. Sehingga berdasarkan ketiga faktor diatas maka cenderung peraturan tersebut belum berjalan efektif. Adapun hambatan yang terjadi adalah masih ada beberapa warga desa yang kurang berpartisipasi dalam melengkapi berkas persyaratan yang dibutuhkan. Kemudian solusi yang perlu dilakukan antara lain perlu adanya sosialisasi yang maksimal kepada warga agar memiliki antusias yang tinggi dalam mengikuti PTSL.

English Abstract

The application of comprehensive and systematic land registration initiated by the government is intended to expedite the program to improve public participation. Landungsari village in the Regency of Malang was chosen to be the location for the land registration program in 2023. Public involvement in this program in the area refers to active participation in land registration. This program is seen to have involved the members of the public although not all stages in the program involved their participation and the pattern of participation is murky. This research, therefore, is intended to analyze the implementation of the registration program in Landungsari village by employing a socio-legal method and sociojuridical approaches. The primary data were gamered from interviews with relevant respondents. The research population involved all the staff of the land office in the Regency of Malang and all resident in the village. Samples were taken based on a purposive sampling technique. The data were analyzed using a descriptive analysis. Upon the analysis results, there has been incompleteness in the substance. Although it is structurally fulfilled, there has been an issue in the culture of the community where people were not aware of the regulation in place. That is, the implementation of the regulation is not effective. The participation of the residents is considered not optimal in completing the required files for registration. This issue indicates that more profound information on the program needs to be given to the community to encourage them to join the program.
