Abstract
Perdagangan perempuan dan anak di Indonesia menjadi fenomena kejahatan transnsional yang marak di Indonesia. Di Jawa Timur, pada tahun 2020-2022 ada 50 tuntutan kasus perdagangan manusia di seluruh pengadilan negeri di Jawa Timur. Namun, pemberantasan perdagangan manusia di Indonesia belum memenuhi standar dan masih dalan kategori Tier 2. Pemberantasan perdagangan manusia, Indonesia telah memiliki kerangka hukum namun implementasi masih kurang dan jumlah kasus masih tinggi. Dalam sistem peradilan perdagangan manusia di Indonesia, Aparat Hukum terlalu fokus dalam mempidana pelaku, namun abai terhadap pemulihan hak- hak korban. Padahal, selain kerugian fisik, korban pun juga menderita kerugian psikis dan ekonomi akibat perbuatan para pelaku. Negara sudah selayaknya memberikan perlindungan dan jaminan terpenuhinya hak-hak korban. Bentuk perlindungan dan pemenuhan hak korban perdagangan manusia terutama perempuan dan anak telah diatur oleh ACTIP bersama ASEAN-ACT dalam Victim-sensitive Court Indicators. Dalam pemenuhan indiktor ini, aparat hukum indonesia yaitu penyidik, penuntut umum, dan pengadilan telah memenuhi beberapa aspek perlindungan dalam 6 indikator. Namun, pemenuhn indiktor ini belum maksimal dan inkonsisten.
English Abstract
Trafficking in women and children in Indonesia has become a widespread transnational crime phenomenon in Indonesia. In East Java, in 2020-2022 there were 50 prosecutions for human trafficking cases in all district courts in East Java. However, the eradication of human trafficking in Indonesia has not met standards and is still in the Tier 2 category. To eradicate human trafficking, Indonesia has a legal framework but the implementation is lacking and the number of cases is still high. In the human trafficking justice system in Indonesia, legal officials are too focused on convicting perpetrators, but neglect to restore the rights of the victims. In fact, apart from physical losses, victims also suffer psychological and economic losses due to the actions of the perpetrators. The state should provide protection and guarantee the fulfillment of victims' rights. The form of protection and fulfillment of the rights of human trafficking victims, especially women and children, has been regulated by ACTIP together with ASEAN-ACT in Victim-sensitive Court Indicators. In fulfilling this indicator, Indonesian legal officials, namely investigators, public prosecutors and courts, have fulfilled several aspects of protection in the 6 indicators. However, the fulfillment of this indicator is not optimal and inconsistent.
