Abstract
pembentukan basis data DNA nasional di Indonesia. Pilihan tema ini dilatar belakangi oleh lambatnya proses penyidikan, hal ini dikarenakan proses pengidentifikasian korban maupun tersangka masih menggunakan pencocokan data ante mortem dengan post mortem sebagai metode utama. Sehingga saat ini asas peradilan cepat, sederhana, dan biaya ringan susah untuk dipenuhi karena lambatnya proses pengidentifikasian dan biaya tes DNA di Indonesia yang terlampau tidak murah, lambatnya proses pengidentfikasian dipengaruhi salah satu faktor terdapat upaya penghilangan barang bukti data genetik yaitu DNA oleh pelaku tindak pidana, dikhawatirkan terjadi suatu peningkatan yang signifikan apabila pelaku tindak pidana memahami cara penghilangan barang bukti namun tingkat penanganan akan kasus masih tergolong lambat, terutama pada kasus pemerkosaan di mana alat bukti susah ditemukan. Maka pengaturan terkait basis data DNA nasional selaku alat yang telah terbukti membantu mempercepat proses penyidikan dan meminimalisir upaya salah tangkap harus segera dibentuk sesuai dengan prosedur hukum. Berdasarkan hal yang tertera di atas, maka penelitian ini merumuskan dua rumusan masalah, yaitu: (1) Apa urgensi pengaturan basis data nasional Deoxyribonucleic Acid (DNA) di Indonesia? (2) Bagaimana alternatif pengaturan basis data nasional Deoxyribonucleic Acid (DNA) di Indonesia? Kemudian penelitian ini menggunakan metode yuridis-normatif dengan metode pendekatan Pendekatan Perundang-Undangan (statue approach), Pendekatan Perbandingan Hukum (comparative approach), dan Pendekatan Konseptual (conceptual approach). Kemudian, dari bahan hukum primer, sekunder, dan tersier yang diperoleh akan menganalisis dengan menggunakan metode penafsiran bahasa (gramatikal), penafsiran sistematis, dan penafsiran komparatif. Dari hasil penelitian ini dengan menggunakan metode di atas, diperoleh jawaban atas rumusan masalah bahwa National DNA Database perlu dibentuk guna untuk mempercepat proses penyidikan, dan mencegah upaya recidive karena mengalihkan metode pengidentifikasian pencocokan data post mortem dengan data mortem sebagai metode utama menjadi pencocokan data post mortem dengan data di dalam database DNA nasional. Termasuk upaya mencegah terjadinya pengulangan tindak pidana dengan cara mempercepat proses pengidentifikasian untuk menggagalkan upaya yang dilakukan oleh recidiver untuk menghindari gagalnya sistem hukum karena suatu tindak kriminil yang dilakukan berulang tanpa adanya payung hukum yang dapat mengatasinya. Lalu melakukan studi perbandingan bahan hukum National DNA Database menjadikan UK dan US sebagai negara pembanding. Selanjutnya dilakukan perumusan alternatif pengaturan basis data DNA nasional di Indonesia dari hasil perbandingan pengaturan pembentukan basis data DNA nasional di UK dan US.
English Abstract
This research topic departed from the sluggish process of inquiry because the identification of victims or defendants still requires those in charge to match antemortem and post-mortem data as the main method. This condition has hampered the fulfilment of fast, simple, and affordable principles due to the slow identification process and costly DNA tests in Indonesia. This sluggishness is affected by losing genetic data of DNA as evidence by criminal offenders. There might be a significant change in the ability to lose evidence while the identification remains slow, particularly in the case of rape in which evidence is not easily found. The research results reveal that the National DNA Database needs to be approved to accelerate the inquiry process and prevent re-offenders from transferring the matching method of identification of post-mortem and mortem data in the national DNA database. This approach is also intended to prevent repeat offences by accelerating the identification process to hamper efforts made by re-offenders to avoid the failure of the legal system due to repeat offences without any reliable legal protection to tackle the problem. Based on what is listed above, the author formulates three problem formulations, namely: (1) What is the urgency of setting up a national Deoxyribonucleic Acid (DNA) database in Indonesia? (2) What are the alternatives to setting up a national Deoxyribonucleic Acid (DNA) database in Indonesia? Then this research uses a juridical-normative method with a statue approach, comparative approach, and conceptual approach. Then, the primary, secondary, and tertiary legal materials obtained will be analyzed using the methods of language interpretation (grammatical), systematic interpretation, and comparative interpretation. From the results of this study using the above method, answers were obtained to the formulation of the problem that the National DNA Database needs to be validated in order to speed up the investigation process, and prevent recidive efforts because it diverts the identification method of matching post mortem data with mortem data as the main method to matching post mortem data with data in the national DNA database. Including efforts to prevent the repetition of criminal acts by speeding up the identification process to thwart efforts made by recidivers to avoid the failure of the legal system due to a criminal act that is carried out repeatedly without a legal umbrella that can overcome it. Then conducting a comparative study of legal materials National DNA Database makes the UK and US as comparison countries. Furthermore, the formulation of alternative arrangements for national DNA databases in Indonesia was carried out from the results of comparisons of arrangements for the formation of national DNA databases in the UK and US.
