Abstract

Pada skripsi ini dengan judul yang diuraikan tersebut, penulis membahas Partisipasi masyarakat dalam perubahan suatu Undang-Undang sangat penting karena Undang-Undang hadir berdasarkan dengan kebutuhan masyarakat. Salah satunyanya adalah perubahan kedua UU Desa, mengingat tujuan dari dibentuknya undang-undang di negara hukum adalah untuk menciptakan suasana kesejahteraan masyarakat yakni melalui partisipasi masyarakat dalam pembentukan peraturan perundang-undangan sangat diperlukan untuk mengetahui aspirasi yang disampaikan, atas suatu rancangan undang-undang yang berakibat langsung kepada kesejahteraan rakyat, terlebih berkenaan dengan desa merupakan salah satu wilayah yang sangat vital karena perkembangan sejahteranya masyarakat ditentukan dari wilayah tersebut. Maka dari itu, berangkat dari pokok permasalahan ini, penulis tertarik untuk melakukan penelitian tersebut. Berdasarkan latar belakang dengan topik yang tercantum dalam skripsi ini, penulis merumuskan rumusan masalahnya diantaranya. Pertama, bagaimana upaya Badan Legislasi DPR RI untuk memenuhi unsur partisipasi masyarakat terkait perubahan masa jabatan Kepala Desa dalam perubahan kedua atas Undang-Undang Nomor 6 Tahun 2014 tentang Desa? Kedua, apa hambatan yang ditemui oleh Badan Legislasi DPR RI untuk memenuhi unsur partisipasi masyarakat terkait perubahan masa jabatan Kepala Desa dalam perubahan kedua atas Undang-Undang Nomor 6 Tahun 2014 tentang Desa? Adapun metode penelitian yang digunakan adalah yuridis empiris dengan pendekatan yuridis sosiologis untuk menemukan data primer dan data sekunder pada penulisan skripsi. Data primer diperoleh dengan cara wawancara kepada Anggota Badan Legislasi DPR RI, Pegawai Sekretariat Badan Legislasi DPR RI dan Asosiasi Kepala Desa. Data sekunder diperoleh dengan cara menganalisis kepustakaan seperti hasil Pustaka dari baik fisik atau digital tentang pembentukan undang-undang dan partisipasi masyarakat. Kemudian seluruh bahan yang diperoleh diolah dengan deskriptif kualitatif. Hasilnya adalah langkah yang dilakukan Badan Legislasi DPR RI baik secara kelembagaan ataupun anggota dalam memenuhi partisipasi masyarakat serta partisipasi yang bermakna sudah baik, meskipun masih belum optimal dalam prosesnya, karena ada hambatan-hambatan yang dilalui, baik itu hambatan internal secara kelembagaan atau hambatan eksternal dari pihak-pihak luar. Hambatan internal dan eksternal banyak faktor yang mempengaruhinya.

English Abstract

In this thesis with the title described, the author discusses community participation in changing a law is very important because the law is present based on the needs of the community. One of them is the second amendment to the Village Law, considering that the purpose of the establishment of laws in a state of law is to create an atmosphere of public welfare, namely through public participation in the formation of laws and regulations is needed to find out the aspirations conveyed, on a draft law that has a direct impact on the welfare of the people, especially with regard to the village is one of the most vital areas because the development of community welfare is determined from the region. Therefore, departing from this subject matter, the author is interested in conducting the research. Based on the background with the topics listed in this thesis, the author formulates the formulation of the problem including. First, what are the efforts of the Legislative Body of the House of Representatives to fulfill the element of community participation related to changes in the term of office of the Village Head in the second amendment to Law Number 6 of 2014 concerning Villages? Second, what are the obstacles encountered by the Legislation Body of the House of Representatives to fulfill the elements of community participation related to changes in the term of office of the Village Head in the second amendment to Law Number 6 of 2014 concerning Villages? The research method used is empirical juridical with a sociological juridical approach to find primary data and secondary data in writing the thesis. Primary data was obtained by interviewing members of the Legislative Body of the House of Representatives, employees of the Secretariat of the Legislative Body of the House of Representatives and the Village Head Association. Secondary data is obtained by analyzing literature such as the results of physical or digital literature on the formation of laws and community participation. Then all materials obtained are processed with descriptive qualitative. The result is that the steps taken by the Legislative Body of the House of Representatives both institutionally and by members in fulfilling public participation and meaningful participation are good, although it is still not optimal in the process, because there are obstacles that are passed, be it internal institutional obstacles or external obstacles from outside parties. Internal and external barriers have many influencing factors.
