Abstract
Penelitian ini bertujuan untuk mengetahui Mekanisme Pembatalan Perkawinan yang dilakukan oleh Kejaksaan Negeri Batu pada Putusan Pengadilan Agama Malang Nomor 988/Pdt.G/2021/Pa.Mlg. Penelitian ini menggunakan jenis penelitian hukum empiris dengan pendekatan kualitatif dengan penelitian yang berorientasi pada pengumpulan data empiris di lapangan. Dalam penelitian ini menggunakan metode wawancara, peraturan perundang-undangan, dan dokumen-dokumen resmi lainnya. Adapun hasil dari penelitian ini yaitu mekanisme Pembatalan Perkawinan yang dilakukan Oleh Kejaksaan Negeri Batu ini sudah sesuai dengan peraturan dan perundang-undangan mengenai prosedur yang harus diterapkan oleh pelaksana. Kejaksaan Negeri Batu memiliki beberapa kendala mengenai keberadaan pihak Pemohon yaitu Sdri. Maghfiroh yang sedang bekerja di luar negeri dan lokasi kediaman dari pihak Termohon yang tidak sesuai dengan yang ada di Kartu Identitas. Dari kedua kendala tersebut, Jaksa Pengacara Negara melakukan upaya untuk dapat berkoordinasi dengan lancar melalui daring dengan pihak Pemohon dan turun langsung dalam mencari lokasi kediaman para Termohon yang sebenarnya.
English Abstract
This study aims to find out the mechanism for annulment of marriages carried out by the Batu District Prosecutor's Office in the Decision of the Malang Religious Court Number 988/Pdt.G/2021/Pa.Mlg. This study uses empirical legal research with a qualitative approach with research oriented to empirical data collection in the field. In this study using the interview method, laws and regulations, and other official documents. The results of this study are that the mechanism for annulment of marriages carried out by the Batu District Prosecutor's Office is in accordance with the rules and regulations regarding the procedures that must be implemented by the executor. The Batu State Prosecutor's Office has several obstacles regarding the whereabouts of the Petitioner, namely Ms. Maghfiroh who is currently working abroad and the residence location of the Respondent does not match what is on the Identity Card. Of these two obstacles, the State Attorney's Prosecutor made efforts to be able to coordinate smoothly online with the Petitioners and directly involved in finding the real location of the Respondents' residences.
