Abstract

Peraturan Daerah Nomor 1 Tahun 2020 merupakan suatu Peraturan Daerah yang tercetus karena adanya jaminan hak dan kewajiban setiap orang atau warga negara yang diberikan oleh negara dalam hal mencapai persamaan kedudukan di dalam hukum. Dalam hal ini persaman kedudukan yang dimaksud adalah tanpa memandang suku, agama, ras, budaya serta status sosial. Dalam Peraturan Wali Kota Batu ini, khususnya masyarakat miskin mendapatkan jaminan hak yaitu persamaan kedudukan di dalam hUkum dalam bentuk bantuan hUkum secara gratis yang diberikan oleh Pemerintah Daerah yang disini adalah Pemerintah Daerah Kota Batu. Dalam Implementasi Peraturan Wali Kota ini terdapat beberapa hambatan atau kendala yang menyebabkan kurang efektif dalam pelaksanaannya, kendala atau hambatan tersebut adalah kurangnya kelengkapan berkas yang dibawa oleh masyarakat dalam mengajukan permohonan bantuan hukum kemudian minimnya informasi yang diterima oleh masyarakat artinya banyak masyarakat yang belum tau mengenai program bantuan hukum ini serta perluasan informasi yang dilakukan oleh Pemerintah Kota Batu khususnya Bagian Hukum belum terlaksanakan secara maksimal karena belum mencakup banyak daerah di Kota Batu. Namun dari beberapa hambatan atau kendala yang terjadi, terdapat beberapa solusi atau cara agar Implementasi tersebut dapat berjalan dengan baik dan efektif.

English Abstract

Regional Regulation Number 1 of 2020 is a Regional Regulation which was issued because of the guarantee of the rights and obligations of every person or citizen provided by the state in terms of achieving equality of position under the law. position in law. In this case, equality of position is meant without regard to ethnicity, religion, race, culture and social status. In this Batu Mayor's Regulation, especially the poor receive guaranteed rights, namely equal status under the law in the form of free legal assistance provided by the Regional Government, which here is the Batu City Regional Government. In the implementation of this Mayor's Regulation, there are several obstacles or obstacles that cause its implementation to be less effective. These obstacles or obstacles are the lack of completeness of the files brought by the community when applying for legal aid and then the lack of information received by the community, meaning that many people do not know about the program. This legal assistance as well as the expansion of information carried out by the Batu City Government, especially the Legal Department, has not been implemented optimally because it does not cover many areas in Batu City. However, from several obstacles or constraints that occur, there are several solutions or ways so that the implementation can run well and effectively.
