Abstract
Menurut Pasal 35 ayat (1) Peraturan Pemerintah Nomor 142 Tahun 2015 Tentang Kawasan Industri, kawasan industri wajib memiliki tata tertib, PT JIEP selaku pengelola sekaligus pengembang kawasan industri mengeluarkan estate regulation sebagai salah satu tata tertib di kawasan industri yang dikelolanya. Pada Bab VI poin 2.3 estate regulation, terdapat ketentuan bahwa PKL yang melakukan kegiatankegiatannya di area yang tidak diperkenankan oleh PT JIEP dan harus berada di lokasi yang sudah ditentukan oleh PT JIEP. Akan tetapi masih banyak PKL yang berjualan. Tugas akhir ini membahas tentang penertiban terkait kegiatan PKL yang berjualan di area kawasan industri secara bebas. Dan pembahasan ditekankan terhadap bagaimana pelaksanaan serta hambatan maupun upaya PT JIEP dalam penertiban PKL di Kawasan Industri Pulogadung apakah sudah sudah berjalan dengan baik sesuai regulasi yang berlaku. Hasil penelitian ditemukan bahwa pelaksanaan penertiban belum mandapatkan hasil yang maksimal karna masih banyak PKL yang berjualan di area Kawasan Industri Pulogadung. Saran dari peneliti adalah menciptakan sistem baru, dimana PKL yang ekonominya rendah tetap ingin berjualan di kawasan industri tersebut diberikan diberikan kompensasi biaya sewa yang minim juga subsidi berupa (biaya pemakaian listrik, air, dan telepon). Penelitian ini menggunakan jenis penelitian yuridis empiris dan menggunakan pendekatan penelitian yuridis empiris.
English Abstract
According to Article 35 paragraph (1) of Government Regulation Number 142 of 2015 concerning Industrial Estates, industrial estates are required to have regulations, PT JIEP as the manager and developer of the industrial estate issues an estate regulation as one of the regulations in the industrial estate it manages. In Chapter VI point 2.3 estate regulation, there is a provision that street vendors who carry out their activities in areas that are not permitted by PT JIEP and must be in a location determined by PT JIEP. However, there are still many street vendors selling. This final project discusses the regulation related to the activities of street vendors who sell freely in industrial area areas. And the discussion emphasized how the implementation and obstacles as well as PT JIEP's efforts in controlling street vendors in the Pulogadung Industrial Area have been going well according to applicable regulations. The results of the study found that the implementation of the control had not yielded maximum results because there were still many street vendors selling in the Pulogadung Industrial Area. The suggestion from the researcher is to create a new system, where street vendors who have a low economy still want to sell in the industrial area are compensated with minimal rental costs as well as subsidies in the form of (costs for using electricity, water and telephone). This research uses a type of empirical juridical research and uses an empirical juridical research approach.
