Abstract

Impelementasi peraturan walikota Batu nomor 29 tahun 2019 merupkana peraturan yang harus dipatuhi pemerintahan kota Batu dalam membuat sebuah produk hukum salah satunya peraturan walikota Batu. Penelitian ini untuk mengetahui bahwa peraturan yang dikeluarkan oleh kepala pemerintahan kota atau walikota yang memiliki kekuatan hukum untuk mengatur tata kelola kota, mengontrol perilaku masyarakat, dan mengatur kegiatan ekonomi serta lingkungan. Peraturan walikota dibuat oleh bagian hukum yang mana memiliki fungsi dan tugasnya dalam menelitim mengkaji, menyusun, menelaah, legal draft rancangan peratruan walikota. Terdapat hambatan dalam proses pembutannya. 1) Perangkat Daerah mengajukan draft produk hukum tidak memberikan nota penjelasan. 2) kurangnya paham terhadap produk hukum yang akan disusun. 3) lambat waktunya koodinasi. 4) tidak selarasnya bagian hukum, kemendagri, kanwil dan biro hukum. Dari hambatan tersebut menyebabkan pembuatan peraturan walikota mendapat proses yang lebih lama dalam pembuatannya, dari hambatan tersebut terdapat beberapa solusi yang mampu menyelesaikan masalah tersebut dengan baik.

English Abstract

The implementation of the Batu mayor's regulation number 29 of 2019 is a regulation that the Batu city government must comply with in making a legal product, one of which is the Batu mayor's regulation. This research is to find out that regulations issued by heads of city governments or mayors have legal force to regulate city governance, control people's behavior, and regulate economic and environmental activities. The mayor's regulation is made by the legal division which has the function and duties of researching, studying, compiling, studying, legal drafts of the mayor's regulation draft. There are obstacles in the manufacturing process. 1) The Regional Apparatus submits a draft law product without providing an explanatory note. 2) lack of understanding of the legal products to be drafted. 3) slow coordination time. 4) the legal department, the ministry of home affairs, regional offices and law firms are not aligned. From these obstacles, the making of mayoral regulations takes a longer process to make, from these obstacles there are several solutions that are able to solve the problem properly.
