Abstract
Tugas akhir ini berjudul “Mekanisme Balik Nama Sertifikat Hak Milik Dalam Jual Beli Tanah Pada Kantor Pejabat Pembuat Akta Tanah”. Balik Nama Sertifikat merupakan suatu proses merubah status kepemilikan dari penjual sebagai pemilik tanah sebelumnya kepada pembeli sebagai pemilik tanah yang baru. Penelitian ini bertujuan untuk mengetahui pelaksaan mekanisme balik nama sertifikat hal milik dalam jual beli tanah di kantor pejabat pembuat akta tanah. Jenis penelitian ini adalah penelitian yuridis empiris dengan menggunakan pendekatan secara langsung dan jenis data yang digunakan berasal dari data primer dan sekunder. Teknik pengumpulan data dalam penelitian ini menggunakan observasi, wawancara, dan studi dokumentasi. Dari hasil penelitian yang dilakukan, ditemukan bahwa proses balik nama sertifikat hak milik dalam jual beli tanah belum sepenuhnya berjalan dengan baik karena kurangnya kesadaran dan pemahaman dari masyarakat itu sendiri. Dari adanya hal tersebut pada akhirnya memunculkan beberapa kendala yang harus mampu ditangani sehingga tidak menimbulkan hambatan dalam pelaksanaannya. Dimana dari setiap kendala ini ada beberapa upaya yang dapat dilakukan untuk menyelesaikannya.
English Abstract
This final project is entitled "Mechanism of Transferring the Name of Property Rights Certificates in the Sale and Purchase of Land at the Office of the Official for Making Land Deeds". Transferring the name of the certificate is a process of changing the ownership status from the seller as the previous land owner to the buyer as the new land owner. This study aims to find out the implementation of the mechanism for transferring the name of ownership certificates in buying and selling land in the office of the official who made the land deed. This type of research is empirical juridical research using a direct approach and the type of data used comes from primary and secondary data. Data collection techniques in this study used observation, interviews, and documentation studies. From the results of the research conducted, it was found that the process of transferring the name of a certificate of ownership in buying and selling land has not gone well due to a lack of awareness and understanding from the community itself. From the existence of this in the end raises several obstacles that must be able to be handled so as not to cause obstacles in its implementation. Where from each of these obstacles there are several efforts that can be made to solve them. Keywords: Buying and selling, transfer of name, land, land deed official.
