Abstract

Pada penulisan skripsi ini dilatarbelakangi dengan memperhatikan bahwa salah satu diantara kejahatan yang sangat tertutup serta terorganisir ialah tindak pidana narkotika. BNN (Badan Narkotika Nasional) bersama Penyidik Kepolisian Negara Republik Indonesia (POLRI) merasa sangat sulit untuk membongkar kejahatan narkotika serta mengungkap siapa bandar besar yang berperan di belakangnya. Seiring berjalannya waktu, dalam perihal pengungkapan kejahatan terorganisir itu terdapat pola pikir yang searah dari para aparat hukum untuk menemukan inovasi dalam menemukan solusi untuk mengungkap kejahatan yang sangat tertutup, dengan demikian dikenal istilah justice collaborator yang berarti saksi pelaku yang terlibat dalam tindak pidana yang berkolaborasi bersama aparat penegak hukum. Adapun rumusan masalah berdasarkan latar belakang tersebut yakni, pertama apakah dasar pertimbangan hakim dalam menjatuhkan sanksi pidana yang lebih berat terhadap terdakwa yang berstatus sebagai justice collaborator dalam putusan Nomor : 320 /Pid.Sus/2020/PN.Pbr, kedua bagaimanakah urgensi pengaturan justice collaborator dalam perkara tindak pidana narkotika. Dalam menjawab rumusan masalah tersebut penulis menerapkan metode penelitian yuridis normatif dengan pendekatan undang-undang dan pendekatan kasus. Bahan hukum yang digunakan meliputi bahan hukum primer dan sekunder dengan teknik penelusuran bahan hukumnya yakni melalui studi kepustakaan. Dengan demikian penulis mendapatkan hasil dari penelitian ini yakni regulasi yang mengatur perihal justice collaborator di Indonesia pada saat ini masih belum bisa menjamin kepastian perlindungan hukum terhadap justice collaborator, hal tersebut dibuktikan dengan adanya kasus perkara Nomor : 320/Pid.Sus/2020/PN.Pbr yang belum sepenuhnya memenuhi hak-hak terdakwa yang berstatus sebagai justice collaborator.

English Abstract

The background for writing this thesis is to pay attention to notice that one of the most closed and organized crimes is narcotics crime. BNN (National Narcotics Agency) together with Indonesian National Police Investigators (POLRI) find it very difficult to dismantle narcotics crimes and reveal who the big dealers are behind it. Over time, in the matter of disclosing organized crime, there isaone way mindset from legal officials to find innovation in finding solutions to uncover crimes that are very secretive, thus the term justice collaborator is known, which means witness who are involved in criminal acts who collaborate together. The formulation of the problem based on this background is, first, what is the ideal legal arrangement for justice collaborator in the criminal justice system in Indonesia, second, what is the urgency of implementing justice collaborator in narcotics crime cases in Indonesia. In answering the formulation of the problem, the author usesanormative juridicial research method withastatutory approach andacase approach. The legal materials used include primary and secondary legal materials with the technique of tracing legal materials through literature studies and in analyzing these legal materials using grammatical and systematic interpretations. Thus the authors get the results of this research, namely that regulations governing justice collaborators in Indonesia at this time still cannot guarantee certainly of legal protection for justice collaborators, this is evidenced by the existence of case number 320/Pid.Sus/2020/PN.Pbr who have not fully fulfilled the rights of the accused who has the status ofajustice collaborator.
