Abstract

Pada penelitian ini peneliti mengangkat permasalahan mengenai ketidaksesuaian antara das sollen dan das sein pada Pasal 14 Undang -undang No. 30 Tahun 2000 tentang Rahasia Dagang terhadap racikan biji kopi house blend di Armor Kopi Bandung. Dalam hal ini terjadi oknum yang pernah bekerja di Armor Kopi Bandung menguasai rahasia dagang. Perbuatan yang dilakukan oleh oknum ini bertentangan dengan peraturan yang tercantum di Pasal 14 Undang-undang No. 30 Tahun 2000 tentang Rahasia Dagang, pemilik rahasia dagang berhak penuh atas racikan biji kopi house blend-nya dan berhak mendapatkan perlindungan hukum. Berdasarkan hal yang telah disebutkan di atas, dalam skripsi ini peneliti mengangkat dua rumusan masalah, yaitu: (1) Bagaimana implementasi pasal 14 Undang-undang No. 30 Tahun 2000 tentang Rahasia Dagang mengenai racikan biji kopi house blend di Armor Kopi Bandung? (2) Apa saja faktor-faktor penghambat dan bagaimana upaya penyelesaian Cafe Armor Kopi dalam melindungi racikan biji kopi House blend sebagai objek rahasia dagangnya berdasarkan pasal 14 Undang-undang No. 30 Tahun 2000 tentang Rahasia Dagang? Penulisan skripsi ini menggunakan metode penelitian sosio legal dengan pendekatan yuridis sosiologis. Data primer dan data sekunder diperoleh dengan teknik purposive sampling yang dianalisis menggunakan teknik data kualitatif menggunakan teori Lawrence M. Friedman mengenai efektivitas penegakan hukum yaitu substansi hukum, struktur hukum, dan budaya hukum. Dari penelitian, peneliti mendapatkan jawaban atas permasalahan yang ada bahwa implementasi Pasal 14 Undang-undang No. 30 Tahun 2000 tentang Rahasia Dagang belum terlaksana dengan baik. Substansi hukum pasal 14 Undang-undang No. 30 Tahun 2000 tentang Rahasia Dagang telah mengatur dengan baik, namun substansi dalam perjanjian kerja Armor Kopi Bandung belum terlaksana dengan baik dikarenakan dalam perjanjian kerja Armor Kopi Bandung belum memuat secara menyeluruh mengenai batasan-batasan apa saja mengenai hal yang diperbolehkan dan dilarang terutama mengenai rahasia dagang. Sehingga substansi hukum dalam penelitian ini sebagian belum terlaksana dengan baik. Struktur hukum belum berjalan dengan baik disebabkan aparat penegak hukum belum bekerja maksimal dalam mengawasi dan memberi edukasi terkait kasus menguasai rahasia dagang racikan biji kopi House blend. Budaya hukum belum terlaksana dengan baik dikarenakan adanya faktor ketidaktahuan pemilik Armor Kopi Bandung selaku pemegang rahasia dagang yang diambil haknya secara bertentangan dengan undang-undang maupun oknum pekerja yang tidak mengetahui bahwa tindakan yang dilakukannya melanggar pasal 14 Undangundang No. 30 Tahun 2000 tentang Rahasia Dagang. Upaya penyelesaiannya terbagi menjadi dua yaitu preventif dan represif yang telah dilakukan oleh pemilik Cafe Armor Kopi Bandung namun belum terlaksana dengan optimal sehingga implementasi belum berjalan dengan baik.

English Abstract

In this research, the researcher addresses the issue of inconsistency between "das sollen" (what should be) and "das sein" (what is) in Article 14 of Law No. 30 of 2000 concerning Trade Secrets regarding the blend of coffee beans known as "House Blend" at Armor Coffee Bandung. In this case, there has been a misappropriation of trade secrets by individuals who previously worked at Armor Coffee Bandung. These actions contradict the regulations stipulated in Article 14 of Law No. 30 of 2000 concerning Trade Secrets, wherein the owner of a trade secret has full rights over their House Blend coffee bean blend and is entitled to legal protection. Based on the aforementioned points, this thesis formulates two research questions: (1) How is Article 14 of Law No. 30 of 2000 concerning Trade Secrets implemented regarding the House Blend coffee bean blend at Armor Coffee Bandung? (2) What are the inhibiting factors for Cafe Armor Coffee in protecting their House Blend coffee bean blend as a trade secret object, according to Article 14 of Law No. 30 of 2000 concerning Trade Secrets? This thesis employs a socio-legal research method with a socio-legal juridical approach. Primary and secondary data were obtained through purposive sampling techniques and analyzed using qualitative data analysis techniques, utilizing Lawrence M. Friedman's theory on the effectiveness of law enforcement, including legal substance, legal structure, and legal culture. From the research, the researcher found answers to the existing problems that the implementation of Article 14 of Law No. 30 of 2000 concerning Trade Secrets has not been carried out properly. The legal substance of Article 14 of Law No. 30 of 2000 concerning Trade Secrets has been well regulated. However, the substance in the employment agreement of Armor Kopi Bandung has not been properly implemented because the employment agreement of Armor Kopi Bandung does not comprehensively outline the limitations regarding what is allowed and prohibited, especially concerning trade secrets. Therefore, the legal substance in this research has not been fully implemented properly. The legal framework has not been functioning well due to the law enforcement officers of the West Java Regional not working to the maximum in monitoring and educating on cases related to the acquisition of the trade secrets of the House Blend coffee bean mixture. The legal culture has not been properly implemented due to factors such as the ignorance of the owner of Armor Kopi Bandung as the holder of the trade secret, which was taken against the law, and employees who do not know that their actions violate Article 14 of Law No. 30 of 2000 concerning Trade Secrets. Efforts to resolve it are divided into two, namely preventive and repressive, which have been carried out by the owner of Cafe Armor Kopi Bandung but have not been optimally implemented, so the implementation has not been going well.
