Abstract

Perusahaan asuransi diwajibkan memiliki paling sedikit satu pengendali perusahaan asuransi, untuk antisipasi apabila kerugian, kasus gagal bayar, wanprestasi. Pasal 15 Undang-Undang Perasuransian menyatakan pengendali perusahaan asuransi wajib menanggung kerugian yang disebabkan oleh perusahaan asuransi. Pada penelitian ini dikaitkan dengan contoh adanya nasabah perusahaan asuransi yang tidak terbayarkan klaimnya akibat dari kasus gagal bayar dari perusahaan asuransi. Adanya frasa kerugian dalam Pasal 15 Undang-Undang Perasuransian menimbulkan kekaburan hukum karena tidak adanya pengaturan lebih lanjut dan penafsiran atas kata kerugian menjadi multitafsir. Dari latar belakang di dapatkan rumusan masalah, pertama ruang lingkup kerugian yang ditanggung oleh Pengendali berdasarkan ketentuan pasal 15 Undang-Undang Perasuransian pada putusan nomor 676/PDT/2021/PT.DKI dan kedua mengenai batasan tanggung jawab pengendali perusahaan asuransi terhadap nasabah yang tidak terbayarkan klaimnya. Tujuan penelitian ialah menganalisis dan menemukan ruang lingkup kerugian dan batasan tanggung jawab yang dapat ditanggung oleh Pengendali pada putusan nomor 676/PDT/2021/PT.DKI Jenis penelitian menggunakan penelitian yuridis normatif dengan menggunakan pendekatan undang-undang, pendekatan konseptual dengan teknik penelusuran bahan hukum studi kepustakaan dan teknik analisis bahan hukum menggunakan interprestasi gramatikal dan interprestasi sistematis. Dari hasil penelitian ini menyimpulkan, Ruang lingkup kata kerugian pada putusan nomor 676/PDT/2021/PT.DKI yang diatur dalam pasal 15 Undang-Undang Nomor 40 Tahun 2014 tentang Perasuransian yang menyatakan bahwa pengendali perusahaan asuransi wajib mengganti kerugian yang dialami oleh perusahaan asuransi didasarkan pada terpenuhinya unsur-unsur perbuatan melawan hukum pada Pasal 1365 KUHPerdata, diperkuat dengan adanya pelanggaran prinsip kehati-hatian dalam perusahaan asuransi tersebut dalam menjalankan perusahaannya, sehingga kerugian yang dimaksud adalah kerugian yang disebabkan oleh perbuatan melawan hukum. Batasan tanggung jawab pengendali perusahaan asuransi terhadap nasabah pemegang asuransi jiwa yang tidak terbayarkan klaimnya akibat dari kasus gagal bayar perusahaan asuransi adalah hanya bertanggung jawab sebesar saham yang dimilikinya.

English Abstract

Insurance companies are required to have at least one insurance company controller, this is used to anticipate things such as losses, cases of failure to pay, default or bankruptcy. Article 15 of Law number 40 of 2014 concerning Insurance states that the controller of an insurance company is obliged to bear losses caused by the insurance company. This research is related to an example of an insurance company customer whose claim was not paid as a result of a case of payment crows from the insurance company. The existence of the phrase loss in Article 15 of Law Number 40 of 2014 on Insurance creates legal ambiguity because there is no further regulation regarding losses referred to in the provisions of Article 15, causing the interpretation of the word loss to be subject to multiple interpretations. From this background, two problem formulations were obtained, firstly the scope of losses borne by the Controller based on the provisions of article 15 of Law Number 40 of 2014 concerning Insurance in decision number 676/PDT/2021/PT.DKI and secondly regarding the limits of the controller's responsibility insurance company against customers holding life insurance policies whose claims have not been paid as a result of the insurance company's failure to pay. The aim of this research is to analyze and find the scope of losses that can be borne by controllers in decision number 676/PDT/2021/PT.DKI and to analyze the limits of responsibility of insurance company controllers towards customers who hold life insurance policies whose claims have not been paid as a result of cases of default. insurance company. This type of research uses normative juridical research using a statutory approach, a conceptual approach using literature study legal material search techniques and legal material analysis techniques using grammatical interpretation and systematic interpretation. From the results of this research, it can be concluded that (1) The scope of the word loss in decision number 676/PDT/2021/PT.DKI is regulated in article 15 of Law Number 40 of 2014 concerning Insurance which states that insurance company controllers are obliged to compensate for losses suffered by insurance companies are based on the fulfillment of the elements of unlawful acts in Article 1365 of the Civil Code, strengthened by violations of the precautionary principle in the insurance company, so that the losses in question are losses caused by unlawful acts. (2) The limit of responsibility of an insurance company controller towards customers holding life insurance whose claims are not paid as a result of cases of failure to pay by the insurance company is that they are only responsible for the amount of shares they own.
