Abstract

Pada skripsi ini, penulis mengangkat permasalahan urgensi pengaturan Anti-SLAPP berdasarkan hukum perlindungan konsumen. Pilihan tema tersebut dilatarbelakangi oleh adanya ketidaklengkapan norma dalam Pasal 4 huruf D Undang-Undang No.8 Tahun 1999 tentang Perlindungan Konsumen terkait pengaturan Anti-SLAPP. Hal ini dibuktikan dengan maraknya sengketa konsumen digugat oleh pelaku usaha yang merasa dirusak citranya akibat kritik, keluhan, atau review dari konsumennya. Meskipun Pasal 4 UUPK diatur tentang hak konsumen untuk didengarkan keluhannya dan ketika dirugikan konsumen berhak menggugat sebagaimana diatur dalam Pasal 45 namun masih sering konsumen tidak mendapatkan haknya bahkan malah di gugat balik/ SLAPP.Hal demikian terjadi karena belum adanya mekanisme anti gugat balik oleh pelaku usaha terhadap konsumen. Kasus SLAPP yang sempat menyita perhatian publik yaitu Prita Mulyasari melawan Omni Hospital International, PT.MSU menggugat konsumennya (kasus Meikkarta), dan masih banyak lagi. Berdasarkan hal tersebut, skripsi ini mengangkat rumusan masalah sebagai berikut: (1) Bagaimana urgensi pengaturan Anti-strategic lawsuit against public participation di Indonesia ditinjau dari perspektif hukum perlindungan konsumen? (2) Bagaimana model pengaturan Anti-strategic lawsuit against public participation yang tepat di Indonesia? Kemudian penulisan karya tulis ini menggunakan metode penelitian yuridis normatif dengan metode pendekatan peraturan perundang-undangan (statute approach) dan pendekatan kasus (case approach). Bahan hukum yang diperoleh penulis akan dianalisis dengan menggunakan metode penafsiran gramatikal dan interpretasi komparatif. Berdasarkan hasil penelitian, pengaturan Anti-SLAPP didalam UU Perlindungan Konsumen memiliki urgensi yurisidis, filosofis dan sosiologis yaitu adanya ketidaklengkapan norma dalam UU Perlindungan Konsumen terkait Anti-SLAPP, pengaturan anti-SLAPP dapat menjadi alat kontrol gugatan terhadap konsumen dalam memperjuangan haknya, konsumen yang digugat secara perdata tidak dapat dilindungi dengan UU No. 13 Tahun 2006 tentang Perlindungan Saksi dan Korban dengan kata lain konsumen tidak dipandang sebagai korban dalam sengketa perlindungan konsumen sehingga UU Perlindungan Konsumen harus memfasilitasi perlindungan hukum yang mumpuni bagi konsumen, mengatasi penyalahgunaan hukum oleh pihak yang memiliki kekuatan finansial dan menyalahgunakan kedudukannya dalam hal ini adalah pelaku usaha yang tidak beritikad baik. Sehingga penulis memberikan beberapa rekomendasi kepada pemerintah yakni legislatif dan Presiden, pelaku usaha serta konsumen untuk memperbaharui UU Perlindungan Konsumen dengan menambahkan substansi Anti-SLAPP didalamnya untuk memperkuat jaminan perlindungan hukum bagi konsumen dan menindaktegas pelaku usaha yang anti kritik sehingga tercipta pasar dan iklim transaksi komersil yang sehat.

English Abstract

This thesis, the author raises the issue of the urgency of anti-SLAPP regulation based on consumer protection law. In this thesis, the author raises the issue of the urgency of regulating Anti-SLAPP based on consumer protection law. The choice of theme is motivated by the incompleteness of the norms in Article 4 letter D of Law No.8 of 1999 concerning Consumer Protection related to Anti-SLAPP arrangements. This is evidenced by the rampant consumer disputes sued by business actors who feel their image is damaged due to criticism, complaints, or reviews from their consumers. Although Article 4 of the right of consumers to have their complaints heard and when harmed, consumers have the right to sue as stipulated in Article 45, but consumers still often do not get their rights and are even sued back / SLAPP.This happens because there is no anti-slapback mechanism by business actors against consumers. SLAPP cases that have grabbed public attention are Prita Mulyasari against Omni Hospital International, PT.MSU suing its consumers (Meikkarta case), and many more. Based on this, this thesis raises the following problem formulations: (1) What is the urgency of regulating Anti-strategic lawsuit against public participation in Indonesia from the perspective of consumer protection law? (2) What is the appropriate model for regulating Anti-strategic lawsuit against public participation in Indonesia? This paper uses normative juridical research method with statute approach and case approach. Legal materials obtained by the author will be analyzed using the method of grammatical interpretation and comparative interpretation. Based on the results of the research, the Anti-SLAPP regulation in the Consumer Protection Law has jurisidical, philosophical and sociological urgency, namely the existence of incomplete norms in the Consumer Protection Law related to Anti-SLAPP, anti-SLAPP regulation can be a means of controlling lawsuits against consumers in fighting for their rights, consumers who are sued civilly cannot be protected by Law No. 13/2006 on Witness and Victim Protection, in other words, consumers are not seen as victims in consumer protection disputes so that the Consumer Protection Law must facilitate qualified legal protection for consumers, overcome legal abuse by parties who have financial power and abuse their rights. 13/2006 on Witness and Victim Protection, consumers are not seen as victims in consumer protection disputes so that the Consumer Protection Law must facilitate qualified legal protection for consumers, overcome legal abuse by parties who have financial strength and abuse their position, in this case, business actors who are not in good faith. Therefore, the author provides several recommendations to the government, namely the legislature and the President, business actors and consumers to update the Consumer Protection Law by adding Anti-SLAPP substance in it to strengthen the guarantee of legal protection for consumers and repress anti-critical business actors so as to create a healthy market and commercial transaction climate.
