Abstract

Permasalahan yang dikaji dalam skripsi ini dilatarbelakangi dengan permasalahan yang belakangan banyak ditemukan pengguna jejaring sosial yang menceritakan alur sebuah film atau storytelling film. Hal tersebut bisa berakibat kepada berkurangnya pendapatan hasil dari pembuatan sebuah film dan dapat menjadi sebuah pelanggaran hak ekonomi maupun hak moral yang dimiliki oleh pencipta karya film tersebut. Berdasarkan hal tersebut diatas, skripsi ini mengangkat rumusan masalah: (1) Apakah konten video storytelling film yang berisikan potongan film milik orang lain dapat diberikan perlindungan hak cipta sebagai karya yang dilindungi dalam Pasal 40 Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta, (2) Bagaimana Akibat Hukum pada konten video storytelling film yang berisikan alur cerita dalam film milik orang lain menurut ketentuan Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta. Kemudian penulisan skripsi ini menggunakan metode yuridis normatif dengan metode pendekatan perundang-undangan dan pendekatan analisis. Bahan hukum primer, sekunder, dan tersier yang diperoleh penulis akan dianalisis dengan menggunakan metode penafsiran sistematis dan gramatikal Berdasarkan rumusan masalah diatas, penulis berkesimpulan dengan disebutkannya karya sinematografi dalam Pasal 40 ayat (1) huruf m sebagai suatu karya cipta yang dilindungi, dengan dibuatnya konten video storytelling atas alur sebuah film, perbuatan tersebut dikatakan sebagai menyalahi hak-hak pemilik hak cipta atas ciptaannya. Pada akhirnya oknum pelaku yang membuat konten video berupa storytelling alur atas sebuah film di media sosial secara jelas melakukan pelanggaran hak cipta yang meciptakan kerugian berdasarkan pasal 98 dan pasal 99 Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta.

English Abstract

The problems studied in this thesis are motivated by problems that have recently been found by many social network users who tell the plot of a movie or movie storytelling. This can result in reduced income from making a movie and can be a violation of the economic rights and moral rights of the creator of the movie. Based on the foregoing, this thesis raises the formulation of the problem: (1) Can storytelling movie video content containing pieces of film belonging to others be granted copyright protection as works protected in Article 40 of Law Number 28 of 2014 concerning Copyright, ( 2) What are the legal consequences for video storytelling movie content that contains storylines in movies belonging to other people according to the provisions of Law Number 28 of 2014 concerning Copyright. Then the writing of this thesis uses a normative juridical method with a statutory approach and an analytical approach. The primary, secondary, and tertiary legal materials obtained by the author will be analyzed using systematic and grammatical interpretation methods. Based on the formulation of the problem above, the author concludes that by mentioning cinematographic works in Article 40 paragraph (1) letter m as a protected copyright work, with the creation of storytelling video content on the plot of a movie, the act is said to violate the rights of the copyright owner on his creation. In the end, the perpetrators who create video content in the form of storytelling plots of a movie on social media clearly commit copyright infringement which creates losses based on article 98 and article 99 of Law Number 28 of 2014 concerning Copyright.
