Abstract

PPAT merupakan pejabat yang bertugas membantu sebagian wewenang BPN dalam pendaftaran tanah melalui pembuatan alat bukti berupa akta peralihan hak maupun pembebanan hak. Sebelum dilaksanakan peralihan, seorang PPAT diwajibkan memastikan dan yakin bahwa data yang tercantum dalam sertipikat hak atas tanah telah sesuai dengan data fisik dan data yuridis serta bebas dari sengketa, blokir, maupun sita jaminan. Namun ketika telah dilaksanakan pengecekan sertipikat dan dinyatakan “bersih” serta telah dilaksanakan tanda tangan kemudian timbul sengketa maka akan mengakibatkan kerugian yang tentu saja beresiko terhadap kinerja PPAT. Berdasarkan latar belakang tersebut diatas, karya tulis ini mengkaji (1) Bagaimana tanggung jawab PPAT yang telah melaksanakan pengecekan namun timbul sengketa setelah ditandatanganinya suatu akta? (2) Bagaimana Implikasi Yuridis bagi PPAT yang telah melakukan pengecekan namun timbul sengketa setelah ditandatanganinya suatu akta? Untuk menjawab permasalahan diatas, penelitian hukum normatif ini menggunakan pendekatan perundang-undangan dengan bahan hukum yang diperoleh melalui penelusuran kepustakaan. Berdasarkan pembahasan, maka dapat disimpulkan (1) tanggung jawab PPAT hanya setelah proses penandatanganan akta, karena PPAT telah melaksanakan amanat dari Pasal I angka 28 Permen ATR/BPN No.16 Tahun 2021 yaitu melalui pengecekan sertipikat sebelum dilaksanakan transaksi jual beli tanah tersebut. Pihak yang mengajukan pengaduan sengketa pertanahan harus membuktikan terlebih dahulu, sehingga tanggung jawab PPAT hanya sampai setelah hasil pengecekan sertipikat terbit dan dinyatakan “bersih” kemudian ditandatanganinya suatu akta; (2) Implikasi yuridis bagi PPAT yang telah melaksanakan pengecekan namun timbul sengketa setelah ditandatanganinya suatu akta adalah akta PPAT tetаp menjаdi аktа otentik yаng berlаku dаn tidаk menjаdi bаtаl demi hukum kаrenа mаsih memenuhi unsur аktа otentik dаn jugа tidаk berlаku sebаgаi аktа di bаwаh tаngаn. Hilаngnyа keotentikаn аktа PPAT tersebut jika terdаpаt putusаn hаkim di Pengаdilаn yаng mаnа penggugаt dаpаt membuktikаn bаhwа аktа PPAT yang bersаngkutаn itu tidаk benаr dаn membuktikаn bаhwа penilаiаn аtаu pernyаtааnnyа sesuаi аturаn hukum yаng berlаku di Pengаdilаn. Kesimpulan dari penelitian ini adalah bahwa adanya suatu sengketa setelah penandatanganan akta tidak menyebabkan PPAT bertanggung jawab dan akta PPAT tetаp menjаdi аktа otentik dаn tidаk menjаdi bаtаl demi hukum. Adapun saran dalam penelitian ini yaitu perlu adanya perpanjangan jangka waktu menjadi 30 hari kalender dalam menyampaikan akta dan dokumen dalam proses peralihan hak.

English Abstract

The Land Deed Official is an official whose job is to assist part of National Land Agency authority in land registration through making evidence in the form of deed transfer of rights and encumbrance of rights. Prior to carrying out the transfer, the Land Deed Official is required to ensure and be sure that the data listed in the land rights certificate is in accordance with the physical data and juridical data and is free from disputes, blocking, or collateral confiscation. However, when a certificate check has been carried out and declared "clean" and a signature has been carried out, a dispute arises, it will result in a loss, which of course risks the Land Deed Official performance. Based on the background mentioned above, this paper examines (1) What are the responsibilities of the Land Deed Official who has carried out checks but disputes arise after the signing of a deed? (2) What are the Juridical Implications for Land Deed Official who has checked but a dispute arises after the signing of a deed? To answer the above problems, this normative legal research uses a statutory approach, namely by examining statutory regulations. Legal materials obtained through library writing. Based on the discussion, it can be concluded (1) the Land Deed Official is not responsible for the emergence of disputes after the signing of a deed, because the Land Deed Official has carried out the mandate of Article I number 28 of Ministerial Regulation from Ministry of Agrarian Affairs and Spatial Planning or National Land Agency No.16 of 2021, namely through checking certificates before carrying out land sale and purchase the transactions. The side who submit a land dispute complaint must prove it first, so that the Land Deed Official responsibility is only until after the results of checking the certificate are issued and declared "clean" then a deed is signed; The juridical implication for a Land Deed Official who has carried out checks but a dispute arises after the signing of a deed is that the Land Deed Official's deed remains an authentic deed that is valid and does not become null and void because it still fulfills the elements of an authentic deed and also does not apply as a private deed. The authenticity of the Land Deed Official's deed is lost if there is a judge's decision in court in which the plaintiff can prove that the Land Deed Official's deed in question is incorrect and proves that the assessment or statement in accordance with the legal provisions in force in the Court. The conclusion of this study is that the existence of a dispute after signing the deed does not cause the Land Deed Official to be responsible and the Land deed Official deed remains an authentic deed and does not become null and void. The suggestions in this study are that it is necessary to extend the period to 30 calendar days in submitting deeds and documents in the process of transferring rights.
