Abstract
Undang-undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan pasal 106 ayat (6) ini hanya mengatur tentang kewajiban pengendara dalam menggunakan sabuk keselamatan yang jika melanggar akan dipidana kurungan paling lama 1 bulan atau denda paling banyak Rp 250.000,00. Dan ketentuan pasal ini belum berksplor karena dia hanya membahas mengenai pengemudi dan penumpang yang wajib memakai sabuk bukan fokus terhadap perlindungan anak. Berdasarkan hal tersebut diatas, penelitian ini mengangkat rumusan masalah (1) Bagaimanakah urgensi pengaturan car seat anak dalam Undang-undang lalu lintas dan angkutan jalan, (2) Bagaimanakah perbandingan pengaturan mengenai penggunaan sabuk pengaman pada pengendara kendaraan roda 4 di Indonesia dan di Singapura? Jenis penelitian ini merupakan metode normatif yang menggunakan metode pendekatan penelitian Pendekatan Perundang-undangan, dan Pendekatan Perbandingan, dengan menggunakan bahan hukum, serta teknik metode analisis deskriptif. Berdasarkan hasil penelitian ini, peraturan yang berlaku di Indonesia tidak adanya peraturan yang membahas mengenai baby car seat dalam Undang-Undang Lalu Lintas dan Angkutan Jalan. Hal ini dapat diketahui dari analisis yang dilakukan melalui pendekatan perbandingan oleh negara singapura, yaitu berdasarkan Singapore Road Traffic ACT Chapter 276 (Motor Vehicles, Wearing of Seat Belts). Dikarenakan belum adanya peraturan mengenai kewajiban penggunaan car seat untuk anak di bawah umur dan bayi demi melindungi keselamatan anak-anak dan bayi dalam kendaraan roda empat. Sehingga urgensi ketentuan penggunaan car seat sangat penting dan pihak pemerintah perlu melakukan pembaharuan serta evaluasi demi mengurangi angka kecelakaan dan kematian di jalan raya.
English Abstract
Law Number 22 of 2009 concerning Road Traffic and Transportation article 106 paragraph (6) only regulates the obligation of motorists in using seat belts which if violated will be sentenced to imprisonment for a maximum of 1 month or a maximum fine of Rp 250,000.00. And the provisions of this article have not been explored because it only discusses drivers and passengers who are required to wear belts instead of focusing on child protection. Based on the above, this study raises the formulation of the problem (1) What is the urgency of regulating child car seats in the traffic and road transport law, (2) How do regulations regarding the use of seat belts compare to 4-wheeled vehicle drivers in Indonesia and in Singapore? This type of research is a normative method that uses research approaches, statutory approaches, and comparative approaches, using legal materials, as well as descriptive analysis method techniques. Based on the results of this study, the applicable regulations in Indonesia do not have regulations that discuss baby car seats in the Road Traffic and Transport Law. This can be seen from the analysis conducted through a comparative approach by Singapore, which is based on Singapore Road Traffic ACT Chapter 276 (Motor Vehicles, Wearing of Seat Belts). Because there is no regulation regarding the mandatory use of car seats for minors and infants to protect the safety of children and infants in four- wheeled vehicles. So the urgency of the provisions for the use of car seats is very important and the government needs to update and evaluate in order to reduce the number of road accidents and deaths.
