Abstract
elama melaksanakan penelitian di PT Bumitama Gunajaya Agro, penulis menemui permasalahan dengan efektifitas hukum Pasal 7 Ayat (1) Permentan No. 38 Tahun 2020 tentang Kewajiban Sertifikasi ISPO Bagi Usaha Perkebunan Kelapa Sawit. Hal ini muncul dan ada kerana penerapan sertifikasi ISPO di kalangan para pengusaha perkebunan kelapa sawit belum mencapai keseluruhan tahap pelaksanaan yang diharapkan. Maka dari itu, penulis melakukan mengajukan rumusan permasalahan yakni: (1) Bagaimana hambatan dalam menerapkan Pasal 7 Ayat (1) Peraturan Menteri Pertanian Nomor 38 Tahun 2020 tentang Kewajiban sertifikasi ISPO di PT Bumitama Gunajaya Agro? (2) Bagaimana efektivitas Pasal 7 Ayat (1) Peraturan Menteri Pertanian Nomor 38 Tahun 2020 tentang kewajiban sertifikasi ISPO di PT Bumitama Gunajaya Agro? (3) Bagaimana upaya yang dapat dilaksanakan untuk mengoptimalkan efektivitas Pasal 7 Ayat (1) Peraturan Menteri Pertanian Nomor 38 Tahun 2020 tentang kewajiban sertifikasi ISPO di PT Bumitama Gunajaya Agro? Penelitian hukum empiris dengan memakai pendekatan yuridis sosiologis yang meliputi prosedur penelusuran data melalui wawancara dan observasi kemudian dipakai untuk menulis penelitian ini. Informasi yang dikumpulkan oleh penulis akan dilakukan analisis dengan memakai teknik analisis deskriptif kualitatif. Dari hasil penelitian yang telah dilakukan, penulis memperoleh jawaban dari permasalahan yang ada bahwa ISPO di PT Bumitama Gunajaya Agro masih belum terlaksana secara efektif. Kemudian penulis telah mendapatkan jawaban terkait hambatan-hambatan yang mengakibatkan ketidak-efektifan implementasi ISPO tersebut serta upaya yang telah dilaksanakan perusahaan untuk menerapkan kewajiban sertifikasi ISPO sejalan terhadap kebijakan sudah ditetapkan pada Peraturan UU terkait.
English Abstract
In this thesis, the author encountered issues related to the effectiveness of Article 7 Paragraph (1) of the Agricultural Minister Regulation No. 38 of 2020 on the Mandatory ISPO Certification for Palm Oil Plantation Businesses. This was due to the incomplete implementation of the ISPO certification by palm oil plantation industry players, which served as a driving factor in the author's selection of the research topic. Therefore, the author formulated the research problem as follows: (1) What are the obstacles in implementing Article 7 Paragraph (1) of the Agricultural Minister Regulation No. 38 of 2020 on the Mandatory ISPO Certification in PT Bumitama Gunajaya Agro? (2) What is the effectiveness of Article 7 Paragraph (1) of the Agricultural Minister Regulation No. 38 of 2020 on the Mandatory ISPO Certification in PT Bumitama Gunajaya Agro? (3) What efforts can be made to optimize the effectiveness of Article 7 Paragraph (1) of the Agricultural Minister Regulation No. 38 of 2020 on the Mandatory ISPO Certification in PT Bumitama Gunajaya Agro? This empirical legal research employed a socio-legal approach that included data collection procedures through interviews and observations, which were then used to write this study. The data collected by the author were analyzed using descriptive qualitative analysis techniques. From the results of the research that has been done, writer found that the implementation of ISPO at PT Bumitama Gunajaya Agro has not been fully effective. Additionally, the author identified the obstacles that have contributed to the lack of effectiveness of ISPO implementation and the efforts made by the company to comply with the mandatory ISPO certification requirement, in accordance with the relevant laws and regulations.
