Abstract
Skripsi ini, penulis mengangkat permasalahan tentang Tugas Pelaksana Operasional BUM Desa yang dilatarbelakangi oleh Pasal 27 Ayat (2) Peraturan Pemerintah Nomor 11 Tahun 2021 Tentang Badan Usaha Milik Desa Terkait Tugas Pelaksana Operasional Badan Usaha Milik Desa yang memaparkan terkait tugas Pelaksana Operasional BUM Desa. Namun, dalam praktiknya Pelaksana Operasional mengabaikan tanggung jawab dalam mengelola BUM Desa. Berdasarkan latar belakang di atas, skripsi ini mengangkat tiga rumusan masalah: (1) Bagaimana efektivitas Pasal 27 ayat (2) Peraturan Pemerintah Republik Indonesia Nomor 11 Tahun 2021 Tentang Badan Usaha Milik Desa terhadap tugas Pelaksana Operasional Badan Usaha Milik Desa di BUM Desa KM Desa S? (2) Apa kendala - kendala terhadap tugas Pelaksana Operasional di BUM Desa KM Desa S berdasarkan Pasal 27 ayat (2) Peraturan Pemerintah Republik Indonesia Nomor 11 Tahun 2021 Tentang Badan Usaha Milik Desa? (3) Bagaimana upaya BUM Desa KM dalam mengatasi kendala-kendala terhadap tugas Pelaksana Operasional Badan Usaha Milik Desa di BUM Desa KM Desa S dalam penerapan Pasal 27 ayat (2) Peraturan Pemerintah Republik Indonesia Nomor 11 Tahun 2021 Tentang Badan Usaha Milik Desa? Skripsi ini ditulis oleh penulis menggunakan metode yuridis empiris. Penulis akan menganalisis data primer dan data sekunder dengan menggunakan teknik analisa deskriptif kualitatis, karena di sini penulis mengumpulkan data, mereduksi data, menganalisis data, serta memverifikasi untuk menarik kesimpulan dari penelitian yang telah dilakukan. Dari hasil penelitian menggunakan metode di atas, maka penulis memperoleh jawaban atas permasalahan tersebut bahwa Efektivitas Pasal 27 Ayat (2) PP 11 Tahun 2022 Tentang BUM Desa Terkait Tugas Pelaksana Operasional Badan Usaha Milik Desa Di BUM Desa KM Desa S Kecamatan M Kabupaten Gresik belum berjalan secara efektiv karena unsur substansi hukum, struktur hukum, dan budaya masyarakat tidak terpenuhi. Terdapat kendala terhadap tugas Pelaksana Operasional di BUM Desa KM antara lain dari substansi hukum yaitu Peraturan Desa yang membatasi tugas Pelaksana Operasional dalam mengembangkan BUM Desa KM dan tidak adanya perjanjian kerja bagi pegawai BUM Desa KM. Kendala dari struktur hukum yaitu rendahnya kualitas SDM (pengurus BUM Desa) menjalankan BUM Desa secara professional, dan kurangnya pembinaan dan pengembangan oleh Pemerintah Kabupaten Gresik. Adanya kendala dari budaya masyarakat yaitu kecilnya kepercayaan masyarakat dan pemerintah desa menyebabkan rendahnya penyertaan modal Kepada BUM Desa KM. Upaya yang dapat dilakukan dalam mengatasi kendala tersebut yaitu kendala substansi hukum dengan merubah peraturan desa agar tidak membatasi tugas Pelaksana Operasional dalam mengembangkan BUM Desa KM dan membuat perjanjian kerja kepada pegawai BUM Desa KM. Upaya mengatasi kendala struktur hukum yaitu memberikan pembinaan kepada pengurus BUM Desa terkait profesionalisme, integritas serta keseriusan dalam mengurus BUM Desa dengan diadakan pendidikan dan pelatihan terhadap para pengurus BUM Desa oleh Pemerintah Kabupaten Gresik. Upaya mengatasi kendala budaya masyarakat sejalan dengan perbaikan substansi hukum dan struktur hukum agar kontribusi masyarakat dalam perkembangan BUM Desa KM meningkat.
English Abstract
In this essay, the author raises the issue of the Operational Implementation Task of the BUM Village which is promulgated by Article 27 Paragraph (2) of Government Regulation No. 11 of 2021 concerning the village-owned enterprise agency relating to the operational implementation tasks of the village -owned business agency which displays the related operational implementing tasks. However, in practice, the Operational Executives ignore responsibilities in managing the village BUM. Based on the above background, this script raises three formulas of problems: (1) How is the effectiveness of Article 27 paragraph (2) of Government Regulations No. 11 of 2021 on the Rural Property Authority to the task of Operational Implementation of the Rural Enterprise Authority at BUM Desa KM Desa S? (2) What are the obstacles to the tasks of the Operational Execution in the Rural Development Authority on the basis of article 27 of the (2) of the Government Regulation No. (3) How are the efforts of BUM Desa KM in overcoming the obstacles to the task of the Operational Executive of the Village Owned Enterprise Agency in BUM desa KM Desa S in the implementation of Article 27 paragraph (2) of the Regulations of the Government of the Republic of Indonesia No. 11 Year 2021 concerning the village owned enterprise agency?The author will analyze primary and secondary data using qualitative descriptive analysis techniques, because here the author collects data, reduces data, analyzes data, and verifies to draw conclusions from the research that has been done. From the results of research using the above methods, the author obtained an answer to the problem that the Effectiveness of Article 27 Paragraph (2) PP 11 Year 2022 About BUM Village Related to the Operational Implementation Duties of the Village Owned Enterprise Agency at BUM village KM village S district of Gresik has not been performed effectively because the elements of legal substance, legal structure, and culture of the community are not met. There are obstacles to the duties of the Operational Executives in BUM Village KM, among other things, from the legal substance of the Village Regulations which restricts the tasks of the operational executive in developing the BUM village KM and the absence of an employment agreement for the staff of BUM District KM. The obstacles of the legal structure are the low quality of the SDM (the manager of the village BUM) conducting the Village BUM professionally, and the lack of construction and development by the Government of the district of Gresik. There are barriers from the culture of the community, that is, the small confidence of the people and the government of the village caused the low participation of capital to BUM Village KM. The effort that can be done in overcoming such barriers is the barriers of the substance of the law by changing the village regulations so as not to restrict the duties of the Operational Executives in developing BUM village KM and making employment agreements to the staff of BUM District KM. In order to overcome the obstacles of the legal structure is to provide training to the manager of the BUM Municipality related to professionalism, integrity and seriousness in managing the village BUM by conducting education and training of the managers of the Municipality by the Gresik District Government. Efforts to overcome cultural barriers of the community in line with the improvement of legal substance and legal structure so that the contribution of the society in the development of BUM Village KM increases
