Abstract
Penelitian ini membahas terkait penegakan sanksi administrasi Pasal 7 ayat (2) Peraturan Bupati Kediri Nomor 15 Tahun 2014 yang mengatur batas jam operasional usaha karaoke atau kafe di Kabupaten Kediri, yaitu pukul 10.00 hingga 24.00 WIB. Penegakan sanksi administrasi terhadap pelanggaran Pasal 7 ayat (2) tersebut dilakukan oleh Satpol PP Kabupaten Kediri. Namun, berdasarkan pra-survei, terdapat sejumlah usaha karaoke atau kafe yang beroperasi melebihi jam operasional. Sehingga, terdapat kesenjangan antara das sein dan das sollen. Berdasarkan latar belakang tersebut, skripsi ini mengangkat dua rumusan masalah, yaitu (1) Bagaimana penegakan sanksi administrasi mengenai jam operasional Pasal 7 ayat (2) Peraturan Bupati Kediri Nomor 15 Tahun 2014 dan (2) Apa faktor penghambat dan solusi penegakan sanksi administrasi mengenai jam operasional Pasal 7 ayat (2) Peraturan Bupati Kediri Nomor 15 Tahun 2014? Skripsi ini merupakan penelitian hukum sosiolegal yang menggunakan metode pendekatan sosiologi hukum. Berdasarkan hasil penelitian, maka dapat diperoleh jawaban atas rumusan masalah pertama bahwa penegakan sanksi administrasi mengenai jam operasional Pasal 7 ayat (2) Peraturan Bupati Kediri Nomor 15 Tahun 2014 belum dilakukan secara efektif. Sedangkan, jawaban atas rumusan masalah kedua terbagi menjadi dua faktor penghambat, yaitu internal dan eksternal. Faktor internalnya adalah Satpol PP kurang personil, ketidakseriusan Pemerintah Daerah Kabupaten Kediri, dan ketidakjelasan prosedur bagi pelanggar aturan. Sedangkan, faktor eksternalnya adalah terdapat beberapa pihak yang tidak kooperatif sehingga menghambat penegakan sanksi administrasi.
English Abstract
This study discusses the enforcement of administrative sanctions Article 7 paragraph (2) of the Kediri Regent Regulation Number 15 of 2014 which regulates the operatinghours for karaoke or cafe businesses in Kediri Regency, namely 10.00 to 24.00 WIB. The enforcement of administrative sanctions for violations of Article 7 paragraph (2) is carried out by the Satpol PP of Kediri Regency. However, based on the pre-survey, some karaoke or cafe businesses operate beyond operating hours. Thus, there isagapbetween das sein and das sollen. Based on this background, this thesis raises twoproblem formulations, namely (1) How to enforce administrative sanctions regarding operational hours of Article 7 paragraph (2) Kediri Regent Regulation Number 15 of 2014 and (2) What are the inhibiting factors and solutions for enforcement of administrative sanctions regarding hours operational Article7paragraph (2) Kediri Regent Regulation Number 15 of 2014? This thesis isasocio- legal research that usesthe legal sociology approach. Based on the research results, the answer to the first problem formulation can be obtained that the enforcement of administrative sanctions regarding operational hours of Article7paragraph (2) of the Kediri Regent Regulation Number 15 of 2014 has not been carried out effectively. Meanwhile, the answer to the second problem formulation is divided into two inhibiting factors, namely internaland external. The internal factors are the lack of personnel for the Satpol PP, the lackof seriousness by the Regional Government of Kediri Regency, and unclear proceduresfor violating the rules. Meanwhile, the external factor is that there are several uncooperative parties that hinder the enforcement of administrative sanctions.
