Abstract
A language difference between two countries involved in a bilateral agreement can be a barrier in comprehending the content thoroughly, therefore legal translation is needed to efface the language barrier. A translation of a legal document needs to transfer the message from source language to target language properly in order to avoid unwanted legal consequences. To dig further into legal translation, this research aimed to discover the legal term categories and the translation procedures of legal terms in the US-Indonesia Peace Corps MoU document. The data used were legal terms that exist in the bilingual document of MoU (Memorandum of Understanding) on Peace Corps program that involves the United States and Indonesia. Two theories are used to analyze the data, namely a theory of legal term categories by Dewi et al. (2020) and a theory of translation procedure by Newmark (1988). A qualitative approach was employed in this research where the author focused on the textual aspect instead of the numerical one in the explanation. The finding is presented in two parts. First, for the legal term categories, there are 6 categories found in the document which consists of 23 legal terms in total, the categories are archaisms (3), formal vocabulary (5), technical terms (10), foreign words (2), modal auxiliaries (2), and fixed expressions (1). Second, for the translation procedure, there are 8 procedures applied in the translation, namely naturalization (1), functional equivalent (1), synonymy (4), transposition (3), modulation (1), recognized translation (7), expansion (2), and couplets (2). In conclusion, the existence of legal term categories in the document becomes a characteristic of a legal text that makes it different from other types of text, and the translation procedures are well-applied since the message from source language to target language is conveyed properly.
