Abstract

Keberadaan pengemis dan pengamen sangat berkaitan erat dengan kesejahteraan dan ketertiban serta sangat sulit untuk dihilangkan. Keberadaannya dapat dilakukan penanggulangan dengan cara usaha preventif, usaha represif, dan usaha rehabilitatif. Termasuk juga Kabupaten Pamekasan mengatasi hal tersebut dengan mengesahkan Peraturan Daerah Kabupaten Pamekasan Nomor 1 Tahun 2017 Tentang Penyelenggaraan Ketertiban Sosial untuk mengatasi maraknya pengemis dan pengamen masih banyak serta berkeliaran di sekitar masyarakat. Berdasarkan permasalahan tersebut, rumusan masalah dalam penelitian ini: (1) Bagaimana Pelaksanaan Usaha Preventif, Represif, dan Rehabilitatif Berdasarkan Pasal 14 ayat (1) Peraturan Daerah Kabupaten Pamekasan Nomor 1 Tahun 2017 tentang Penyelenggaraan Ketertiban Sosial? (2) Apa Hambatan dan Solusi dalam Pelaksanaan Usaha Preventif, Represif, dan Rehabilitatif Berdasarkan Pasal 14 ayat (1) Peraturan Daerah Kabupaten Pamekasan Nomor 1 Tahun 2017 tentang Penyelenggaraan Ketertiban Sosial? Penelitian ini menggunakan jenis penelitian sosio legal dengan metode pendekatan yuridis sosiologis. Lokasi penelitian dilaksanakan di Dinas Sosial Kabupaten Pamekasan, Satuan Polisi Pamong Praja dan Pemadam Kebakaran Kabupaten Pamekasan, dan Lampu Lalu Lintas di Kabupaten Pamekasan. Jenis data yang digunakan adalah data primer yang bersumber dari hasil wawancara dan kuesioner langsung dari lokasi penelitian, serta data sekunder yang bersumber dari arsip data dari lokasi penelitian, studi kepustakaan, peraturan perundang-undangan terkait. Teknik analisis data dengan menggunakan metode deskriptif kualitatif. Hasil penelitian ini dapat diketahui bahwa Pelaksanaan Usaha Preventif, Represif, dan Rehabilitatif Berdasarkan Pasal 14 ayat (1) Peraturan Daerah Kabupaten Pamekasan Nomor 1 Tahun 2017 tentang Penyelenggaraan Ketertiban Sosial belum dilaksanakan sepenuhnya, seperti pemukiman lokal dan pemerluasan lapangan pekerjaan pada usaha preventif, penyerahan ke pengadilan pada usaha represif, dan usaha rehabilitatif yang tidak dapat dijalankan. Adapun faktor yang mempengaruhi, yaitu faktor peraturan, faktor sarana dan prasarana, faktor masyarakat, dan faktor kebudayaan. solusi yang dilakukan adalah mengajukan anggaran, memberdayakan pengamen, dan melakukan edukasi melalui media massa dan pengeras suara di lampu lalu lintas.

English Abstract

The existence of beggars and buskers is closely related to welfare and order and is very difficult to eliminate. Their existence can be overcome by means of preventive efforts, repressive efforts, and rehabilitative efforts. Including Pamekasan Regency overcoming this by passing Pamekasan Regency Regional Regulation Number 1 of 2017 concerning the Implementation of Social Order to overcome the rampant beggars and buskers are still many and roaming around the community. Based on these problems, the formulation of the problems in this study: (1) How is the Implementation of Preventive, Repressive, and Rehabilitative Efforts Based on Article 14 paragraph (1) of Pamekasan Regency Regional Regulation Number 1 of 2017 concerning the Implementation of Social Order? (2) What are the Obstacles and Solutions in the Implementation of Preventive, Repressive, and Rehabilitative Efforts Based on Article 14 paragraph (1) of Pamekasan Regency Regional Regulation Number 1 of 2017 concerning the Implementation of Social Order? This research uses a socio-legal research type with a sociological juridical approach method. The research location was carried out at the Pamekasan Regency Social Service, Pamekasan Pamong Praja Police and Fire Unit, and Traffic Lights in Pamekasan Regency. The types of data used are primary data sourced from the results of interviews and questionnaires directly from the research location, as well as secondary data sourced from data archives from the research location, literature studies, related laws and regulations. Data analysis techniques using qualitative descriptive methods. The results of this study indicate that the Implementation of Preventive, Repressive, and Rehabilitative Efforts Based on Article 14 paragraph (1) of Pamekasan Regency Regional Regulation Number 1 of 2017 concerning the Implementation of Social Order not yet fully implemented, such as local settlement and expansion of employment opportunities in preventive efforts, submission to the court in repressive efforts, and rehabilitative efforts that cannot be carried out. The influencing factors are regulatory factors, facilities and infrastructure factors, community factors, and cultural factors. The solutions are proposing a budget, empowering buskers, and educating through mass media and loudspeakers at traffic lights.
