Abstract
Online Single Submission Risk Based Approach merupakan program dari Peraturan Pemerintah Nomor 5 Tahun 2021 Tentang Penyelenggaraan Perizinan Berusaha Berbasis Resiko. Sistem perizinan ini berguna untuk memudahkan para pelaku usaha dalam menerbitkan izin usaha. Secara empiris, pelaksanaan pelayanan perizinan berusaha belum terimplementasi dengan efektif dilihat dari prosedur dalam pelaksanaanya walaupun tujuan memberi kemudahan kepada para pelaku usaha sudah tepat sasaran namun masih ada beberapa faktor penghambat yang memengaruhi implementasi kebijakan Online Single Submission Risk Based Approach berjalan belum efektif. Adapun tujuan dari penelitian ini untuk mengetahui bagaimana implementasi kebijakan Peraturan Pemerintah Nomor 5 Tahun 2021 di Dinas Penanaman Modal Provinsi Sulawesi Selatan dan pencapaian tahapan serta faktor penghambat pada implementasi kebijakan Peraturan pemerintah Nomor 5 Tahun 2021 di Dinas Penanaman Modal. Penelitian ini menggunakan model implementasi kebijakan Edward III. Harapan penelitian, tulisan ini dapat dimanfaatkan untuk memperbaiki implementasi Sistem Online Single Submission Risk Bassed Approach di Indonesia khususnya di Provinsi Sulawesi Selatan. Penelitian ini menggunakan pendekatan kualitatif deskriptif Hasil penelitian menyimpulkan bahwa: Pertama, implementasi kebijakan Peraturan Pemerintah Nomor 5 Tahun 2021 belum efektif. Implementasi kebijakan ini di pengaruhi melalui faktor komunikasi, sumberdaya, disposisi dan struktur birokrasi, yaitu: (1) pelaksana kebijakan telah melakukan komunikasi secara transmisi melalui sosialisasi secara langsung dan secara online melalui media sosial, dan juga melakukan komunikasi secara internal antara bagian dan staf pelaksana dalam rangka menyamakan presepsi demi kejelasan kebijakan, informasi terkait sistem Online Single Submission Risk Bassed Approch masih dapat di akses melalui web resmi dan sosial media Dinas Penanaman Modal Provinsi Sulawesi Selatan; (2) Sumberdaya meliputi (a) Sumber daya manusia pada Dinas Penanaman Modal provinsi Sulawesi Selatan secara kualitas memiliki keterampilan yang memadai berdasarkan pendidikan IT dan secara kuantitas juga telah memadai dengan memiliki 110 staf dan 19 staf khusus pelayanan perizinan; (b) anggaran pada penyelenggaraan Perizinan Berusaha di Daerah melalui sistem OSS ini berasal dari APBN sesuai dengan ketentuan PP No. 6 tahun 2021 tentang Penyelenggaraan Perizinan Berusaha di Daerah; (c) sarana dan prasarana pendukung sistem OSS-RBA secara fisik telah memadai namun secara perangkat lunak belum memadai secara menyeluruh; (d) Kewenangan yang dimiliki DPMPTSP Sulawesi Selatan menurut Peraturan Pemerintah Nomor 5 Tahun 2021 adalah memberikan izin usaha untuk tingkat xiii risiko rendah sedangkan untuk tingkat risiko menengah rendah, risiko menengah tinggi dan risiko tinggi masih di tangani oleh pusat untuk penerbitan izin usahanya; (3) Disposisi terkait komitmen dan sikap perilaku para pelaksana sistem OSS-RBA terutama para staf pelaksana dan pelayanan perizinan sudah baik dan interaktif dengan masyarakat; dan (4) Struktur birokrasi pelaksanaan sistem OSS-RBA di Dinas Penanaman Modal Provinsi Sulawesi Selatan telah ditetapkan dengan jelas dan melaksanakan tugas dan tanggung jawabnya sesuai dengan SOP yang berlaku pada lingkup Dinas Penanaman Modal Provinsi Sulawesi Selatan. Kedua, Pelaksanaan Sistem Online Single Submission Risk Bassed Approch telah mencapai sebagian tujuan kebijakan ini yaitu untuk memberi kemudahan bagi para pelaku usaha dalam mendapatkan izin di banding dengan perizinan berusaha sebelumnya secara manual yang harus melalui banyak pintu yang dapat memicu adanya pungutan liar dan jangka waktu yang lama dalam masa proses penerbitan izin. Adanya peningkatan pada pertumbuhan UMKM di Sulawesi Selatan sejak Tahun 2019 hingga Tahun 2021. Ketiga, belum efektifnya implementasi kebijakan sistem OSS-RBA sebabkan beberapa faktor yang mengambat yaitu : (1) kewenangan yang diberikan oleh pemerintah pusat kepada pemerintah Provinsi atau Dinas Penanaman Modal Provinsi Sulawesi Selatan belum sepenuhnya dalam hal memberi dan mengcover perizinan pada tingkat resiko menengah rendah, menengah tinggi dan tinggi; (2) fasilitas pada perangkat lunak atau software yang menjadi penunjang berjalannya prosedur perizinan melalui sistem OSS-RBA masih lemah dari segi jaringan pendukung dan model laman aplikasi yang sering kali eror.
English Abstract
Online Single Submission Risk Based Approach is a program of Government Regulation Number 5 of 2021 concerning the Implementation of Risk-Based Business Licensing. This licensing system is useful to make it easier for business actors to issue business licenses. Empirically, the implementation of business licensing services has not been implemented effectively judging from the procedures in its implementation even though the purpose of providing convenience to business actors is right on target, but there are still several inhibiting factors that affect the implementation of the Online Single Submission Risk Based Approach policy that has not been effective. The purpose of this study is to find out how the implementation of Government Regulation Number 5 of 2021 policy in the South Sulawesi Provincial Investment Office and the achievement of stages and inhibiting factors in the implementation of government regulation policy Number 5 of 2021 at the Investment Office. This research uses the Edward III policy implementation model. The hope of this research is that this paper can be used to improve the implementation of the Online Single Submission Risk Bassed Approach System in Indonesia, especially in South Sulawesi Province. This study uses a descriptive qualitative approach The results of the study concluded that: First, the implementation of Government Regulation Number 5 of 2021 has not been effective. The implementation of this policy is influenced through communication factors, resources, dispositions and bureaucratic structures, namely: (1) policy implementers have communicated in transmission through direct and online socialization through social media, and also communicate internally between the implementing part and staff in order to equalize perceptions for policy clarity, information related to the Online Single Submission Risk Bassed Approch system can still be accessed through official website and social media of the South Sulawesi Provincial Investment Office; (2) Resources include (a) Human resources at the Investment Office of South Sulawesi province in quality have adequate skills based on IT education and in quantity are also adequate by having 110 staff and 19 special staff for licensing services; (b) the budget for the implementation of Business Licensing in the Regions through the OSS system comes from the State Budget in accordance with the provisions of PP No. 6 of 2021 concerning the Implementation of Business Licensing in the Regions; (c) the facilities and infrastructure supporting the OSS-RBA system are physically adequate but the software is not comprehensive adequate; (d) The authority owned by DPMPTSP South Sulawesi according to Government Regulation Number 5 of 2021 is to provide business xv licenses for low risk levels while for medium low-risk, medium-high-risk and high-risk levels it is still handled by the center for the issuance of its business licenses; (3) Dispositions related to the commitment and attitude of behavior of the implementers of the OSS-RBA system, especially the implementing staff and licensing services, have been good and interactive with the community; and (4) The bureaucratic structure of the implementation of the OSS-RBA system in the South Sulawesi Provincial Investment Office has been clearly established and carries out its duties and responsibilities in accordance with the SOPs applicable to the scope of the South Sulawesi Provincial Investment Office. Second, the implementation of the Online Single Submission Risk Bassed Approch System has achieved part of the objectives of this policy, namely to make it easier for business actors to obtain permits compared to previous business permits manually which have to go through many doors that can trigger illegal levies and long periods of time in the process of issuing permits. There has been an increase in the growth of MSMEs in South Sulawesi from 2019 to 2021. Third, the ineffectiveness of the implementation of the OSS-RBA system policy causes several factors to increase, namely: (1) the authority given by the central government to the Provincial government or the South Sulawesi Provincial Investment Office has not been fully in terms of granting and covering permits at medium low, medium high and high risk levels; (2) the facilities in the software or that support the running of licensing procedures through the OSS-RBA system are still weak in terms of supporting networks and application page models that are often errors.
