Abstract

Penerapan implementasi pasal 81 ayat 2 Undang-Undang Nomor 23 Tahun 2002 dalam proses penyidikan di Unit Pelayanan Perempuan dan Anak (UPPA) Polres Ponorogo sudah berjalan sesuai aturan hukum yang berlaku. Perkara tindak pidana persetubuhan yang ditangani Unit Pelayanan Perempuan dan Anak (UPPA) Polres Ponorogo semuanya menggunakan modus operandi tipu muslihat dan serangkaian kebohongan. Maka dari itu Unit Pelayanan Perempuan dan Anak (UPPA) Polres Ponorogo menggunakan pasal 81 Ayat 2 Undang-Undang Nomor 23 Tahun 2002 pada perkara tindak pidana persetubuhan yang ditanganinya. Penelitian ini dilakukan di Kepolisian Resor Ponorogo dalam rentang waktu bulan Agustus 2022 hingga Januari 2023. Dalam penelitian Tugas Akhir ini dirumuskan dua pertanyan, yakni: (1) Bagaimana implementasi penerapan Pasal 81 Ayat 2 Undang-Undang Nomor 23 Tahun 2002 terkait Persetubuhan Dengan Tipu Muslihat didalam proses penyidikan di Unit Pelayanan Perempuan dan Anak (UPPA) Polres Ponorogo?; dan (2) Hambatan apa yang terjadi dalam implementasi penerapan Pasal 81 Ayat 2 Undang-Undang Nomor 23 Tahun 2002 terkait Persetubuhan Dengan Tipu Muslihat didalam proses penyidikan di Unit Pelayanan Perempuan dan Anak (UPPA) Polres Ponorogo? Untuk menjawab dua rumusan masalah tersebut, penelitian ini menggunakan metode penelitian yuridis empiris dengan pendekatan studi kasus (case study). Hasil penelitian yang menjadi kesimpulan penelitian ini antara lain: 1. Unit Pelayanan Perempuan dan Anak (UPPA) Polres Ponorogo sudah menerapkan pengimplementasian pasal 81 Ayat 2 Undang-Undang Nomor 23 Tahun 2002 dalam proses penyidikan sesuai dengan Pasal 81 Ayat 2 Undang-Undang Nomor 23 Tahun 2002. Hal tersebut berdasarkan atas keterangan saksi dari anak korban yang dimana dalam tindak pidana persetubuhan tersebut terdapat unsur tipu muslihat dan serangkaian kebohongan. 2. Dalam melakukan mekanisme penanganan kasus persetubuhan di Unit Pelayanan Perempuan dan Anak (UPPA) Polres Ponorogo, terdapat hambatan yang menimbulkan Unit Pelayanan Perempuan dan Anak (UPPA) Polres Ponorogo terhambat saat melakukan proses penyidikan yang dimana anak korban tidak bisa menjelaskan kronologi kejadian dikarenakan anak korban sedang mengalami ketakutan, trauma, dan gangguan mental, pelaku tindak pidana persetubuhan sering kali melarikan diri dan tidak ingin bertanggung jawab atas kejadian yang telah dilakukan sehingga membuat proses penyidikan menjadi lama, dan anak korban terlambat melakukan visum dikarenakan hasil pemeriksaan tidak menunjukkan keadaan yang sebenarnya. Dari adanya hal tersebut menjadi penghambat anggota penyidik Unit Pelayanan Perempuan dan Anak (UPPA) Polres Ponorogo pada melakukan proses penyidikan.

English Abstract

The application of the implementation of Article 81 paragraph 2 of Law Number 23 of 2002 in the investigation process at the Women and Children Service Unit (UPPA) of the Ponorogo Police has been running according to the applicable legal regulations. The cases of sexual intercourse handled by the Women and Children Service Unit (UPPA) of the Ponorogo Police all use the modus operandi of deception and a series of lies. Therefore, the Women and Children Service Unit (UPPA) of the Ponorogo Police uses Article 81 Paragraph 2 of Law Number 23 of 2002 in the cases of criminal intercourse that it handles. This research was conducted at the Ponorogo Resort Police in the period from August 2022 to January 2023. In this research, two questions were formulated, namely: (1) How is the implementation of Article 81 Paragraph 2 of Law Number 23 of 2002 related to Counseling by Deception in the investigation process at the Women and Children Service Unit (UPPA) Polres Ponorogo?; and (2) What obstacles occurred in the implementation of the implementation of Article 81 Paragraph 2 of Law Number 23 of 2002 regarding Counseling with Deception during the investigation process at the Women and Children Services Unit (UPPA) of the Ponorogo Police? To answer the two formulations of the problem, this study uses an empirical juridical research method with a case study approach. The research results that become the conclusions of this study include: 1. The Women and Children Service Unit (UPPA) of the Polres Ponorogo has implemented Article 81 Paragraph 2 of Law Number 23 of 2002 in the investigation process in accordance with Article 81 Paragraph 2 of Law Number 23 of 2002. This is based on witness testimony from the child of the victim where in the crime of intercourse there is an element of deception and a series of lies. 2. In carrying out the mechanism for handling cases of intercourse at the Women and Children Service Unit (UPPA) of the Ponorogo Police, there were obstacles that caused the Women and Children Service Unit (UPPA) of the Ponorogo Police to be hampered when carrying out the investigation process where the child victim could not explain the chronology of events because the child the victim is experiencing fear, trauma, and mental disorders, the perpetrators of the crime of sexual intercourse often run away and do not want to be responsible for the events that have been carried out, which makes the investigation process lengthy, and the victim's child is late for a post-mortem examination because the results of the examination do not show the actual situation. From this, it became an obstacle for investigators from the Women and Children Service Unit (UPPA) of the Ponorogo Police in carrying out the investigation process.
