Abstract

Angka kecelakaan kerja di Indonesia setiap tahunnya mengalami peningkatan, termasuk dengan profesi atlet. Profesi atlet yang selalu berkaitan dengan turnamen olahraga menjadi krusial jika dikaitkan dengan keselamatan. Berdasarkan UU No. 13 tahun 2003 tentang Ketenagakerjaan Pasal 1 angka 2 disebutkan bahwa tenaga kerja adalah setiap orang yang mampu melakukan pekerjaan guna menghasilkan barang dan/atau jasa baik untuk memenuhi kebutuhan sendiri maupun untuk masyarakat, sehingga peserta dalam turnamen ini dapat dikatakan sebagai pekerja/tenaga kerja. EST Brawijaya merupakan salah satu sarana untuk menyalurkan minat dan bakat mahasiswa di bidang nonakademik, seperti olahraga basket dan futsal. Kehadiran BPJS Ketenagakerjaan Cabang Malang ini adalah sebagai bentuk asuransi yang dalam penerapannya adalah menanggulangi resiko yang akan dihadapi oleh pekerja, dalam penelitian ini pekerja yang dimaksud adalah atlet mahasiswa. Tujuan dari penelitian ini adalah untuk mengetahui bagaimana penerapan program JKK pada atlet mahasiswa Universitas Brawijaya dan apakah sudah sesuai dengan UU Ketenegakerjaan. Penelitian ini menggunakan metode kualitatif dengan penyajian data secara deskriptif serta melampirkan hasil wawancara dari narasumber. Hasil dari penelitian ini disimpulkan bahwa pelayanan BPJS Ketenagakerjaan terkait alur pendaftaran hingga pelayanan klaim JKK pada atlet cedera telah terlaksana secara optimal, meskipun beberapa pada mitra kerja mereka, khususnya Rumah Sakit, masih ada yang belum optimal. Selain itu atlet mahasiswa Universitas Brawijaya telah berpartisipasi secara aktif yang dilihat dari segi kedisiplinan dalam membayar iuran per bulannya. Meskipun demikian, pihak BPJS Ketenagakerjaan diharapkan dapat melakukan sosialisasi secara terkait program kerja mereka sehingga seluruh lapisan masyarakat memiliki wawasan dan memahami apa saja yang terjangkau oleh BPJS Ketenagakerjaan. Selain itu juga adalah agar BPJS Ketenagakerjaan melakukan evaluasi atas perkembangan kinerja yang sudah dilakukan.

English Abstract

The number of work accidents in Indonesia has increased every year, including the athlete profession. The athlete profession which is always related to sports tournaments is crucial when it comes to safety. Based on Law No. 13 of 2003 concerning Manpower Article 1 point 2, it is stated that labor is everyone who is able to do work in order to produce goods and / or services both to meet their own needs and for the community, so that participants in this tournament can be said to be workers / laborers. EST Brawijaya is one of the means to channel students' interests and talents in non-academic fields, such as basketball and futsal. The presence of BPJS Employment Malang Branch is a form of insurance which in its application is to overcome the risks that will be faced by workers, in this study the workers in question are student athletes. The purpose of this research is to find out how the application of the JKK program to Brawijaya University student athletes and whether it is in accordance with the Employment Law. This research uses a qualitative method with descriptive data presentation and attaches the results of interviews from sources. The results of this study concluded that BPJS Employment services related to the flow of registration to JKK claim services for injured athletes have been carried out optimally, although some of their partners, especially hospitals, are still not optimal. In addition, Brawijaya University student athletes have actively participated as seen in terms of discipline in paying monthly contributions. Nevertheless, BPJS Employment is expected to conduct socialization related to their work programs so that all levels of society have insight and understand what is covered by BPJS Employment. In addition, it is also for BPJS Employment to evaluate the development of performance that has been carried out.
