Abstract

Pada skripsi ini, penulis mengulas problematika perihal efektivitas hukum dalam Pasal 6 ayat (1) Peraturan Menteri Nomor 5 Tahun 2006 tentang Ambang Batas Emisi Gas Buang Kendaraan Bermotor Lama, yakni mengenai Walikota melaksanakan uji emisi kendaraan bermotor lama yang terdaftar di Kota Malang. Pilihan tema tersebut dilatarbelakangi oleh kepadatan penduduk di Kota Malang yang cukup besar yang berimplikasi kepada mobilitas dengan kendaraan bermotor tinggi sehingga menyebabkan kualitas udara kian memburuk. Dinas Lingkungan Hidup dapat menciptakan andil yang besar atas kepastian hukum. Pelaksanaan uji emisi penting mengingat Kota Malang adalah kota dengan jumlah kendaraan yang besar. Atas dasar inilah, uji emisi perlu dilaksanakan secara masif di Kota Malang bagi seluruh kendaraan bermotor terutama kendaraan lama yang terdaftar. Berdasarkan latar belakang diatas, skripsi ini memiliki rumusan masalah sebagai berikut: (1) Mengapa Pasal 6 ayat (1) Peraturan Menteri Negara Lingkungan Hidup Nomor 5 Tahun 2006 tentang uji emisi kendaraan bermotor lama yang terdaftar di daerah Kota Malang tidak efektif? (2) Bagaimana hambatan dan upaya yang dapat dilakukan untuk mengoptimalkan efektivitas Pasal 6 ayat (1) Peraturan Menteri Negara Lingkungan Hidup Nomor 5 Tahun 2006 tentang uji emisi kendaraan bermotor lama yang terdaftar di daerah Kota Malang? Kemudian penulisan karya tulis ini menggunakan metode yuridis empiris atau sociolegal dengan metode pendekatan yuridis sosiologis. Dalam penelitian ini akan digunakan teknik pengumpulan bahan hukum dilakukan melalui beberapa cara, yakni wawancara terhadap narasumber, studi dokumentasi, observasi, angket kuesioner kepada responden. Alasan pemilihan lokasi penelitian adalah dikarenakan Dinas Lingkungan Hidup merupakan Perangkat Daerah yang menjadi unsur pembantu Walikota dalam penyelenggaraan pelaksanaan uji emisi kendaraan bermotor lama yang terdaftar di daerahnya. Dari hasil penelitian, jawaban rumusan masalah pertama bahwa pelaksanaan uji emisi kendaraan bermotor lama yang terdaftar di Kota Malang belum efektif karena faktor hukum, penegak hukum, fasilitas, dan masyarakat. Sedangkan, jawaban atas rumusan masalah kedua terbagi menjadi dua faktor penghambat internal dan eksternal. dikelompokkan menjadi faktor internal dan eksternal. 1) faktor internal: a) persiapan kurang matang; b) belum ada perintah melaksanakan uji emisi bagi roda dua; c) sulit memberhentikan kedaraan; 2) faktor eksternal: a) faktor cuaca yaitu musim penghujan; b) alat uji emisi rusak. Upaya yang dapat dilakukan yaitu: a) persiapan yang lebih matang; b) pengusulan uji emisi kendaraan untuk roda dua; c) sosialisasi kepada seluruh masyarakat; d) persiapan cadangan alat uji emisi; e) dilakukan waktu musim kemarau.

English Abstract

In this thesis, the author reviews the problems regarding legal effectiveness in Article 6 paragraph (1) of Ministerial Regulation Number 5 of 2006 concerning Thresholds for Exhaust Emissions of Old Motorized Vehicles, namely regarding Mayors carrying out emission tests of old motorized vehicles registered in the City of Malang. The choice of this theme is motivated by the relatively large population density in Malang City which has implications for mobility with high motorized vehicles, causing air quality to worsen. The Environmental Service can make a big contribution to legal certainty. Implementation of emission tests is important considering that Malang City is a city with a large number of vehicles. On this basis, emission tests need to be carried out massively in Malang City for all motorized vehicles, especially registered old vehicles. Based on the background above, this thesis has the following problem formulation: (1) Why is Article 6 paragraph (1) of the Regulation of the Minister of State for the Environment Number 5 of 2006 concerning emission testing of old motorized vehicles registered in the Malang City area not effective? (2) What are the obstacles and efforts that can be made to optimize the effectiveness of Article 6 paragraph (1) Regulation of the State Minister for the Environment Number 5 of 2006 concerning emission testing of old motorized vehicles registered in the Malang City area? Then the writing of this paper uses the empirical or sociolegal juridical method with the sociological juridical approach. In this research, legal material collection techniques will be used in several ways, namely interviews with informants, documentation studies, observations, questionnaires to respondents. The reason for choosing the research location was because the Environmental Service is a Regional Apparatus that is an auxiliary element of the Mayor in organizing the implementation of emission tests for old motorized vehicles that are registered in their area. From the results of the research, the answer to the first problem formulation is that the implementation of emission tests for old motorized vehicles registered in Malang City has not been effective due to legal, law enforcement, facilities, and community factors. Meanwhile, the answer to the second problem formulation is divided into two internal and external inhibiting factors. grouped into internal and external factors. 1) internal factors: a) inadequate preparation; b) there has been no order to carry out emission tests for two wheels; c) difficult to stop the vehicle; 2) external factors: a) weather factors, namely the rainy season; b) the emission test equipment is damaged. Efforts that can be made are: a) more thorough preparation; b) proposal for emission test for two-wheeled vehicles; c) outreach to the whole community; d) preparation of emission test equipment reserves; e) carried out during the dry season
