Abstract

Otonomi Desa merupakan kebijakan otonomi daerah yang diberikan kepada pemerintah desa untuk lebih mengoptimalkan potensi yang dimiliki sehingga dapat memaksimalkan pendapatan desa untuk pembangunan dan kesejahteraan masyarakat. Undang-Undang Nomor 6 Tahun 2014 tentang Desa menjelaskan bahwa Pemerintahan Desa adalah penyelenggaraan urusan pemerintahan dan kepentingan masyarakat setempat dalam sistem pemerintahan Negara Kesatuan Republik Indonesia. Dalam meningkatkan perekonomian masyarakat desa, mendirikan BUMDes merupakan langkah yang tepat untuk terwujudnya kesejahteraan masyarakat desa. BUMDes merupakan lembaga ekonomi yang didirikan berdasarkan musyawarah antara Pemerintah Desa dan masyarakat Desa berdasarkan kebutuhan dan potensi Desa. Pengelolaan BUMDes dilakukan oleh masyarakat desa. Peran pemerintah desa yang baik dalam mengelola BUMDes akan menentukan keberhasilan BUMDes. Pada skripsi ini, peneliti mengangkat permasalahan pengelolaan BUMDes berdasarkan pasal 87 UU Nomor6tahun 2014, pemilihan tema tersebut karena dilatar belakangi kami sebagai masyarakat umum belum mengetahui bagimana pengelolaan BUMDes yang dipimpim oleh komesaris dan direktur BUMDes, serta kurang transparansi dalam pendirian serta pengelolaan yang terjadi di desa Bandarangin apakan sudah sesuai dengan undang-undang no6tahun 2014 tentang Desa. Apakah usaha terhadap pengelolaan oleh BUMDes tersebut berjalan semestinya dan Bagaimana hambatan dan upaya pemerintah desa terhadap pengoptimalan BUMDes sumber rejeki. Berdasarkan hal tersebut diatas, Skripsi ini mengangkat Rumusan Masalah:(1) Bagaimana pelaksanaan kewenangan pemerintah desa dalam pengelolaan BUMDes berdasarkan pasal 87 Undang-Undang Nomor 6 tahun 2014 tentang desa terhadap Bumdes Sumber Rejeki? (2) Apa hambatan dan upaya yang dilakukan oleh pemerintah desa untuk mengoptimalkan bumdes sumber rejeki ? Jenis penelitian ini adalah yuridis sosio-legal. Pendekatan yang digunakan adalah pendekatan hukum sosiologis. Metode pengambilan sampel yang digunakan oleh peneliti adalah sampling dalam non-probability sampling. Data yang digunakan adalah data primer berupa wawancara dan dokumentasi serta data sekunder berupa buku akademik, skripsi, laporan penelitian dan jurnal. Hasil penelitian menunjukan bahwa Pemerintah Desa dan kepala desa dalam pengelolaan BUMDes Sumber Rejeki cukup berperan dalam hal pendirian dan perencanaan unit usaha tetapi dari segi penasehat dan pengawasan kinerja BUMDes, Pemerintah Desa dan kepala desa bandarangin dirasa cukup dalam berperan terhadap pengelolaan BUMDes Sumber Rejeki. Peran BUMDes Sumber Rejeki dalam meningkatkan kesejahteraan masyarakat yaitu pemenuhan kebutuhan sehari-hari/jenis seperti usaha Isi ulang Air Minum.

English Abstract

Village Autonomy isaregional autonomy policy given to the village government to further optimize its potential so that it can maximize village income for development and the welfare of the community. Law Number 6 of 2014 concerning Villages explains that Village Administration is the administration of government affairs and the interests of local communities in the government sistem of the Unitary State of the Republic of Indonesia. In improving the economy of the village community, establishing BUMDes is the right step for the realization of the welfare of the village community. BUMDes is an economic institution established based on deliberation between the Village Government and the Village community based on the needs and potential of the Village. BUMDes management is carried out by the village community. The role ofagood village government in managing BUMDes will determine the success of BUMDes. In this thesis, the author raises the issue of BUMDes management based on Article 87 of Law no.6of 2014, the choice of the theme is because we as the general public do not know how the management of BUMDes is led by the commissioners and directors of BUMDes, as well as lack of transparency in the establishment and management of what happened in the village of Bandarangin whether it is in accordance with Law No.6of 2014 about the Village. Is the effort to manage BUMDes running properly and what is the role of the village head in managing BUMDes for the welfare of the people of the Bandarangin village. Based on the above, this paper raises the formulation of the problem: (1) How is the implementation of Article 87 of Law No.06/2014 on the village government of Bandarangin Sumberejo, Kec. kab. poor in the management of BUMDes?. (2) What is the role of the village head of Bandarangin Sumberejo sub-district. the district unfortunate for the management of BUMDes. This type of research is empirical-legal. The approach used isasociological approach. The sampling method used by the researcher is random sampling without probability sampling. The data used are primary data in the form of interviews and documentation and secondary data in the form of scientific papers, theses, research reports and journals. The results of this study. The results showed that the Village Government and village heads in managing the Sumber Rejeki BUMDes playedasignificant role in the establishment and planning of business units, but in terms of advisory and supervising the performance of BUMDes, the Village Government and the village head of Bandarangin were deemed sufficient in their role in the management of BUMDes Sumber Fortune. The role of the Sumber Rejeki BUMDes in improving the welfare of the community is the fulfillment of daily needs/types of drinking water refill business.
