Abstract

Permasalahan dalam penelitian ini terkait dengan Bagaimana Implementasi Perlindungan Konsumen Rokok Sehat Tentrem Dari Pelanggaran Standar Produksi Yang Dilakukan Oleh Pelaku Usaha Rokok Sehat Tentrem Ditinjau PP No. 109 Tahun 2012 dan Bagaimana Upaya Yang Dilakukan Untuk Mengatasi Hambatan Dalam Proses Implementasi Perlindungan Konsumen Rokok Sehat Tentrem Dari Pelanggaran Standar Produksi Yang Dilakukan Oleh Pelaku Usaha Rokok Sehat Tentrem. Tujuan dari dilakukannya penelitian ini adalah untuk menganalisis implementasi perlindungan konsumen rokok sehat tentrem dari pelanggaran standar produksi yang dilakukan oleh pelaku usaha rokok sehat tentrem ditinjau dari PP No. 109 Tahun 2012 dan untuk menganalisis upaya yang dilakukan untuk mengatasi hambatan dalam proses implementasi perlindungan konsumen rokok sehat tentrem dari pelanggaran standar produksi yang dilakukan oleh pelaku usaha rokok sehat tentrem. Penelitian ini merupakan penelitian yuridis empiris, dengan pendekatan yuridis sosiologis, yang mempergunakan teknik analisis berupa deskriptif analisis untuk merangkai data primer berupa wawancara dan data sekunder berupa literatur-literatur yang menunjang data primer guna menjawab permasalahan dalam penelitian ini. Hasil dari penelitian ini menunjukkan bahwa Pelaku usaha rokok sehat Tentrem telah melanggar hukum dengan membuat klaim palsu tentang risiko penggunaan produk. Selain itu, tindakan pelaku usaha rokok sehat tentrem melanggar standar produksi yang dipersyaratkan, khususnya persyaratan untuk mencantumkan peringatan kesehatan dalam rokok. Seperti yang dikatakan sebelumnya, rokok sehat tidak mengandung nikotin, namun produk ini masih mengandung tar. Pelanggaran ini diperparah oleh strategi pemasaran yang digunakan oleh perusahaan yang mengklaim manfaat kesehatan dari merokok mereka. Dalam hal ini, produsen rokok sehat tentrem dapat menghadapi hukuman penjara atau denda sebagai akibat dari hukuman pidana. Selain itu, pelanggaran larangan berdasarkan Pasal 26. Sehingga, implementasi terhadap perlindungan konsumen rokok Sehat Tentrem belum terlaksanakan dengan baik karena adanya sejumlah hambatan. Upaya yang dilakukan konsumen merasa dirugikan dengan tidak terbuktinya klaim-klaim yang dilakukan oleh pelaku usaha telah berusaha untuk melakukan tindakan penyelesaian atas masalahnya tersebut dengan mengadakan perundingan. Perundingan ini dilakukan hanya antara kedua belah pihak saja yaitu konsumen dan pelaku usaha, yang dimaksudkan untuk mencari jalan tengah dari permasalahan yang terjadi dan tidak terdapat salah satu pihak yang secara nyata dirugikan. Pilihan Konsumen untuk tidak melakukan penyelesaian sengketa melalui jalur hukum ini dapat didasarkan atas pemikiran bahwa ganti kerugian yang diberikan tidaklah sebanding dengan biaya dan waktu yang dikeluarkan untuk berperkara.

English Abstract

The problem in this research is related to how the implementation of consumer protection for healthy cigarettes is peaceful from violations of production standards carried out by healthy cigarette business actors. 109 Year 2012 and How Efforts Are Made To Overcome Barriers In The Process Of Implementing Consumer Protection Of Healthy Cigarettes In Peace From Violations Of Production Standards Performed By Business Actors Of Healthy And Peaceful Cigarettes. The purpose of this study was to analyze the implementation of consumer protection for healthy cigarettes peacefully from violations of production standards by entrepreneurs of peaceful healthy cigarettes in terms of PP no. 109 of 2012 and to analyze the efforts made to overcome obstacles in the process of implementing the protection of peaceful healthy cigarette consumers from violations of production standards committed by peaceful healthy cigarette business actors. This research is an empirical juridical research, with a sociological juridical approach, which uses analytical techniques in the form of descriptive analysis to assemble primary data in the form of interviews and secondary data in the form of literatures that support primary data in order to answer the problems in this study. The results of this study indicate that Tentrem's healthy cigarette business actors have violated the law by making false claims about the risks of using the product. In addition, the actions of healthy cigarette business actors violate the required production standards, in particular the requirement to include health warnings in cigarettes. As previously stated, healthy cigarettes do not contain nicotine, but these products still contain tar. These abuses are compounded by the marketing strategies employed by companies claiming the health benefits of their smoking. In this case, producers of calm and healthy cigarettes could face imprisonment or fines as a result of criminal penalties. In addition, the violation of the prohibition based on Article 26. Thus, the implementation of the protection of Healthy Tentrem cigarette consumers has not been carried out properly due to a number of obstacles. Efforts made by consumers feel disadvantaged by not proving the claims made by business actors have tried to take action to resolve the problem by holding negotiations. These negotiations are carried out only between the two parties, namely consumers and business actors, which are intended to find a middle way of the problems that occur and there is no one party that is actually harmed. Consumers' choice not to settle disputes through this legal route can be based on the idea that the compensation provided is not commensurate with the costs and time spent in litigation.
