Abstract

Pada skripsi ini, penulis mengangkat permasalahan Upaya Penyelesaian Sengketa Kegagalan Perlindungan Data Keuangan Nasabah Bank Digital di Indonesia. Pilihan tema tersebut dilatarbelakangi oleh hadirnya bank digital di Indonesia dengan potensi kejahatan siber yang utamanya mengenai keamanan data dan penyelesaian sengketa yang belum diatur secara khusus dalam suatu peraturan tentang perlindungan data pribadi. Berdasarkan hal tersebut di atas, penelitian ini mengangkat rumusan masalah: (1) Bagaimana upaya penyelesaian sengketa kegagalan perlindungan data keuangan nasabah bank digital di Indonesia? (2) Bagaimana perlindungan hukum data keuangan nasabah bank digital di Indonesia? Kemudian penulisan karya tulis ini menggunakan metode yuridis normatif dengan metode pendekatan perundang-undangan (statute approach) dan pendekatan analisis (analytical approach). Bahan hukum yang didapatkan penulis dianalisis dengan menggunakan teknik analisis deskriptif kualitatif yaitu suatu metode analisis bahan hukum dengan cara menentukan isi atau makna aturan hukum dari peraturan perundang-undangan yang berkaitan dengan perbankan dan perlindungan data pribadi serta pendapat ahli hukum terkait. Hasil penelitian menggunakan metode di atas, penulis memperoleh jawaban atas permasalahan yang ada bahwa perlindungan hukum data keuangan nasabah bank digital di Indonesia masih diatur secara umum sebagai perlindungan terhadap data nasabah yang merupakan implementasi prinsip kerahasiaan bank yakni berupa perlindungan preventif dan perlindungan represif. Perlindungan preventif terdapat dalam berbagai ketentuan perundang-undangan yang terkait dengan data pribadi serta dalam perjanjian pembukaan rekening. Sedangkan perlindungan represif apabila muncul sengketa di antara para pihak maka dapat diselesaikan terlebih dahulu melalui mekanisme penyelesaian sengketa secara internal bank lalu Lembaga Alternatif Penyelesaian Sengketa Perbankan Indonesia atau melalui pengadilan. Bank digital sudah seharusnya dapat dimintai pertanggungjawaban apabila terjadi kegagalan perlindungan data keuangan nasabah oleh seseorang/badan hukum akibat kelalaian. Kegagalan perlindungan data pribadi nasabah oleh bank digital dapat digugat sebagai perbuatan melawan hukum atas dasar kesalahan berdasarkan ketentuan Pasal 1365 KUH Perdata, maupun atas dasar ketidakpatutan atau ketidakhati-hatian berdasarkan ketentuan Pasal 1366 KUH Perdata.

English Abstract

In this thesis, the author raises the issue of Dispute Resolution Efforts on the Failure of Financial Data Protection for Digital Bank Customers in Indonesia. The choice of theme is motivated by the presence of digital banks in Indonesia with the potential for cyber crimes, which are mainly related to data security and dispute resolution which have not been specifically regulated in a regulation on personal data protection. Based on the above, this research raises the formulation of the problem: (1) How are efforts to resolve disputes over the failure of financial data protection for digital bank customers in Indonesia? (2) What is the legal protection for digital bank customer financial data in Indonesia? Then the writing of this paper uses a normative juridical method with a statute approach and an analytical approach. The legal materials obtained by the authors were analyzed using qualitative descriptive analysis techniques, namely a method of analyzing legal materials by determining the content or meaning of the legal rules of laws and regulations relating to banking and personal data protection as well as the opinions of related legal experts. The results of the study using the above method, the authors obtained answers to the existing problems that the legal protection of digital bank customer financial data in Indonesia is still generally regulated as protection of customer data which is the implementation of the principle of bank secrecy in the form of preventive protection and repressive protection. Preventive protection is contained in various statutory provisions related to personal data as well as in account opening agreements. . Whereas repressive protection if a dispute arises between the parties, it can be resolved first through the internal dispute resolution mechanism of the bank and then the Indonesian Banking Alternative Dispute Resolution Institution or through the courts. Digital banks should be held accountable if there is a failure to protect customer financial data by a person/legal entity due to negligence. Failure to protect customers' personal data by digital banks can be sued as an act against the law on the basis of an error based on the provisions of Article 1365 of the Civil Code, or on the basis of impropriety or carelessness based on the provisions of Article 1366 of the Civil Code.
