Abstract

Pada skripsi ini, Penulis mengangkat masalah konsekuensi yuridis dari perbuatan ajakan menolak vaksinasi Covid-19 di muka umum. Pemilihan tema tersebut dilatarbelakangi oleh peristiwa ketika Pemerintah Indonesia melaksanakan program wajib vaksinasi secara intensif di masa pandemi, terdapat masyarakat dengan sengaja mengajak masyarakat lain untuk menolak vaksinasi Covid-19. Berdasarkan hal tersebut di atas, karya tulis ini menunjukkan manifestasi masalah: (1) Apakah ajakan menolak vaksinasi Covid-19 di muka umum merupakan tindak pidana?, (2) Apa ketentuan pasal yang dapat dikaitkan dengan ajakan menolak vaksinasi Covid-19 di muka umum? Kemudian penelitian ini menggunakan metode yuridis normatif dengan metode pendekatan perundang-undangan (statute approach). Bahan hukum primer, sekunder, dan tersier yang diperoleh Penulis akan dianalisis dengan menggunakan teknik analisis penafsiran gramatikal. Dari hasil penelitian dengan metode di atas, Penulis mendapatkan jawaban untuk masalah yang ada, yaitu dari perbuatan ajakan menolak vaksinasi Covid-19 merupakan tindak pidana karena perbuatan tersebut bertentangan dengan program pemerintah dalam penanggulangan penyebaran virus Covid-19 yang dengan sengaja menghalangi pelaksanaan penanggulangan wabah menular. Serta ketentuan pasal yang dapat dikaitkan dengan perbuatan tersebut yaitu Pasal 14 ayat (1) Jo. Pasal 5 ayat (1) huruf c Undang-Undang Nomor 4 Tahun 1984 Tentang Wabah Penyakit Menular karena pencegahan dan pengebalan adalah tindakan-tindakan yang dilakukan untuk memberi perlindungan kepada orang-orang yang belum sakit, akan tetapi mempunyai risiko untuk terkena penyakit. Sedangkan Pasal 160 KUHP, harus terpenuhinya delik materil dalam putusan Mahkamah Konstitusi Nomor 7/PUU-VII/2009 sebagai delik materil.

English Abstract

In this thesis, the author raises the issue of the juridical consequences of the invitation to refuse the Covid-19 vaccination in public. The choice of this theme was motivated by an incident when the Government of Indonesia carried out an intensive mandatory vaccination program during a pandemic, where people deliberately invited other people to reject the Covid-19 vaccination. Based on the foregoing, this paper shows the manifestation of the problem: (1) Is a public invitation to reject the revision of Covid-19 a crime?, (2) What are the provisions of the article that can be linked to a call to refuse public Covid-19 vaccinations? Then this study uses a normative juridical method with a statute approach. Primary, secondary, and tertiary legal materials obtained by the author will be analyzed using grammatical interpretation analysis techniques. From the results of the research using the method above, the author gets answers to existing problems, namely from the act of solicitation to refuse the Covid-19 vaccination which is a criminal offense because this act is contrary to the government's program in tackling the spread of the Covid-19 virus which deliberately hinders the implementation of infectious disease prevention. . As well as the provisions of the article that can be linked to the act, namely Article 14 paragraph (1) Jo. Article 5 paragraph (1) letter c of Law Number 4 of 1984 concerning Outbreaks of Infectious Diseases because prevention and immunity are actions taken to provide protection to people who are not yet sick, but have a risk of getting the disease. Whereas Article 160 of the Criminal Code, the material offense must be fulfilled in the Constitutional Court decision Number 7/PUU-VII/2009 as a material offense.
