Abstract

Pada skripsi ini, penulis mengangkat permasalahan mengenai anonimitas menjadi komponen penting untuk melindungi hak atas kebebasan berekspresi dan hak atas privasi sebagai derogable rights. Permasalahan kebocoran data pribadi dalam marketplace menjadikan perlu adanya anonimitas yang sebagai langkah mengatasi potensi pencurian dan penyalahgunaan data pribadi. Adanya isu anonimitas ini menjadi menarik untuk dibahas karena berkaitan dengan kebebasan berekspresi serta terdapat banyak perdebatan antara hak untuk tidak beridentitas atau anonimitas dan kepatuhan identitas untuk mendapatkan validitas identitas pengguna khususnya dari marketplace. Pelapor Khusus PBB menyatakan bahwa internet yang terbuka dan aman harus diperhitungkan di antara prasyarat untuk menikmati kebebasan berekspresi saat ini, dan oleh karena itu harus dilindungi oleh pemerintah. Berdasarkan hal tersebut diatas, penulis mengangkat rumusan masalah dalam skripsi ini: (1) Bagaimana analisis keterkaitan Anonimitas sebagai Derogable Rights dalam perspektif transaksi elektronik? (2) Bagaimana pengaturan perlindungan hukum anonimitas dalam transaksi elektronik pada marketplace di Indonesia? Kemudian penulisan skripsi ini menggunakan metode yuridis normatif dengan metode pendekatan perundang-undangan (statue appoach) dan pendekatan analitis (analytical approach). Bahan hukum primer, sekunder, dan tersier yang diperoleh penulis akan dianalisis dengan menggunakan metode penafsiran gramatikal, penafsiran sistematis. Dari hasil penelitian metode di atas, penulis memperoleh jawaban anonimitas sebagai bentuk hak asasi manusia dengan sifat derogable rights dalam penerapannya masih dapat dibatasi. hingga saat ini di Indonesia belum mengatur terkait anonimitas dalam pemilihan penggunaan data pribadi. Dalam hal perlindungan atas data pribadi tidak ada mengatur mengenai penyelesaian atas kebocoran data pribadi serta kerugian yang dialami oleh konsumen atau pengguna

English Abstract

This thesis raises the issue of anonymity which is a key component to protect the right to freedom of expression and the right to privacy as derogable rights. The problem of leakage of personal data in the marketplace makes the need for anonymity as a step to overcome the potential for theft and misuse of personal data. The existence of this anonymity issue is interesting to discuss because it relates to freedom of expression and there were many debates between the right to not have an identity or anonymity and identity compliance to obtain the validity of user identities, especially from the marketplace. The UN Special Rapporteur stated that an open and secure internet must be counted among the prerequisites for enjoying freedom of expression today, and therefore must be protected by governments. This thesis raises the formulation of the problem: (1) How is the analysis of the relationship between Anonymity as Derogable Rights in the perspective of electronic transactions? (2) How is the legal protection for anonymity in electronic transactions in the marketplace in Indonesia? This thesis uses a normative juridical method with a statutory approach and an analytical approach. The primary, secondary, and tertiary legal materials obtained by the author will be analyzed using the method of grammatical interpretation, systematic interpretation. From the results of the research using the above method, the author obtains the answer that anonymity is a form of human rights with the nature of derogable rights in its application which can still be limited. Until now, Indonesia has not regulated regarding anonymity in choosing the use of personal data. In terms of protection of personal data, there is no regulation regarding the settlement of personal data leakage and losses experienced by consumers or users.
