Abstract
Pada skripsi ini, peneliti mengangkat isu hukum mengenai upaya yang dilakukan oleh Unit PPA Kepolisian Resor Mojokerto terhadap pemulihan dampak psikologis anak korban kekerasan seksual di Mojokerto. Pemilihan tema ini dilatar belakangi oleh karena banyaknya perbuatan tindak pidana yang dilakukan terhadap anak. Salah satu di antaranya adalah tindakan kekerasan seksual terhadap anak yang dampaknya menyerang psikologis korban. Tingkat kekerasan seksual pada anak di Mojokerto dari tahun ke tahun tidak menunjukkan penurunan, bahkan relatif stabil. Trauma yang berat atas peristiwa kekerasan seksual yang diterima anak korban beresiko membuat korban shock. Sehingga akibat dari shock tersebut akan berpengaruh pada perilaku fisik korban. Berdasarkan latar belakang yang telah peneliti sebutkan diatas, skripsi ini mengangkat 2 (dua) rumusan masalah yaitu : (1) Bagaimana bentuk penanganan dampak psikologis terhadap anak korban kekerasan seksual sebagaimana diatur dalam peraturan perundang-undangan di Indonesia? (2) Apa kendala dan upaya yang dilakukan Unit PPA Polres Mojokerto dalam melaksanakan kewajibannya untuk memulihkan dampak psikologis anak korban kekerasan seksual di wilayah hukum Polres Mojokerto? Untuk menjawab rumusan masalah, metode yang digunakan oleh peneliti adalah metode penelitian hukum yuridis empiris (socio legal) dan dengan menggunakan metode pendekatan yuridis sosiologis. Peneliti melakukan penelitian lapangan dengan mengkaji ketentuan hukum yang berlaku dan fenomena-fenomena yang terjadi dalam kehidupan masyarakat. Berdasarkan yang peneliti paparkan diatas peneliti memperoleh hasil penelitian yakni, jawaban atas permasalahan yang peneliti peroleh bahwa bentuk penanganan dampak psikologis terhadap anak korban kekerasan seksual yang diberikan oleh Unit PPA Polres Mojokerto adalah : Memberikan pendampingan hukum, pendampingan medis, dan pendampingan psikologis; Memulihkan trauma korban dengan cara melakukan pendekatan kepada korban agar menimbulkan perasaan nyaman dan aman bagi korban, dan melakukan kerja sama dengan pekerja Sosial dari Dinas Sosial untuk memberikan pembinaan sehingga dapat dijadikan bekal untuk menghadapi masa depan; Memberi motivasi agar semangat belajar, mencari ilmu, dan memperbanyak wawasan, karena anak korban kekerasan seksual memiliki potensi dan peluang sukses yang sama dengan anak-anak di luaran sana yang seumuran dengan mereka. Sedangkan kendala yang dialami Unit PPA Polres Mojokerto dalam pemulihan dampak psikologis anak korban kekerasan seksual adalah Terbatasnya petugas yang mengatasi kasus kekerasan seksual pada anak yang berdampak pada keadaan psikologis korban; Terbatasnya anggaran dalam penanganan pemulihan dampak psikologis anak korban kekerasan seksual; Adanya pandemi Covid-19 sehingga menghambat penanganan pemulihan dampak psikologis anak korban kekerasan seksual; dan Lingkungan dan masyarakat sekitar yang semakin mempersalahkan anak yang menjadi korban kekerasan seksual. Sehingga untuk mengatasi kendala tersebut dilakukanlah upaya Menjalin kerja sama dengan lebih banyak lembaga bantuan Hukum di Mojokerto; Menjalin lebih banyak kerja sama dengan instansi dari berbagai sektor yang berbeda; Mengajukan peninjauan terkait keterbatasan anggaran; dan melakukan sosialisasi kepada masyarakat tentang pentingnya memahami kasus kekerasan seksual pada anak.
English Abstract
In this thesis, the researcher raises the legal issue regarding the responsibility of the state towards the recovery of the psychological impact of child victims of sexual violence in Mojokerto. The background for choosing this theme is the number of criminal acts committed against children. One of them is the act of sexual violence against children, whose impact is psychologically attacking the victim. The level of sexual violence against children in Mojokerto from year to year does not show a decline, in fact it is relatively stable. Victims of sexual violence are at risk of experiencing severe trauma because the rape incident is something that shocks the victim. Psychological shock can be experienced at the time of rape as well as after, and can be accompanied by physical reactions. Based on the above, this thesis raises the formulation of the problem, namely: (1) What is the form of handling the psychological impact on child victims of sexual violence as regulated in Indonesian laws and regulations? (2) What are the obstacles and efforts made by the PPA Unit of the Mojokerto Police in carrying out its obligations to restore the psychological impact of child victims of sexual violence in the jurisdiction of the Mojokerto Police? To answer the formulation of the problem above, the researcher uses an empirical juridical legal research method (socio legal) and uses a sociological juridical approach. Researchers conduct field research by examining applicable legal provisions and what happens in people's lives. From the results of the research above, the researchers obtained answers to the existing problems so that it was concluded that the form of handling the psychological impact on children victims of sexual violence provided by the PPA Unit of the Mojokerto Police was: Provide legal assistance, medical assistance, and psychological assistance; Restoring trauma to victims by approaching victims to create a feeling of comfort and safety for victims, and collaborating with Social workers from the Social Service to provide guidance so that they can be used as preparations for facing the future; Motivating students to be enthusiastic about learning, seeking knowledge, and expanding their knowledge, because children who are victims of sexual violence have the same potential and chances of success as other children out there who are the same age as them. Meanwhile, the obstacles faced by the Mojokerto Police PPA Unit in recovering the psychological impact of child victims of sexual violence are: The lack of officers who handle cases of sexual violence against children that have an impact on the psychological state of the victim; Limited budget in handling the recovery of psychological impacts of children victims of sexual violence; The existence of the Covid-19 pandemic has hampered the handling of the recovery of the psychological impact of children who are victims of sexual violence; and The environment and the surrounding community are increasingly blaming children who are victims of sexual violence. So to overcome these obstacles, efforts were made to establish cooperation with many legal aid institutions in Mojokerto; Establish more cooperation with agencies from different sectors; Submit a review regarding budget constraints; and conduct outreach to the community about the importance of understanding cases of sexual violence against children.
