English Abstract

The researcher examines the issue of Law Enforcement Constraints faced by Judges at the Religious Courts of Jombang Regency with the increasing number of marriages below the minimum age of marriage in Jombang Regency from year to year. This theme was chosen because of the increasing number of marriages below the minimum age for marriage in the last three years in Jombang Regency. In addition, the obstacles faced by judges in law enforcement must be known, so that later they can find the causes and efforts that can be made to reduce the number of marriages. Thesis research with the formulation of the problem: 1. What are the obstacles in law enforcement on marriages below the minimum age of marriage in Jombang Regency. 2. What efforts can be made to overcome obstacles to law enforcement on marriages below the minimum age of marriage. To answer this problem, empirical legal research uses a sociological juridical approach. Using the Types and Sources of primary and secondary data, as well as the results of interviews with Judges which were analyzed using literature studies and documentation studies. In addition, it also uses descriptive analysis techniques, namely by describing the results of research conducted on the object of research using a qualitative approach. Based on the problems above, it can be concluded that the obstacles in law enforcement against marriages below the minimum age of marriage in the Religious Courts of Jombang Regency are the first from the legal factor itself, the second due to factors from law enforcement, the third factor is the lack of existing facilities and facilities, the fourth factor is the lack of awareness of the community, and cultural factors that exist in the community. Then efforts to overcome obstacles in law enforcement against marriages below the minimum age of marriage by means of submitting proposals to clarify and reinforce existing rules, providing training for special judges in adjudicating child cases, providing a communicative platform to the community regarding the prevention of marriages under the minimum age of marriage, conduct cooperation between related agencies to conduct socialization or legal counseling about marriage to the public.
