Abstract
Pada skripsi ini, berdasarkan pada permasalahan terkait pertimbangan hukum Majelis Hakim dalam Perkara Nomor: 920/Pid.Sus/2019/Pn Jkt.Sel mengenai kasus menghimpun dana masyarakat dalam bentuk simpanan tanpa izin dari Pimpinan Bank Indonesia yang hanya menuntut pertanggungjawaban dari Terdakwa selaku Direktur Operasional PT. Exist Assetindo, maka rumusan masalah yang diangkat adalah : 1. Apakah pertimbangan hukum Majelis Hakim dalam Memutus perkara Nomor: 920/Pid.Sus/2019/Pn Jkt.Sel mengenai penjualan Promissory note oleh PT Exist Assetindo merupakan pelangggaran Pasal 46 ayat (1) Undang-undang nomor 7 tahun 1992 tentang Perbankan yang dilakukan oleh Korporasi? dan 2. Apakah PT Exist Assetindo sebagai subjek hukum korporasi dalam perkara Nomor: 920/Pid.Sus/2019/Pn Jkt.Sel dapat dimintai pertangunggungjawaban pidana korporasi dalam tindak pidana perbankan?. Dengan menggunakan metode penelitian yuridis normatif serta pendekatan perundang-undangan dan pendekatan kasus, peneliti dapat menjabarkan hasil analisis bahwa korporasi dalam Perkara Nomor: 920/Pid.Sus/2019/Pn Jkt.Sel dapat dimintai pertanggungjawaban pidana karena telah memenuhi unsur tindak pidana oleh korporasi dalam Pasal 4 PERMA Nomor 13 Tahun 2016 tentang Tata Cara Penanganan Tindak Pidana oleh Korporasi. Meskipun hakim menggunakan dasar pertimbangan dalam UU Nomor 7 Tahun 1992 sebagaimana telah dirubah dengan UU Nomor 10 Tahun 1998 tentang Perbankan, maka sesuai dengan Pasal 46 ayat (2) UU tersebut, yang seharusnya dimintai pertanggungjawaban bukan hanya Terdakwa selaku Direktur Operasional, tetapi juga pihak-pihak lain yang ikut terlibat dan bertanggung jawab atas perbuatan ini.
English Abstract
In this thesis, based on the legal considerations of the Panel of Judges Case Number: 920/Pid.Sus/2019/Pn Jkt.Sel regarding the case of collecting funds from the public without permission from the Management of Bank Indonesia, which only demands accountability from the Defendant as Operational Director of PT. Exist Assetindo, the the formulation of the problem raised is : 1. Are the legal considerations of the Panel of Judges in deciding the case Number: 920/Pid.Sus/2019/Pn Jkt.Sel regarding the sale of promotional notes by PT Exist Assetindo constitutes corporate criminal liability related to criminal acts of Article 46 paragraph (1) of law Number 7 of 1992 concerning banking committed by a Corporation? and 2. Can PT Exist Assetindo as a corporate legal subject in case Number: 920/Pid.Sus/2019/Pn Jkt.Sel be held accountable for corporate crime in banking crimes?. By using normative juridicial research methods as well as statutory and case approaches, researchers can describe the results of the analysis is the corporation in case number: 920/Pid.Sus/2019/Pn Jkt.Sel, can be held criminally responsible because it has fulfilled the elements of a criminal act by the corporation in Article 4 PERMA 13 Tahun 2016 concerning Procedures for Handling Criminal Acts by Corporations. Even though the judge used the basis of consideration in UU No. 7 Tahun 1992 amanded by UU No. 10 Tahun 1998 concerning Banking, then in accordance with Article 46 (2) of this rule, what should be held accountable is not only the Defendant as Operational Director, but also other parties that involved and responsible for this act.
