Abstract

Tahun 1960 masyarakat Bojong Koneng menerima surat garap dari negara setelah HGU PTPN XI habis masa. Sejak 1960 banyak masyarakat Bojong Koneng yang melakukan jual beli lahan eks HGU PTPN dengan surat oper alih garap. Salah satu jual beli yang terjadi adalah jual beli Rocky Gerung dengan Andi Junaedi pada tahun 2009. Tahun 2021, PT. Sentul City melakukan somasi dengan dasar kepemilikan SHGB kepada beberapa warga yang diduga menempati lahan milik PT. Sentul City. Somasi tersebut meminta masyarakat untuk segera mengosongkan lahan dalam kurun waktu 7 x 24 jam. Masyarakat yang menerima somasi merasa dirinya juga berhak atas tanah tersebut, karena telah menguasai secara fisik sejak tahun 1960. Berdasarkan hal tersebut diatas, penelitian ini mengangkat dua rumusan masalah: (1) Bagaimana keabsahan jual beli sebidang tanah dengan alas hak garap yang dilakukan oleh Rocky Gerung dengan penggarap? (2) Bagaimana kekuatan bukti yang dimiliki oleh PT. Sentul City dan Rocky Gerung menurut PP No. 24 Tahun 1997 tentang pendaftaran tanah? Penelitian ini menggunakan metode yuridis normatif, serta pendekatan undang-undang (statur approach) dan pendekatan kasus (case approach), dan pendekatan konseptual. Penulis menganalisa bahan hukum dengan menggunakan teknik analisis sistematis untuk bahan hukum peraturan perundang-undangan, dengan menghubungkan peraturan hukum primer dengan keseluruhan sistem hukum positif Indonesia. Teknik analisis hermeneutika untuk bahan hukum sekunder, dengan cara menguraikan bahan hukum sekunder hingga mendapatkan makna dan arti tersirat dalam bahan hukum sekunder. Hasil dari kedua analisis tersebut akan digabungkan dengan menggunakan analisis deskriptif, dengan memeparkan hasil analisis secara rinci dengan menggunakan kalimat deduktif. Hasil penelitian menunjukkan bahwa jual beli antara pemegang hak garap (penjual) dengan Rocky Gerung (pembeli) adalah sah. Hal ini dikarenakan berdasarkan hukum kebiasaan setempat, memperbolehkan hal tersebut. Peralihan hak garap tersebut memiliki bukti berupa surat pernyataan oper alih. Selain itu, proses peralihan hak dilakukan di hadapan kepala desa dan saksi. Namun, surat perrnyataan oper alih garapan tidak dapat dijadikan sebagai bukti peralihan hak atas tanah. Sementara itu, bukti milik PT. Sentul City, berupa sertifikat tanah, dalam Pasal 32 ayat (1) PP No. 24 Tahun 1997 tentang Pendaftaran Tanah, memiliki kekuatan pembuktian yang kuat. Tetapi, secara prosedural sertifikat tanah tersebut dapat diajukan gugatan pembatalan sertifikat. Gugatan tersebut, harus memperhatikan ketentuan Pasal 32 ayat (2) PP No. 24 Tahun 1997 tentang Pendaftaran Tanah.

English Abstract

In 1960, the people of Bojong Koneng received a letter from the state after the PTPN XI HGU expired. Since 1960, many people in Bojong Koneng have been buying and selling land for the former PTPN HGU with a letter of operation over the work. One of the buying and selling that occurred was the sale and purchase of Rocky Gerung with Andi Junaedi in 2009. In 2021, PT. Sentul City made a subpoena based on the ownership of the SHGB to several residents who were suspected of occupying land owned by PT. Sentul City. The summons asked the community to immediately vacate the land within 7 x 24 hours. The people who received the subpoena felt that they also had the right to the land because they had physically controlled it since 1960. Based on the above, this paper raises the formulation of the problem: (1) How is the validity of the sale and purchase of a plot of land with the right to cultivate carried out by Rocky Gerung with tenants? (2) What is the strength of the evidence owned by PT. Sentul City and Rocky Gerung according to PP No. 24 of 1997 concerning land registration? The writing of this paper uses a normative juridical method, with a statutory approach and a case approach. The legal material obtained by the author will be analyzed using a systematic analysis technique for the legal material of laws and regulations, by linking primary legal regulations with the overall positive legal system of Indonesia. Hermeneutic analysis technique for secondary legal materials, by describing secondary legal materials to obtain the meaning and implicit meaning in secondary legal materials. The results of the two analyzes will be combined using descriptive analysis, by describing the results of the analysis in detail using deductive sentences. The results showed that the sale and purchase between the holder of cultivation rights (the seller) and Rocky Gerung (the buyer) was legal. This is because based on local customary law, this is allowed. The transfer of cultivation rights has evidence in the form of a transfer statement letter. In addition, the rights music process was carried out in front of the village head and witnesses. However, the statement letter for the transfer of arable land cannot be used as evidence of land rights music. Meanwhile, the evidence belonging to PT. Sentul City, in the form of land certificates, in Article 32 paragraph (1) PP no. 24 of 1997 concerning Land Registration, has strong evidentiary power. However, procedurally the land certificate can be submitted for a certificate testing application. The lawsuit must pay attention to the provisions of Article 32 paragraph (2) PP No. 24 of 1997 concerning Land Registration.
