Abstract
Pada skripsi ini, penulis mengangkat permasalahan Implementasi Pasal 9A Ayat (1) Huruf a Peraturan Menteri Pendidikan dan Kebudayaan Nomor 19 Tahun 2020 tentang Perubahan Atas Peraturan Menteri Pendidikan dan Kebudayaan Nomor 8 Tahun 2020 tentang Petunjuk Teknis Bantuan Operasional Sekolah Reguler Di Sekolah Menengah Pertama Seluruh Kecamatan Singosari Kabupaten Malang. Pilihan tema tersebut dilatar belakangi oleh adanya dana BOS yang sudah disediakan Pemerintah untuk pembelian kuota internet sebagai penunjang pembelajaran dalam jaringan atau online namun belum sepenuhnya diterima peserta didik Sekolah Menengah Pertama di Kecamatan Singosari, Kabupaten Malang selama masa pandemi covid-19. Dalam hal ini peserta didik dan/atau orang tua harus mengeluarkan uang pribadi untuk membeli kuota internet sebagai penunjang pembelajaran peserta didik. Berdasarkan hal tersebut diatas, karya tulis ini mengangkat rumusan masalah : (1) Mengapa implementasi Pasal 9A ayat (1) huruf a Peraturan Menteri Pendidikan dan Kebudayaan Nomor 19 Tahun 2020 tentang Petunjuk Teknis Bantuan Operasional Sekolah Reguler di sekolah menengah pertama seluruh Kecamatan Singosari Kabupaten Malang pada masa pandemi Covid-19 tidak dapat dimanfaatkan oleh peserta didik? (2) Apakah faktor penghambat dalam implementasi Pasal 9A ayat (1) huruf a Peraturan Menteri Pendidikan dan Kebudayaan Nomor 19 Tahun 2020 tentang Petunjuk Teknis Bantuan Operasional Sekolah Reguler di sekolah menengah pertama seluruh Kecamatan Singosari Kabupaten Malang pada masa pandemi Covid-19? (3) Bagaimana upaya Dinas Pendidikan Kabupaten Malang dalam mengatasi faktor penghambat implementasi Pasal 9A ayat (1) huruf a Peraturan Menteri Pendidikan dan Kebudayaan Nomor 19 Tahun 2020 tentang Petunjuk Teknis Bantuan Operasional Sekolah Reguler di sekolah menengah pertama seluruh Kecamatan Singosari Kabupaten Malang pada masa pandemi Covid-19 ? Kemudian penulisan karya tulis ini menggunakan metode yuridis empiris dengan metode pendekatan yuridis sosiologis. Bahan hukum primer, sekunder dan tersier yang diperoleh penulis akan dianalisis dengan menggunakan teknik analisis metode pendekatan kualitatif dengan cara menganalisa permasalahan yang ada di lapangan, selanjutnya akan dikaji dikaitkan dengan peraturan perundang-undangan yang berlaku. Dari hasil penelitian dengan metode diatas, penulis memperoleh jawaban atas permasalahan yang ada bahwa Dinas Pendidikan Kabupaten Malang selaku Pemerintah sudah mengetahui adanya ketidakdisiplinan peserta didik dalam penggunaan bantuan kuota internet, berkaitan dengan pendataan peserta didik yang akan memperoleh dana BOS, provider celuler yang bekerja sama dalam penyediaan layanan internet dan berkaitan dengan 8 Standar Nasional Pendidikan yang menyebabkan bantuan kuota internet tersebut tidak dapat diterima oleh semua peserta didik Sekolah Menengah Pertama di Kecamatan Singosari Kabupaten Malang. Maka solusi yang dapat dilakukan oleh Dinas Pendidikan mendukung upaya yang dilakukan pihak sekolah dalam memberlakukan kembali Lembar Kerja Siswa (LKS) meskipun Lembar Kerja Siswa tersebut sudah ada sebelum proses pembelajaran dalam jaringan diterapkan ditengah pandemi covid-19 dan mengharapkan untuk pendidik bersedia dalam mengajar ke rumah peserta didik yang membutuhkan.
English Abstract
In this thesis, the author raises the problem of the Implementation of Article 9A Paragraph (1) Letter a Regulation of the Minister of Education and Culture Number 19 of 2020 concerning Amendments to the Regulation of the Minister of Education and Culture Number 8 of 2020 Regarding Technical Instructions for Regular School Operational Assistance in Junior High Schools in All Districts of Singosari, Malang. The choice of this theme was motivated by the existence of BOS funds that had been provided by the Government to purchase internet quotas as support for online learning, but this was not fully accepted by junior high school students in Singosari District, Malang during the Covid-19 pandemic. In this case students and / or parents have to spend personal money to buy internet quotas to support student learning. Based on things explained above, this paper raises the formulation of the problem: (1) How is the implementation of Article 9A paragraph (1) letter a Regulation of the Minister of Education and Culture Number 19 of 2020 concerning Technical Instructions for Regular School Operational Assistance in junior high schools throughout Singosari District, Malang Regency during the Covid-19 pandemic? (2) What are the inhibiting factors in the implementation of Article 9A paragraph (1) letter a Regulation of the Minister of Education and Culture Number 19 of 2020 concerning Technical Guidelines for Operational Assistance for Regular Schools in junior high schools throughout Singosari District, Malang during the Covid-19 pandemic? (3) How is the efforts of the Malang Regency Education Office in overcoming the inhibiting factors for the implementation of Article 9A paragraph (1) letter a Regulation of the Minister of Education and Culture Number 19 of 2020 concerning Technical Instructions for Regular School Operational Assistance in junior high schools throughout Singosari District, Malang Regency during the pandemic Covid-19? Then the writing of this paper uses an empirical juridical method with a sociological juridical approach. The primary, secondary and tertiary legal materials obtained by the author will be analyzed using analysis techniques with a qualitative approach by analyzing problems in the field, then they will be studied in relation to the applicable laws and regulations. From the results of the research with the method above, the authors get answers to the existing problems that the Malang Regency Education Office as the Government already knows about the indiscipline of students in the use of internet quota assistance, related to data collection of students who will receive BOS funds, cellular providers who cooperate in the use of internet quota assistance, the provision of internet services and related to the 8 National Education Standards which caused the internet quota assistance not to be accepted by all junior high school students in Singosari District, Malang Regency. So the solution that can be made by the Education Office supports the efforts made by the school in re-enacting Student Worksheets even though the Student Worksheets already exist before the learning process in the network is implemented in the midst of the Covid-19 pandemic and hopes for educators to be willing to teach at home learners who need.
