Abstract

Pada skripsi ini, permasalahan yang terdapat dalam penelitian ini adalah terdapat perbedaan antara aturan (das sollen) dalam hal ini adalah Pasal 20 Peraturan Walikota Pasuruan Nomor 43 Tahun 2018 tentang Kawasan Tanpa Rokok dan kenyataan yang ada di lapangan (das sein). Alasan pemilihan tema tema tersebut dikarenakan oleh ketidakefektifan daripada Pasal 20 yang dimana isinya pada Pasal 20 mengenai sanksi yang diberikan kepada orang yang melanggar ketentuan dari Pasal 8 mengenai larangan orang merokok di KTR, menjual atau membeli rokok di KTR kecuali bagi tempat umum yang memiliki izin untuk menjual rokok, kemudian dilarang mengiklankan, mempromosikan dan memberi sponsor di lingkungan KTR di Kota Pasuruan. Berdasarkan hal tersebut, maka terdapat 2 (dua) rumusan masalah antara lain: (1) Bagaimana pelaksanaan efektivitas Pasal 20 Peraturan Walikota Pasuruan Nomor 43 Tahun 2018 tentang Kawasan Tanpa Rokok? (2) Faktor apa saja yang mempengaruhi efektivitas Pasal 20 Peraturan Walikota Pasuruan Nomo 43 Tahun 2018 tentang Kawasan Tanpa Rokok? Dari hasil penelitian yang sudah dilakukan, penulis memperoleh jawaban atas pertanyaan yang ada bahwa pelaksanaan efektivitas Pasal 20 Peraturan Walikota Pasuruan Nomor 43 Tahun 2018 tentang kawasan tanpa rokok sampai sekarang belom dilaksanakan. Adapun faktor-faktor yang mempengaruhinya meliputi faktor penegak hukum, faktor sarana dan fasilitias, faktor masyarakat, faktor kebudayaan.

English Abstract

In this thesis, the problem contained in this research is that there are differences between the rules in this case are Articles 20 of Pasuruan Mayor Regulation Number 43 of 2018 concerning Non-Smoking Areas and the reality on the ground. The reason for choosing these themes was due to the ineffectiveness of Articles 20 which contained in Article 20 regarding the sanctions given to people who violated the provisions of Article 8 regarding the prohibition. people smoke in non smoking areas, sell or buy cigarettes in non smoking areas except for public places that have a license to sell cigarettes, then are prohibited from advertising, promoting and sponsoring in non smoking areas environment in Pasuruan City. Based on this, there are 2 (two) problem: (1) How is the implementation of the effectiveness of Articles 20 of Pasuruan Mayor Regulation Number 43 of 2018 concerning Non-Smoking Areas? (2) What factors affect the effectiveness of Articles 20 of Pasuruan Mayor Regulation No. 43 of 2018 concerning Non-Smoking Areas? From the results of the research that has been carried out, the authors obtained answers to the existing questions that the implementation of the effectiveness of Articles 20 of the Pasuruan Mayor Regulation Number 43 of 2018 concerning non- smoking areas has so far been ineffective. The factors that influence it include law enforcement factors, facilities factors, community factors, cultural factors.
