Abstract

Pada skripsi ini, penulis mengangkat permasalahan tentang Efektivitas Pelaksanaan pasal 20 ayat (1) Peraturan Daerah kota Malang nomor 2 tahun 2012 tentang ketertiban umum dan lingkungan terkait penyediaan fasilitas tempat sampah pada angkutan kota. Pilihan judul tersebut dilatarbelakangi oleh adanya ketidaksesuaian antara das sein (Peraturan yang berlaku dan das sollen (kenyataan di lapangan). Berdasarkan paragraf di atas, penelitian ini mengangkat rumusan masalah:(1) Bagaimana efektivitas Pelaksanaan pasal 20 ayat (1) Peraturan Daerah kota Malang nomor 2 tahun 2012 tentang ketertiban umum dan lingkungan terkait penyediaan fasilitas tempat sampah pada angkutan kota. (2) Apa saja kendala yang dihadapi Dinas Perhubungan Kota Malang dalam melaksanakan Peraturan Daerah tersebut. (3) Bagaimana upaya yang dapat dilakukan untuk mengatasi kendala dalam pelaksanaan pasal 20 ayat (1) Peraturan Daerah tersebut dan studi dilakukan di Dinas Perhubungan kota Malang. Metode penelitian dalam skripsi ini dengan menggunakan socio legal. Sedangkan untuk pembahasannya dengan menggunakan tepri efektivitas hukum menurut Soerjono Soekanto yang mana dilihat dari sudut pandang hukum,penegakan hukum,sarana dan prasarana,masyarakat dan kebudayaan. Dari hasil penelitian dengan metode di atas, penulis memperoleh jawaban atas permasalahan yang ada bahwa Efektivitas Pelaksanaan pasal 20 ayat (1) Peraturan Daerah kota Malang nomor 2 tahun 2012 tentang ketertiban umum dan lingkungan terkait penyediaan fasilitas tempat sampah pada angkutan kota tidak efektif. Hal ini dikarenakan yang menjadi faktor penghambatnya yakni faktor penegakan hukum,faktor masyarakat dan faktor kebudayaan sedangkan yang menjadi faktor pendukungnya yakni hanya berupa faktor hukum dan faktor sarana dan prasarana.

English Abstract

In this thesis, the author raises the issue of the Effectiveness of the Implementation of article 20 paragraph (1) of the Regional Regulation of the city of Malang number 2 of 2012 concerning public order and the environment related to the provision of trash can facilities in city transportation. The choice of title was motivated by a discrepancy between das sein (applicable regulations and das sollen (reality on the ground). Based on the paragraph above, this study raises the formulation of the problem: (1) How is the effectiveness of the implementation of article 20 paragraph (1) of the Regional Regulation of the city of Malang number 2 of 2012 concerning public order and the environment related to the provision of waste can facilities in city transportation. (2) What are the obstacles faced by the Malang City Transportation Office in implementing the Regional Regulation. (3) How can efforts be made toovercome obstacles in the implementation of article 20 paragraph (1) of the Regional Regulation and the study is carried out at the Transportation Office of Malang City. The research method in this thesis is by using legal socio. As for the discussion using the law effectiveness principle according to Soerjono Soekanto which is seen from the point of view of law, law enforcement, facilities and infrastructure, society and culture. From the results of research with the above method, the author obtained answers to existing problems that the Effectiveness of the Implementation of article 20 paragraph (1) of the Malang City Regional Regulation number 2 of 2012 concerning public order and the environment related to the provision of waste bin facilities in city transportation is ineffective. This is because the inhibiting factors are law enforcement factors, community factors and cultural factors while the supporting factors are only in the form of legal factors and facilities and infrastructure factors.
