Abstract

Pasal 127B Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional Nomor 16 Tahun 2021 (Permen ATR 16/2021) mengatur tentang dapat dicatatnya Perjanjian Pengikatan Jual Beli (PPJB) dan perjanjian sewa atas tanah terdaftar ke kantor pertanahan. Sebelum adanya Pasal 127B Permen ATR 16/2021 tersebut, PPJB dan perjanjian sewa tidak diatur untuk dapat dicatatkan. Terdapat maksud, tujuan dan implikasi hukum dari Pasal 127B Permen ATR 16/2021 tersebut. Isu hukum dalam penelitian tesis ini adalah terkait ratio legis dari Pasal 127B Permen ATR 16/2021 tersebut, yakni terkait maksud, tujuan dan implikasi dari pencatatan PPJB dan perjanjian sewa ke kantor pertanahan. Rumusan masalah yang diangkat dalam tesis ini adalah: 1) Apa Implikasi Hukum Terhadap Terdaftar Atau Tidak Terdaftarnya Ppjb Sebagaimana Dimaksud Dalam Pasal 127b Ayat (1) Permen ATR 16/2021? Penelitian tesis ini merupakan penelitian yuridis normatif, dengan metode pendekatan peraturan perundang-undang (statute approach), dan pendekatan konseptual (conceptual approach). Teknik analisis yang digunakan adalah interpretasi hukum, sesuai dengan isu hukum dalam penelitian ini terhadap implikasi hukum terhadap pencatatan PPJB dan perjanjian sewa dari Pasal 127B Permen ATR 16/2021. Hasil dari pembahasan yang menjadi temuan dalam penelitian ini adalah: 1) Pencatatan PPJB tidak konsisten dengan peraturan di atasnya yaitu Peraturan Pemerintah Nomor 24 tahun 1997 tentang Pendaftaran Tanah. Dari hasil penelitian ini dapat disimpulkan bahwa: 1) Pencatatan PPJB yang merupakan akta otentik yang dibuat dihadapan notaris bukan merupakan bagian dari pendaftaran tanah. Pasal 127B Permen ATR 16/2021 terkait pencatatan PPJB dan perjanjian sewa ke kantor pertanahan tidak konsisten dengan peraturan diatasnya atau peraturan pokoknya yaitu Peraturan Pemerintah Nomor 24 tahun 1997 tentang Pendaftaran Tanah.

English Abstract

Article 127B of the Regulation of Agrarian and Spatial Planning Minister/ the Head of National Land Agency Number 16 of 2021 (henceforth referred to as Permen ATR 16/2021) regulates the possibility of the registration of sale and purchase agreement (henceforth referred to as PPJB) and the agreement of the leasing of land registered in the land agency. Previously in the absence of Article 127B of Permen ATR 16/2021, the PPJB and leasing agreement were not regulated for further registration, while this Article sets forth the intention, objectives, and legal implication. The issue studied in this research refers to the ratio legis of Article 127B of Permen ATR 16/2021 regarding the intention, objectives, and legal implication of the registration of PPJB and leasing agreement with the land agency. The research problems consist of 1) what is the legal implication of the registration status of the PPJB as intended in Article 127b Paragraph (1) of Permen ATR 16/2021? This research employed normative juridical methods and statutory and conceptual approaches. Research materials were analyzed based on the legal implication of the registration of PPJB and leasing agreement as in Article 127B of Permen ATR 16/2021. The research results reveal that 1) the registration of PPJB as an authentic deed made in the presence of a notary is not part of land registration. Article 127B of Permen ATR 16/2021 regarding the registration of PPJB and the leasing agreement with the land agency is not congruent with the law above it or the Government Regulation Number 24 of 1997 concerning Land Registration.
