Abstract
Pada skripsi ini, penulis mengangkat permasalahan terkait adanya pelanggaran terhadap kewajiban memiliki Izin Usaha Peternakan di wilayah Kabupaten Gunungkidul. Pilihan tema tersebut disebabkan Kabupaten Gunungkidul memiliki potensi besar dalam sektor peternakan akan tetapi, masih adanya pelanggaran terhadap kewajiban perizinan sebagaimana yang telah diatur d Peraturan Daerah Kabupaten Gunungkidul No. 1 Tahun 2017 Tentang Perizinan Usaha Peternakan dan Pendaftaran Peternakan Rakyat. Berdasarkan hal tersebut, penulis mencoba untuk melihat mengenai penerapan kewajiban kepemilikan Izin Usaha Peternakan sebagaimana yang telah diatur dalam Pasal 3 Ayat (1) bagi pelanggar Izin Usaha Peternakan. Berdasarkan hal tersebut, rumusan masalah dalam penelitian ini, adalah: (1) Mengapa Pasal 3 Ayat (1) Peraturan Daerah Kabupaten Gunungkidul No. 1 Tahun 2017 Tentang Perizinan Usaha Peternakan dan Pendaftaran Peternakan Rakyat belum bisa diterapkan secara maksimal di wilayah Kabupaten Gunungkidul Dan (2) Apa saja faktor-faktor yang menghambat dalam penerapan Pasal 3 Ayat (1) Peraturan Daerah Kabupaten Gunungkidul No. 1 Tahun 2017 Tentang Perizinan Usaha Peternakan dan Pendaftaran Peternakan Rakyat terhadap pelanggaran Izin Usaha Peternakan di wilayah Kabupaten Gunungkidul Penulisan skripsi ini menggunakan metode penelitian yuridis-empiris dengan pendekatan yuridis-sosiologis. Bahan hukum yang dipakai terbagi menjadi tiga yakni, primer, sekunder dan tersier yang didapatkan oleh penulis yang nantinya dianalisis dengan metode deskriptif kualitatif. Berkaitan dengan teknik sampling, peneliti menerapkan cara non-probability sampling dengan teknik purposive sampling sebagai suatu cara sampling dengan teknik pengambilan sumber data. Dari hasil penelitian, penulis mendapatkan kesimpulan bahwasanya penerapan kewajiban kepemilikan Izin Usaha Peternakan telah dilaksanakan oleh Bidang Pengendalian DPMPT Kabupaten Gunungkidul dan diberikan sanksi administratif dalam bentuk peringatan tertulis terhadap 15 kasus pelanggaran Izin Usaha Peternakan. Penerapan sanksi dilakukan secara langsung oleh Bidang Pengendalian DPMPT Kabupaten Gunungkidul, bukan dilakukan oleh Satpol PP dikarenakan sudah merupakan suatu kebiasaan hukum yang terjadi di wilayah hukum Kabupaten Gunungkidul. Adapun ada beberapa faktor penghambat dalam penegakan sanksi administratif, antara lain disebabkan oleh, faktor hukum, penegak hukum, fasilitas atau sarana, masyarakat serta kebudayaan.
English Abstract
In this thesis, the author raises issues related to the violation of the obligation to have an Animal Husbandary Business License in the Gunungkidul Regency area. The choice of the theme is due to the fact that Gunungkidul Regency has great potential in the livestock sector, however, there are still violations of licensing obligations as stipulated in the Regional Regulation of Gunungkidul Regency No. 1 of 2017 concerning Animal Husbandary Business Licensing and Registration of People's Livestock. Based on this, the author tries to look at the implementation of the obligation to own the Animal Husbandry Business License as stipulated in Article 3 Paragraph (1) for violators of the Animal Husbandry Business License. Based on these, the formulation of the problem in this study, are: (1) Why Article 3 Paragraph (1) Regional Regulation of Gunungkidul Regency No. 1 of 2017 concerning Livestock Business Licensing and Registration of People's Livestock cannot be implemented optimally in the Gunungkidul Regency area And (2) What are the factors that hinder the implementation of Article 3 Paragraph (1) of the Regional Regulation of Gunungkidul Regency No. 1 of 2017 concerning Livestock Business Licensing and Registration of People's Livestock for violations of Livestock Business Permits in the Gunungkidul Regency area? The writing of this thesis uses a juridical-empirical research method with a juridical-sociological approach. The legal materials used are divided into three, namely primary, secondary and tertiary obtained by the authors which will be analyzed using qualitative descriptive methods. In relation to the sampling technique, the researcher applies a non-probability sampling method with a purposive sampling technique as a sampling method with a data source collection technique. From the results of the study, the authors concluded that the implementation of the obligation to have a Livestock Business License has been carried out by the Controlling Division of the Gunungkidul Regency DPMPT and was given administrative sanctions in the form of a written warning against 15 cases of violations of the Animal Husbandry Business License. The application of sanctions is carried out directly by the Control Division of the Investment and Integrated Services Office of Gunungkidul Regency, not done by Satpol PP because it is a legal habit that occurs in the jurisdiction of Gunungkidul Regency. There are several inhibiting factors in the enforcement of administrative sanctions, among others caused by legal factors, law enforcement, facilities, society and culture.
