Abstract

Skripsi ini membahas mengenai, Bagaimana Efektivitas Larangan Pramuwisata Yang Tidak Memiliki KTPP (Kartu Tanda Pengenal Pramuwisata) Pasal 22 Ayat 2 Peraturan Daerah Provinsi Bali Nomor 5 Tahun 2020 Standar Penyelenggaraan Kepariwisataan Budaya Bali (Studi Di Dinas Pariwisata Pemerintah Provinsi Bali). Menurut Peneliti Dalam pasal tersebut secara tegas disebutkan Melarang pramuwisata yang Tidak Memiliki KTPP (KARTU TANDA PENGENAL PRAMUWISATA) menjalankan tugas kepemanduan wisata. Nyatanya, fakta di lapangan, masih banyaknya Pramuwisata ilegal yang beroperasi di sekitar wilayah Bali, banyak di antara mereka adalah pegawai yang bekerja di perusahaan jasa akomodasi pariwisata, seperti pekerja restoran, hotel, atau vila sehingga menjadikan pemandu wisata sebagai pekerjaan sampingan. Berangkat dari permasalahan tersebut, pada akhirnya penulis menarik (dua) rumusan masalah yang digunakan sebagai Batasan dalam penelitian penulis. Adapun rumusan masalah tersebut, yakni: (1) Bаgаimаnа Efektivitas Pasal 22 Ayat (2) Peraturan Daerah Provinsi Bali Nomor 5 Tahun 2020 tentang Standar Penyelenggaraan Kepariwisataan Budaya Bali (Studi Di Dinas Pariwisata Pemerintah Provinsi Bali) ? (2) Аpа hаmbаtаn dаn solusi Dalam Penerapan Efektivitas Pasal 22 Ayat (2) Peraturan Daerah Provinsi Bali Nomor 5 Tahun 2020 tentang Standar Penyelenggaraan Kepariwisataan Budaya Bali (Studi Di Dinas Pariwisata Pemerintah Provinsi Bali)? Metode pendekatan yang digunakan dalam penelitian ini adalah metode pendekatan yuridis sosiologis yaitu mengidentifikasi dan mengkonsepsikan hukum sebagai institusi sosial yang riil dan fungsional dalam sistem kehidupan nyata. Penulis menggunakan pendekatan tersebut karena penulis ingin menganalisa Bagaimana Efektivitas Larangan Pramuwisata Yang Tidak Memiliki KTPP (Kartu Tanda Pengenal Pramuwisata) Pasal 22 Ayat 2 Peraturan Daerah Provinsi Bali Nomor 5 Tahun 2020 Standar Penyelenggaraan Kepariwisataan Budaya Bali (Studi Di Dinas Pariwisata Pemerintah Provinsi Bali).

English Abstract

This thesis discusses the Effectiveness of the Prohibition of Tour Guides Who Do not Have a KTPP (Tourism Guide Identity Card) Article 22 Paragraph 2 of the Regional Regulation of the Province of Bali Number 5 of 2020 Standards for the Implementation of Balinese Cultural Tourism (Studies at the Tourism Office of the Provincial Government of Bali). According to the researcher, the article expressly states that it is forbidden for tour guides who do not have a KTPP (TANDmark ID card) to carry out tour guide duties. In fact, the facts on the ground are that there are still many illegal tour guides operating around the Bali area, many of whom are employees who work in tourism accommodation service companies, such as restaurant, hotel, or villa workers, thus making tour guides a side job. Departing from these problems, in the end the author draws (two) problem formulations that are used as limitations in the author's research. The formulation of the problem, namely: (1) How is the effectiveness of Article 22 Paragraph (2) of the Regional Regulation of the Province of Bali Number 5 of 2020 concerning Standards for the Implementation of Balinese Cultural Tourism (Studies at the Tourism Office of the Provincial Government of Bali)? (2) What are the obstacles and solutions in the Effective Application of Article 22 Paragraph (2) of the Bali Provincial Regulation Number 5 of 2020 concerning Standards for the Implementation of Balinese Cultural Tourism (Studies at the Bali Provincial Government Tourism Office)? The approach method used in this study is a sociological juridical approach, namely identifying and conceptualizing law as a real and functional social institution in a real-life system. The author uses this approach because the author wants to analyze the Effectiveness of the Prohibition of Tour Guides Who Don't Have a KTPP (Tourism Guide Identity Card) Article 22 Paragraph 2 of the Regional Regulation of the Province of Bali Number 5 of 2020 Standards for the Implementation of Balinese Cultural Tourism (Studies at the Tourism Office of the Provincial Government of Bali).
