Abstract
Pada Skripsi ini, penulis mengangkat permasalahan mengenai Penyelesaian Perkara Tindak Pidana dengan Restorative Justice sebagai Bentuk Perlindungan Hukum bagi Korban Penyalahgunaan Narkotika di Masa Pandemi. Pilihan tema tersebut dilatarbelakangi dengan meningkatnya korban penyalahgunaan Narkotika pada masa pandemi di wilayah hukum Kepolisian Resor Nganjuk. Berdasarkan hal yang telah dipaparkan diatas, karya tulis ini mengangkat rumusan masalah : (1) Bagaimana Penyelesaian Perkara Pidana melalui Restoratif Justice Sebagai Bentuk Perlindungan Hukum Bagi Korban Penyalahgunaan Narkotika Di Masa Pandemi? (2) Apa kendala yang dihadapi oleh Penyidik Satresnarkoba dalam menerapkan Restorative Justice pada Masa Pandemi? Kemudian jenis penelitian ini adalah penelitian empiris. Pada penelitian ini penulis menggunakan pendekatan yaitu yuridis sosiologis. Jenis data yang digunakan dalam penelitian ini adalah Data Primer dan Data Sekunder. Dari hasil penelitian dengan metode diatas, penulis memperoleh jawaban atas permasalahan yang ada bahwa Dalam pelaksanaan kewenangan penyelidikan dan penyidikan tetap berpacu pada aturan-aturan yang mengatur. Namun dengan catatan dikarenakan pelaksanaan penyidikan tersebut pada masa pandemi maka harus lebih mengedepankan prosedur protokol kesehatan.Kemudian Penanganan Restorative Justice pada Masa Pandemi khususnya anggota satresnarkoba dalam mengungkap kasus penyalahgunan Namun disamping itu mengenai penanganan Penyelesaian Perkara Pidana melalui Restoratif Justice pada Masa Pandemi di Wilayah Hukum Kepolisian Resort Nganjuk dapat teratasi.
English Abstract
In this thesis, the author raises the issue of the Settlement of Criminal Cases with Restorative Justice as a Form of Legal Protection for Victims of Narcotics Abuse in a Pandemic Period. The choice of theme was motivated by the increasing number of victims of narcotics abuse during the pandemic in the jurisdiction of the Nganjuk Police. Based on what has been described above, this paper raises the formulation of the problem: (1) How is the Settlement of Criminal Cases through Restorative Justice as a Form of Legal Protection for Victims of Narcotics Abuse During a Pandemic? (2) What are the obstacles faced by the Narcotics Satres Investigator in implementing Restorative Justice during the Pandemic Period? Then this type of research is empirical research. In this study, the author uses a sociological juridical approach. The types of data used in this study are Primary Data and Secondary Data. From the results of the research using the above method, the authors obtain answers to the existing problems that in the implementation of the authority of investigation and investigation, it is still based on the rules that govern. However, with a note that due to the implementation of the investigation during a pandemic, health protocol procedures must be prioritized. Then the handling of Restorative Justice during a Pandemic, especially members of the Narcotics Satres in uncovering cases of abuse. However, in addition, regarding the handling of criminal case settlements through Restorative Justice during the Pandemic Period in the Police Legal Area. Resort Nganjuk can be resolved.
