Abstract

Fungsi dari pembentukan peraturan pemerintah secara formil adalah untuk menyelenggarakan pengaturan lebih lanjut, ketentuan lain dalam undang-undang yang mengatur meskipun tidak tegas-tegas menyebutnya serta pengaturan lebih lanjut ketentuan dalam undang-undang yang tegas-tegas menyebutnya. Bila kita tinjau norma dalam Pasal 4 Peratruran Pemerintah Nomor 21 Tahun 2020 tentang Tentang Pembatasan Sosial Berskala Besar (PSBB) Dalam Rangka Percepatan Penanganan Corona Virus Disease 2019 (Covid-19), maka dapat kita ketahui bahwa peraturan pemerintah tersebut tidak memuat asas kesesuaian antara jenis, hierarki, dan materi muatan serta kejelasan rumusan atas Pasal 60 Undang- Undang Nomor 6 Tahun 2018 tentang Karantina Kesehatan. Dimana seharusnya dan apa yang didelegasikan oleh Undang-Undang Kekarantinaan Kesehatan sebagai dasar dari pembentukan Peraturan Pemerimtah Nomor 21 Tahun 2020 tentang Tentang Pembatasan Sosial Berskala Besar (PSBB) Dalam Rangka Percepatan Penanganan Corona Virus Disease 2019 (Covid-19) harus dirumuskan secara jelas dalam menjalankan Undang-Undang tersebut. Karena keterbatasan dari peraturan pemerintah tersebut, maka pelaksanaannya dapat tidak sesuai dengan maksud dan tujuan dari pembentukan peraturan perundang-undangan. Dari adanya pernasalahan ini, rumusan masalah yg peneliti gunakan berupa bagaimana kepastian hukum Pasal 4 Peraturan Pemerintah Nomor 21 Tahun 2020 Dalam Rangka Percepatan Penanganan Corona Virus Disease 2019 (Covid-19) berbasis kepastian hukum? Metode penelitian yang digunakan dalam penelitian ini, menggunakan jenis penelitian yuridis normatif dan menggunakan pendekatan penelitian berupa pendekatan perundang-undangan dan pendekatan analisis. Jenis dan sumber bahan hukum penelitian ini menggunakan bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Hasil dari temuan dalam penelitian ini bahwa Pasal 4 Peraturan Pemerintah Nomor 21 Tahun 2020 tentang Pembatasan Sosial Berskala Besar (PSBB) Dalam Rangka Percepatan Penanganan Virus Diseases 2019 (COVID-19) tidak memberikan bentuk kepastian hukum dalam sistem pembentukan peraturan perundang-undangan karena tidak mengatur secara rinci atas bentuk pelaksanaan atau tata cara nekanisme atas pembatasan sosial berskala bersar (PSBB) yang dimana telah mendapatkan delegasi dari Pasal 59 dan Pasal 60 Undang-Undang Nomor 6 Tahun 2018 tentang Karantina Kesehatan. Sehingga dalam Pasal 4 Peraturan Pemerintah Nomor 21 Tahun 2020 tentang Pembatasan Sosisal Berskala Besar (PSBB) Dalam Rangka Percepatan Penanganan Virus Diseases 2019 (COVID-19) masih menuaikan multi tafsir dalam pengaturannya karena tidak memberikan kejelasan rumusan sebagaimana eksistensi dari peraturan pemerintah yang merupakan Peraturan Perundang- undangan yang ditetapkan oleh Presiden untuk menjalankan Undang-Undang sebagaimana mestinya.

English Abstract

The function of the formal establishment of a PP is to carry out further arrangements, other provisions in the law that regulates it, although it does not explicitly mention it as well as further regulation of provisions in the law which explicitly mentions it. If we review the norms in Article 4 of the PSBB PP in the Context of Accelerating the Handling of COVID-19, we can see that the PP does not contain the principle of conformity between types, hierarchies, and content materials as well as the clarity of the formulation of Article 60 of Law Number 6 of 2018 concerning Quarantine. Health. Where it should be and what is delegated by the Health Quarantine Act as the basis for the formation of the PP PSBB must be clearly formulated in carrying out the Act. Due to the limitations of the PP, its implementation may not be in accordance with the aims and objectives of the establishment of legislation. From this problem, the problem formulation that the researcher uses is in the form of How is the legal certainty of Article 4 of Government Regulation Number 21 of 2020 in the Context of Accelerating the Handling of Corona Virus Disease 2019 (Covid-19) based on legal certainty? The research method used in this study uses a normative juridical research type and uses a research approach in the form of a legal approach and an analytical approach. The types and sources of legal materials in this study used primary legal materials, secondary legal materials, and tertiary legal materials. The results of the findings in this study are that Article 4 of Government Regulation Number 21 of 2020 concerning Large- Scale Social Restrictions (PSBB) in the Context of Accelerating the Handling of Virus Diseases 2019 (COVID-19) does not provide a form of legal certainty in the system for establishing legislation because it does not regulate in detail on the form of implementation or mechanism for the large-scale socialization restriction (PSBB), which has received delegation from Article 59 and Article 60 of Law Number 6 of 2018 concerning Health Quarantine. So that Article 4 of Government Regulation Number 21 of 2020 concerning Large-Scale Social Restrictions (PSBB) in the Context of Accelerating the Handling of Virus Diseases 2019 (COVID-19) still has multiple interpretations in its regulation because it does not provide a clear formulation as to the existence of government regulations which are Legislative Regulations. -invitations set by the President to carry out the law as it should be.
