Abstract
“Penulis memilih tema ini karena penulis mengalami sendiri kegiatan pembuatan Rekening Dana Nasabah tidak sesuai dengan peraturan yang telah dibuat, yaitu proses pembuatan Rekening Dana Nasabah yang penulis alami tidak melakukan kegiatan tatap muka sesuai yang diatur pada peraturan Bank Indonesia, yang mensyaratkan setiap pembuatan Rekening maka bank wajib bertatap muka dengan calon nasabahnya minimal satu kali.” “Berdasarkan hal tersebut diatas, karya tulis ini mengangkat rumusan masalah : (1) Bagaimana Efektivitas Prinsip Pengenalan Nasabah (Know Your Customer Priciple), khususnya dalam pembukaan rekening atau penerimaan nasabah baru di Bank Rakyat Indonesia khususnya pembukaan Rekening RDN di Kantor Cabang BRI Bursa Efek Indonesia sudah sesuai dengan ketentuan perundang-undangan yang berlaku? (2) Bagaimana upaya hukum yang mungkin terjadi jika Bank tidak menerapkan Prinsip Pengenalan Nasabah (Know Your Customer Priciple) khususnya dalam pembukaan rekening atau penerimaan nasabah ?” “Kemudian penulisan karya tulis ini menggunakan metode Penelitian Sosiolegal dengan metode pendekatan Yuridis Sosiologis. Penelitian ini memakai Teknik analisis deskriptif analisis, yaitu suatu metode yang berfungsi untuk menggambarkan atau memberi ilustrasi terhadap objek yang diteliti melalui data atau sampel yang telah terkumpul sebagaimana adanya tanpa melakukan analisis dan menghasilkan konklusi yang berlaku untuk umum.” “Dari hasil penelitian dengan metode di atas, penulis memperoleh jawaban atas permasalahan yang ada bahwa terhadap peraturan dimaksud, Pasal 17, Bank telah melaksanakan secara efektif, namun terhadap ayat (2), Penulis berpendapat bahwa Bank belum sepenuhnya efektif melaksanakan, sehingga bank berpotensi terkena sanksi sebagaimana yang diatur pada Undang-Undang Perbankan No 10 tahun 1998. Tidak terpenuhinya ketentuan Pasal 17 Ayat (2) juga dapat berarti bahwa Perjanjian Pembukaan Rekening Simpanan antara Bank dengan Nasabahnya dapat dibatalkan karena tidak memenuhi syarat sahnya suatu perjanjian sebagaimana yang dimaksud pada Pasal 1320 KUH Perdata dan Pasal 1325.”
English Abstract
The author chose this theme because the author experienced directly the activities of creating Customer Fund Accounts that were not in accordance with the regulations that had been made, namely the process of creating a Customer Fund Account which the author experienced was not done face-to-face. - Facing activities as regulated in Bank Indonesia regulations requiring every account creation to be made by a bank. must meet face-to-face with prospective customers at least once. Based on the above, this paper raises the formulation of the problem: (1) How is the Effectiveness of Know Your Customer Principles, especially in opening accounts or accepting new customers at Bank Rakyat Indonesia, especially opening RDN Accounts at BRI Branch Offices on the Indonesia Stock Exchange? Is it in accordance with the applicable laws and regulations? (2) What legal remedies can occur if the Bank does not apply Know Your Customer Principles, particularly in opening accounts or accepting customers? Then the writing of this paper uses the Sociolegal Research method with the Sociological Juridical approach method. This study uses a descriptive analysis analysis technique, which is a method that serves to describe or describe the object under study through data or samples that have been collected as is without analyzing and producing conclusions that apply to the public. From the results of the research using the above method, the authors obtain answers to the existing problems that the provisions as referred to in Article 17 Banks have been implemented effectively, but in paragraph (2) the author is of the opinion that the Banks have not been fully implemented effectively, so that banks have the potential to be subject to penalty. as regulated in Banking Law no. 10 of 1998. Non-fulfillment of the provisions of Article 17 paragraph (2) may also mean that the Savings Account Opening Agreement between a Bank and its Customer can be canceled because it does not meet the legal requirements. agreement as referred to in Article 1320 of the Civil Code and Article 1325.
