Abstract
Pada skripsi ini, penulis mengangkat permasalahan mengenai Perlindungan Hukum Tindak Pidana Terhadap Korban Cyberpornografi Dengan Motif Balas Dendam (Revenge Porn). Pemilihan permasalahan ini dilatar belakangi oleh Indonesia merupakan salah satu negara yang sangat mengikuti perkembangan dalam hal teknologi. Saat ini, seluruh data serta informasi adalah hal yang seringkali dapat diakses oleh para pengguna teknologi melalui seluruh jaringan internet yang sangat berkembang pesat. Salah satu contohnya adalah suatu kekerasan seksual berbasis online dengan adanya motif balas dendam (revenge porn). Pornografi balas dendam ini merupakan bentuk dari ancaman atau tindakan dan pemaksaan terhadap seseorang terutama pada seorang perempuan untuk menyebarkan konten pornografi berupa video ataupun foto tanpa adanya persetujuan dari pihak korban. Berdasarkan hal diatas, karya tulis ini mengangkat rumusan masalah: (1) Apa sajakah Undang-Undang yang dapat menjerat pelaku tindak pidana cyberpornography dengan motif balas dendam (revenge porn)? (2) Bagaimanakah perlindungan hukum bagi korban atas penyebaran konten pornografi balas dendam (revenge porn) di sosial media? Kemudian peneliti skripsi ini menggunakan pendekatan hukum normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Dokumen hukum yang diperoleh penulis akan dianalisis dengan menggunakan teknik analisis interpretatif, termasuk penggunaan metode yuridis dalam membahas suatu persoalan hukum dengan menggunakan metode penafsiran yang terdapat dua metode yakni, metode sistematis yaitu dengan menafsirkan dokumen hukum yang ada serta menghubungkan pasal satu dengan pasal lainnya dalam suatu perundang-undangan yang bersangkutan. Dan metode gramatikal yaitu penafsiran yang menggunakan bahasa sehari-hari atau dari makna hukum yang umum untuk digunakan dengan adanya maksud serta tujuan. Dari hasil penelitian dengan metode diatas, penulis mendapatkan jawaban atas permasalahan yang ada bahwa hukum tindak pidana korban cyberpornography dengan motif balas dendam (revenge porn) juga menjelaskan mengenai Undang-Undang yang dapat menjerat pelaku tindak pidana ada 4 yaitu: 1) UU Nomor 1 Tahun 1946 tentang peraturan pidana, 2) UU Nomor 44 Tahun 2008 tentang Pornografi, 3) UU Nomor 19 tahun 2016 tentang Perubahan Atas UU Nomor 11 tahun 2008 mengenai Informasi dan Transaksi Elektronik (ITE), dan 4) UU Tindak Pidana Kekerasan Seksual (TPKS). Oleh karena itu, perlindungan hukum tindak pidana terhadap korban cyberpornography dengan motif balas dendam (revenge porn) merupakan perlindungan yang wajib dan harus didapatkan dikarenakan perlindungan hukum merupakan suatu hak asasi manusia serta tidak adanya perbedaan antara laki-laki ataupun perempuan di hadapan hukum atau dalam memperoleh perlindungan hukum.
English Abstract
In this thesis, the author raises the issue of the Legal Protection of Crime Against Cyberpornography Victims With Revenge Porn (Revenge Porn). The reason for choosing this problem is that Indonesia is one of the countries that closely follows developments in technology. Currently, all data and information are things that can often be accessed by technology users through the entire rapidly growing internet network. One example is an online-based sexual violence withamotive for revenge (revenge porn). Revenge pornography isaform of threat or action and coercion against someone, especiallyawoman, to spread pornographic content in the form of videos or photos without the consent of the victim. Based on the above, this paper raises the formulation of the problem: (1) What are the laws that can ensnare perpetrators of cyberpornography crimes with the motive of revenge (revenge porn)? (2) How the legal protection for victims for the spread of revenge porn on social media? Then the author of this paper usesanormative juridical method withastatute approach andacase approach. The legal material obtained by the author will be analyzed using interpretive analysis techniques, namely by using the juridical method in discussingalegal issue by using an interpretive method, there are two methods namely, the systematic method, namely by interpreting existing legal documents and linking one article to another inathe relevant legislation. And the grammatical method is an interpretation that uses everyday language or fromageneral legal meaning to be used with the intent and purpose. From the results of the research using the above method, the authors get answers to the existing problems that the law on criminal acts of cyberpornography victims witharevenge motive (revenge porn) also explains about 4 laws that can ensnare criminals, namely: 1) Law Number 1 Year 1946 concerning criminal regulations, 2) Law Number 44 of 2008 concerning pornography, 3) Law Number 19 of 2016 concerning amendments to Law number 11 of 2008 concerning electronic information and transactions (ITE), and 4) Law on the Crime of Sexual Violence (TPKS). Therefore, legal protection of criminal acts against victims of cyberpornography with the motive of revenge (revenge porn) isamandatory protection and must be obtained because legal protection isahuman right and there is no difference between men and women before the law or in obtaining legal protection.
