Abstract
Pada Skripsi ini, penulis mengangkat isu hukum terkait Pelaksanaan Tanggung Jawab Hukum dari Pejabat Lembaga Peradilan Terhadap Eksekusi Putusan Yang Tidak Dilaksanakan. Pilihan tema tersebut dilatarbelakangi oleh adanya keadaan di masyarakat bahwa eksekusi putusan yang telah dimohonkan oleh pihak yang menang dalam perkara gugatan tidak dilaksanakan. Berdasarkan hal tersebut, maka dirumuskan 2 (dua) rumusan masalah. Rumusan masalah yang pertama tentang kendala yang menyebabkan eksekusi putusan tidak dilaksanakan dan rumusan masalah kedua adalah pelaksanaan tanggung jawab hukum pejabat Lembaga Peradilan terhadap eksekusi putusan yang tidak dilaksanakan. Jenis penelitian ini adalah penelitian sosio-legal dengan metode pendekatan yuridis sosiologis. Data Hukum yang diperoleh penulis akan dianalisis dengan menggunakan teknik analisis deskriptif analitis yaitu suatu metode analisis bahan hukum dengan cara melakukan menentukan isi atau makna aturan hukum terkait pelaksanaan eksekusi putusan, wewenang dan tanggung jawab pejabat Lembaga peradilan dalam melaksanakan eksekusi putusan, dan pendapat para ahli terkait pelaksanaan eksekusi putusan. Dari hasil penelitian dengan metode di atas, penulis memperoleh jawaban atas permasalahan yang ada, yaitu dalam melaksanakan eksekusi putusan, pejabat lembaga peradilan bertindak berdasarkan wewenang dan tanggung jawab yang diperoleh dari undang-undang. Adapun kendala yang menyebabkan tidak dilaksanakannya eksekusi putusan adalah disebabkan oleh tidak diserahkannya berkas-berkas yang dimintakan oleh pengadilan ataupun kurangnya biaya panjar dalam proses eksekusi putusan dan juga terjadinya pergantian pejabat pengadilan dalam proses eksekusi putusan. Kemudian tanggung jawab hukum terhadap eksekusi putusan yang tidak dilaksanakan, bilamana disebabkan lalainya pejabat lembaga peradilan dapat diberikan sanksi administratif berdasarkan sidang kode etik.
English Abstract
In this thesis, the author raises legal issues related to the Implementation of Legal Responsibilities of Judicial Institution Officials Against the Execution of Decisions that are Not Implemented. The choice of the theme was motivated by the situation in the community that the execution of the decision that had been requested by the winning party in the lawsuit was not carried out. Based on this, then formulated 2 (two) problem formulations. The first formulation of the problem concerns the obstacles that cause the execution of decisions not to be carried out and the formulation of the second problem is the implementation of the legal responsibility of Judicial Institution officials for the execution of decisions that are not implemented. This type of research is a socio-legal research with a sociological juridical approach. The legal data obtained by the author will be analyzed using analytical descriptive analysis techniques, namely a method of analyzing legal materials by determining the content or meaning of legal rules related to the execution of decisions, the authorities and responsibilities of judicial institutions in carrying out the execution of decisions, and the opinions of related experts. execution of the decision. From the results of the research with the above method, the authors obtain answers to existing problems, namely in carrying out the execution of decisions, officials of the judiciary act based on the authorities and responsibilities obtained from the law. The obstacles that cause the execution of the decision not to be carried out are caused by the non-submission of the files requested by the court or the lack of down-payment fees in the execution process of the decision and also the change of court officials in the process of executing the decision. Then the legal responsibility for the execution of decisions that are not carried out, if due to the negligence of judicial officials, can be given administrative sanctions based on the code of ethics trial.
