Abstract

Pada penelitian ini penulis mengangkat permasalahan mengenai Pelaksanaan Peraturan Gubernur (Pergub) Jawa Timur No. 27 Tahun 2016 Terkait Penetapan Batas Tarif Angkutan Penumpang Antar Kota Dalam Provinsi Selama Pandemik COVID-19. Pаdа pandemik COVID-19 sааt ini sektor angkutan turut berperan dan terkena imbas dalam kebijakan yang dibuat oleh pemerintah guna melakukan percepatan penanganan COVID-19. Berdasarkan latar belakang tersebut, maka permasalahan hukum yang dikemukakan dalam penelitian ini adalah Bagaimanakah Pelaksanaan Peraturan Gubernur (Pergub) Jawa Timur No. 27 Tahun 2016 Terkait Penetapan Batas Tarif Angkutan Penumpang Antar Kota Dalam Provinsi Selama Pandemik Covid-19, Apa yang menjadi dasar PERGUB Jawa Timur No. 27 Tahun 2016 Terkait Penetapan Batas Tarif Angkutan Penumpang Antar Kota Dalam Provinsi tidak ditaati Selama Pandemik Covid-19, serta Apa saja hambatan dan upaya Dinas Perhubungan Provinsi dalam mengatasi hambatan tersebut dalam adanya penetapan batas tarif selama pandemik Covid-19. Untuk menjawab permasalahan di atas, penelitian yang dilakukan adalah penelitian hukum yuridis-empiris yang menggunakan pendekatan yuridis sosiologis. Lokаsi penelitiаn dilakukan di Dinаs Perhubungan Provinsi Jawa Timur yаng berаlаmаt di Jl. Ahmad Yani No. 268, Menanggal, Gayungan, Kota SBY, Jawa Timur 60234. Teknik memperoleh bahan hukum dilakukan dengan wawancara dan studi kepustakaan. Berdasarkan pembahasan, disimpulkan bahwa Pelaksanaan Peraturan Gubernur (Pergub) Jawa Timur No. 27 Tahun 2016 Terkait Penetapan Batas Tarif Angkutan Penumpang Antar Kota Dalam Provinsi Selama Pandemik COVID-19 diаnggаp penulis sudah tidak lagi efektif.

English Abstract

In this study, the authors raised issues regarding the implementation of East Java Governor Regulation No. 27 of 2016 regarding the Determination of Inter-City Passenger Transport Rate Limits in Provinces During the COVID-19 Pandemic. In the current COVID-19 pandemic, the transportation sector plays a role and is affected by the policies made by the government to accelerate the handling of COVID-19. Based on this background, the legal issues raised in this study are how to implement the East Java Governor Regulation Number 27 of 2016 Regarding the Determination of Inter-City Passenger Transport Rate Limits in the Province During the Covid-19 Pandemic, What is the basis for East Java Governor Regulation Number 27 Year 2016 Regarding the Determination of Tariff Limits for Inter-City Inter-Provincial Passenger Transport not being adhered to during the Covid-19 Pandemic, as well as what are the obstacles and efforts of the Provincial Transportation Service in overcoming these obstacles in the setting of tariff limits during the Covid-19 pandemic. To answer the above problems, the research conducted is juridicalempirical law research that uses a sociological juridical approach. The location of the research was carried out at the Department of Transportation of the Province of East Java, which is located at Jl. Ahmad Yani No. 268, Menanggal, Gayungan, City of Surabaya, East Java 60234. Techniques for obtaining legal materials were carried out by interviewing and studying the literature. Based on the discussion, it was concluded that the implementation of East Java Governor Regulation Number 27 of 2016 Regarding the Determination of Inter-City Passenger Transport Tariffs Within the Province During the COVID-19 Pandemic, the author considers no longer effective.
