Abstract

Penelitian ini membahas mengenai implementasi “Pasal 24 Huruf Q Peraturan Daerah Provinsi Nusa Tenggara Barat Nomor 5 Tahun 2019 tentang Pengelolaan Sampah” yang bertempatdi Dinas Lingkungan Hidup Kabupaten Lombok Barat (DLH). Implementasi ini khususnya dikaji dalam proses pengawasan, pengendalian, serta pengembangan sampah regional yang berlokasi pada Kabupaten Lombok Barat yang dilakukan oleh Dinas Lingkungan Hidup Kabupaten Lombok Barat sebagai Lembaga Teknis Daerah yang merupakan salah satu unsur pendukung tugas Bupati yang bertugas melaksanakan “penyusunan dan pelaksanaan kebijakan daerah yang bersifat spesifik”. Dari latar belakang tersebut, maka dikemukakan rumusan masalah yakni bagaimana implementasi Pasal 24 Huruf Q Peraturan Daerah Provinsi Nusa Tenggara Barat Nomor 5 Tahun 2019 tentang Pengelolaan Sampaholeh Dinas Lingkungan Hidup Kabupaten Lombok Barat terhadap pengelolaan sampah regional dan apa kendala dan upaya Dinas Lingkungan Hidup Kabupaten Lombok Barat dalam mengimplementasikan Pasal 24 Huruf Q Peraturan Daerah Provinsi Nusa Tenggara Barat Nomor 5 Tahun 2019 tentang Pengelolaan Sampah. Penelitian ini menggunakan jenis penelitian yuridis empiris yaitu penelitian hukum dengan cara studi lapangan yang menggunakan pendekatan yuridis sosiologis yang terkait dengan pelaksanaan hukum yang berada dalam masyarakat secara nyata, dan menggunakan teknik analisis data deskriptif analisis. Lokasi penelitian yaitu pada Dinas Lingkungan Hidup Kabupaten Lombok Barat, ini karena Dinas Lingkungan Hidup Kabupaten Lombok Barat mempunyaiwewenang dalam halpengawasan, pengendalian, dan pengembangan sampah regional di Kabupaten Lombok Barat. Dari hasil penelitian berdasarkan rumusan masalah diatas bahwa secara keseluruhan Dinas Lingkungan Hidup Kabupaten Lombok Barat telah mengimplementasikan Pasal 24 HurufQPeraturan Daerah Nomor5Tahun 2019 xiv berupa pengawasan, pengendalian, dan pengembangan sampah regional, meskipun terdapat kendala yang menghambat proses pelaksanaannya seperti kurangnya kemandirian masyarakat, kurangnya pemanfaatan sampah, kurangnya jumlah armada persampahan, kurangnya sosialisasi, dan keterbatasan dana operasional dalam pengelolaan sampah.

English Abstract

This research is based on the implementation of “Article 24 LetterQRegulation of West Nusa Tenggara Province Number5of 2019” concerning Regional Waste Management at the Environmental Service of West Lombok Regency. This implementation is specifically studied in the process of monitoring, controlling, and developing regional waste located in West Lombok Regency which is carried out by the West Lombok Regency Environmental Service asaRegional Technical Institution which is one of the supporting elements of the Regent's task in charge of implementing "the preparation and implementation of regional policies. specific one". From the background, the formulation of the problem is presented, namely how to Implement“Article 24 LetterQof the Regional Regulation of the Province of West Nusa Tenggara Number5of 2019” concerning Regional Waste Management by the Environmental Service of West Lombok Regency towards regional waste management and what are the obstacles and efforts of the West Lombok Regency Environmental Service in implementing Article 24 LetterQRegional Regulation of West Nusa Tenggara Province Number5of 2019 concerning Regional Waste Management. This study usesatype of empirical juridical research, namely legal research by means of field studies that useasociological juridical approach that is related to the actual implementation of law in society, and uses descriptive data analysis techniques. The research location is at the Environmental Service of West Lombok Regency because West Lombok Regency Environmental Service has authority in term of the process of monitoring, controlling, and developing regional waste in West Lombok Regency. From the results of research based on the formulation of the problem above, overall the Environmental Service of West Lombok Regency has implemented “Article 24 LetterQof Regional Regulation Number5of 2019” in the form of supervision, control, and development of regional waste, although there xvi are obstacles that hinder the implementation processsuch as the lack of community independence, lack of waste utilization, lack of the number of waste fleets, lack of socialization, and limited operational funds in waste processing.
