Abstract
Pada skripsi ini, penulis mengangkat permasalahan mengenai Perlindungan Hukum Bagi Anak Korban Eksploitasi Ekonomi Melalui Media Sosial Sebagai Kid Influencers di Indonesia, serta bagaimana dampak yang ditimbulkan dari eksploitasi ekonomi anak sebagai kid Influencers. Berdasarkan hal tersebut di atas, karya tulis ini sendiri mengangkat permasalahan terkait: (1) Apakah kid Influencers dapat dikatakan sebagai tindakan eksploitasi secara ekonomi terhadap anak? (2) Bagaimana perlindungan hukum mengenai kid Influencers sebagai suatu tindakan eksploitasi secara ekonomi terhadap anak ke depannya di Indonesia? Jenis penelitian yang diterapkan pada penulisan penelitian hukum ini merupakan penelitian hukum yuridis normatif dengan menerapkan metode pendekatan perundang-undangan (statute approach) dan pendekatan perbandingan hukum. Bahan hukum yang diperoleh oleh penulis sendiri akan dianalisis dengan menggunakan suatu teknik interpretasi sistematis yaitu upaya dalam mencari keterkaitan antara rumusan suatu konsep hukum atau proposisi hukum antara suatu Peraturan Perundang-Undangan baik yang sederajat maupun tidak sederajat. Dari hasil penelitian dengan metode di atas, penulis memperoleh hasil bahwa tindakan kid Influencers yang sedang marak di media sosial saat ini termasuk ke dalam tindakan eksploitasi ekonomi anak. Selain itu perlindungan hukum bagi kid Influencers di Indonesia sendiri masih mengalami kekaburan hukum. Oleh karena itu untuk mencegah terjadinya kekaburan hukum dan untuk memenuhi hak-hak anak yang menjadi seorang kid Influencers ke depannya, maka pemerintah harus menyusun suatu peraturan hukum secara khusus terkait dengan kid Influencers.
English Abstract
In this thesis, the author raises the issue of Legal Protection for Kid Influencers as Victims of Underage Economic Exploitation Through Social Media in Indonesia, as well as analyzing the impact of economic exploitation on kid Influencers. Based on the statement above, this paper discusses: (1) Does ‘kid Influencers’ fall under the category of underage economic exploitation? (2) If it is indeed an exploitation, what forms of legal protection are available for kid influencers in Indonesia? This legal research relies on normative juridical law research as its primary research method. It is conducted by applying the method of the statutory approach (statute approach) and the legal comparison approach. Legal materials obtained by the author herself will be analyzed usingasystematic interpretation technique, which refers to an effort to discoveralink between the formulation ofalegal concept or legal proposition between Law and Regulations, whether they are equal or inequal. Upon conducting legal research based on the research method, the author concluded that the phenomena of kid Influencers on social media does fall under the act of underage economic exploitation. Furthermore, the author discovered that there is still unfortunatelyarampant legal obscurity on kid Influencers legal protection in Indonesia. To conclude, the author suggests that the government must draft and passalegal regulation specifically dedicated to providingaclear and elaborate protection for kid Influencers in Indonesia.
