Abstract
Pada skripsi ini, penulis mengangkat permasalahan Pelaksanaan Pemungutan Retribusi Parkir di Tepi Jalan Umum berdasar Peraturan Daerah Kabupaten Wonogiri No 7 Tahun 2020 Tentang Perubahan Kedua Atas Peraturan Daerah Kabupaten Wonogiri No 1 Tahun 2012 Tentang Retribusi Jasa Umum. Pemilihan judul tersebut dilatarbelakangi oleh karena adanya penurunan realisasi pendapatan retribusi pelayanan parkir di tepi jalan umum pada tahun 2020 yang sangat signifikan, yakni sebesar 51,2% dan pada tahun 2021 sebesar 39,01% dibandingkan dengan tahun 2019 yakni realisasi pendapatan sebanyak Rp.476.918.500. Berdasar hal tersebut diatas, karya tulis ini merumuskan masalah : (1) Bagaimanakah pelaksanaan pemungutan retribusi parkir ditepi jalan umum oleh Dinas Perhubungan Kabupaten Wonogiri? (2) Apa saja yang menjadi hambatan yang pelaksanaan pemungutan retribusi parkir ditepi jalan umum oleh Dinas Perhubungan Kabupaten Wonogiri? (3) Bagaimana upaya Dinas Perhubungan Kabupaten Wonogiri dalam menghadapi hambatan tersebut? Kemudian penulisan karya tulis ilmiah ini menggunakan metode sosio-legal dengan pendekatan yuridis-sosiologis. Bahan hukum primer dan sekunder yang diperoleh penulis akan dianalisis dengan teknik analisis deskriptif kualitatif yakni dengan menyajikan data yang telah diperoleh dan diolah kemudian dianalisis data kualitatifnya, melalui tahap reduksi data, penyajian, dan kemudian menarik kesimpulan. Dari hasil penelitian dengan metode di atas, penulis memperoleh jawaban atas permasalahan yang ada bahwa, Pelaksanaan pemungutan retribusi parkir di tepi jalan umum Kabupaten Wonogiri oleh Dinas Perhubungan Kabupaten Wonogiri dialihkan kepada pihak ketiga melalui tender kepada CV. Karya Angkasa, kerjasama dilakukan antara CV. Karya Angkasa dengan Dinas Perhubungan melalui Surat Perjanjian No : 511.2/667/2021 selama 1 (satu) tahun kerja. Pengalihan pengelolaan tersebut ternyata bertentangan dengan Pasal 96 ayat (1) Peraturan Daerah Kabupaten Wonogiri No 7 Tahun 2020 Tentang Perubahan Kedua Atas Peraturan Daerah Kabupaten Wonogiri No 1 Tahun 2012 Tentang Retribusi Jasa Umum dimana disebutkan bahwa pemungutan retribusi tidak dapat diborongkan. Serta dalam pelaksanaan, meskipun telah dibentuknya Tim Pengawas dan Pengendalian Perparkiran Kabupaten Wonogiri, masih ditemukan banyaknya Juru Parkir ilegal yang beroprasi di wilayah Kabupaten Wonogiri, hal ini menjadi salah satu sumber kebocoran pendapatan daerah yang berakibat terjadinya penurunan pendapatan retribusi parkir di tepi jalan umum selama 2 (dua) tahun terakhir.
English Abstract
In this thesis, the author raises the issue of the Implementation of Collection of Parking Retribution on the Edge of Public Roads based on the Wonogiri Regency Regulation No. 7 of 2020 concerning the Second Amendment to the Wonogiri Regency Regional Regulation No. 1 of 2012 concerning Public Service Retribution. The reason for choosing the title was due to a very significant decrease in the realization of parking service retribution revenues on public roads in 2020, which was 51.2% and in 2021 it was 39.01% compared to 2019, namely the realization of revenues of Rp. 476,918. .500. Based on the above, this paper formulates the following problems: (1) How is the implementation of the collection of parking fees on the side of public roads by the Wonogiri Regency Transportation Service? (2) What are the obstacles that hinder the implementation of the collection of parking fees on public roads by the Transportation Service of Wonogiri Regency? (3) What are the efforts of the Wonogiri Regency Transportation Office in dealing with these obstacles? Then the writing of this scientific paper uses the socio-legal method with a juridical- sociological approach. The primary and secondary legal materials obtained by the author will be analyzed using qualitative descriptive analysis techniques, namely by presenting the data that has been obtained and processed and then analyzing the qualitative data, through the stages of data reduction, presentation, and then drawing conclusions. From the results of the research using the above method, the authors obtained answers to the existing problems that, the implementation of the collection of parking fees on the edge of the Wonogiri Regency public road by the Wonogiri Regency Transportation Service was transferred to a third party through a tender to CV. Karya Angkasa, the collaboration between CV. Karya Angkasa with the Department of Transportation through Letter of Agreement No: 511.2/667/2021 for 1 (one) year of work. The transfer of management turned out to be contrary to Article 96 paragraph (1) of the Wonogiri Regency Regulation No. 7 of 2020 concerning the Second Amendment to the Wonogiri Regency Regulation No. 1 of 2012 concerning Public Service Retribution where it was stated that the collection of levies could not be wholesaled. As well as in implementation, although the Wonogiri Regency Parking Supervision and Control Team has been established, there are still many illegal parking attendants operating in the Wonogiri Regency area, this has become one of the sources of regional revenue leakage which has resulted in a decrease in parking retribution revenues on the edge of public roads for 2 (two)years ago
