Abstract
Pada skripsi ini penulis mengangkat permasalahan terkait efektivitas penerapan protokol kesehatan pencegahan penyebaran virus Corona Virus Disease 2019 yang dilakukan Satuan Polisi Pamong Praja Kota Malang terhadap para pelaku usaha di Kota Malang dengan berdasarkan pada Peraturan Wali Kota Malang Nomor 30 Tahun 2020 tentang Penerapan Disiplin dan Penegakan Hukum Protokol Kesehatan Sebagai Upaya Pencegahan dan Pengendalian Corona Virus Disease 2019 dengan cara meneliti kinerja Satuan Polisi Pamong Praja Kota Malang, serta meneliti penyebab tidak taatnya para pelaku usaha dalam menerapkan protokol kesehatan. Berdasarkan hal tersebut di atas, maka rumusan masalah yang penulis angkat dalam skripsi ini adalah : 1) Bagaimana strategi yang dilakukan Satuan Polisi Pamong Praja Kota Malang dalam upaya penegakan Peraturan Wali Kota Malang Nomor 30 Tahun tentang Penerapan Disiplin dan Penegakan Hukum Protokol Kesehatan Sebagai Upaya Pencegahan dan Pengendalian Corona Virus Disease 2019?, 2) Mengapa Peraturan Walikota Malang Nomor 30 Tahun 2020 tentang Penerapan Disiplin dan Penegakan Hukum Protokol Kesehatan Sebagai Upaya Pencegahan dan Pengendalian Corona Virus Disease 2019 tidak ditaati oleh beberapa pelaku usaha di Kota Malang?, 3) Apa faktor yang menghambat Satuan Polisi Pamong Praja Kota Malang dalam upaya penegakan Peraturan Walikota Malang Nomor 30 Tahun 2020 tentang Penerapan Disiplin dan Penegakan Hukum Protokol Kesehatan Sebagai Upaya Pencegahan dan Pengendalian Corona Virus Disease 2019?. Kemudian penulisan skripsi ini menggunakan metode yuridis empiris dengan pendekatan yuridis sosiologis. Data primer dan sekunder yang diperoleh penulis akan dianalisis dengan menggunakan teknik analisis deskriptif kualitatif, teknik ini penulis gunakan agar memudahkan pembaca dan penulis untuk memahami serta menarik kesimpulan dari penelitian yang telah dilakukan. Dari hasil penelitian dengan metode di atas, penulis memperoleh jawaban atas permasalahan yang ada yaitu Satuan Polisi Pamong Praja Kota Malang memiliki beberapa strategi untuk mewujudkan efektivitas hukum Peraturan Wali Kota Malang Nomor 30 Tahun 2020 tentang Penerapan Disiplin dan Penegakan Hukum Protokol Kesehatan Sebagai Upaya Pencegahan dan Pengendalian Corona Virus Disease 2019 dengan menggunakan beberapa platform atau media penyaluran aspirasi masyarakat serta patroli rutin dan penyediaan Intelijen Satuan Polisi Pamong Praja, kemudian faktor utama yang menghambat Satpol PP Kota Malang dalam menegakkan Peraturan Wali Kota Malang Nomor 30 Tahun 2020 adalah dari kesadaran masyarakat, dan yang terakhir yaitu terdapat beberapa faktor yang menyebabkan para pelaku usaha di Kota Malang tidak menaati Peraturan Wali Kota Malang Nomor 30 Tahun 2020.
English Abstract
In this thesis, the author raises issues that related to the effectiveness of implementing the health protocols to prevent the spread of the Corona Virus Disease 2019 carried out by Satuan Polisi Pamong Praja Kota Malang based on Malang Mayor Regulation Number 30 of 2020 concerning the Implementation of Dicipline and Health Protocol Law Enforcement as an Effort To Prevent and Control the Corona Virus Disease 2019 by doing some research about the performance of Satuan Polisi Pamong Praja Kota Malang and also doing some research about the causes of disobedience act that has been done by some business actors in Malang City in implementing the health protocols. Based on the explanation above, the author takes and raises some formulation of the problems which are: 1) What is the strategy carried out by the Satuan Polisi Pamong Praja Kota Malang in an effort to enforce the Malang Mayor Regulation Number 30 of 2020 concerning the Implementation of Dicipline and Health Protocol Law Enforcement as an Effort To Prevent and Control the Corona Virus Disease 2019?, 2) Why are there still a lot of business actors in Malang City that disobeying the Malang Mayor Regulation Number 30 of 2020 concerning the Implementation of Dicipline and Health Protocol Law Enforcement as an Effort To Prevent and Control the Corona Virus Disease 2019?, 3) What is the factors that obstruct the Satuan Polisi Pamong Praja Kota Malang in an effort to enforce Malang Mayor Regulation Number 30 of 2020 concerning the Implementation of Dicipline and Health Protocol Law Enforcement as an Effort To Prevent and Control the Corona Virus Disease 2019?. The method of this thesis uses an empirical juridical method with a sociological juridical approach. The primary and secondary data that has been obtained by the author will be analyzed using qualitative descriptive analysis techniques, the author’s reason to using this techniques is to make it easier for the readers and writers to help them understanding and making conclusions from the research that has been done. Based on the results of the research above, the author obtained answers to the existing problems which are, Satuan Polisi Pamong Praja Kota Malang has several strategy to help them realizing the legal effectiveness of Malang Mayor Regulation Number 30 of 2020 concerning the Implementation of Dicipline and Health Protocol Law Enforcement as an Effort To Prevent and Control the Corona Virus Disease 2019 by using several platforms or media for channeling the public aspirations, doing a routine patrol, and also the provision of intelligence of Satuan Polisi Pamong Praja Kota Malang, and then the main factor that hinders the Satuan Polisi Pamong Praja Kota Malang in enforcing Malang Mayor Regulation Number 30 of 2020 concerning the Implementation of Dicipline and Health Protocol Law x Enforcement as an Effort To Prevent and Control the Corona Virus Disease 2019, and lastly, there are several factors that causes the disobedience act of several business actors in Malang City in implementing the Malang Mayor Regulation Number 30 of 2020 concerning the Implementation of Dicipline and Health Protocol Law Enforcement as an Effort To Prevent and Control the Corona Virus Disease 2019.
